In the name of God, Amen, I JOHN COSBY of Warren County and State of Kentucky, being weak in body but of sound and perfect mind and memory blessed be almighty God, for the same, do make and publish this my last will and testament in manner and form following that is to say:

First I give to my son JOEL COSBY, one negro boy named peter, one bed, cow and calf. To my daughter, ELIZABETH LANDRUM, I give one negro girl named Winney, one bed and one cow and calf. To my son JOHN COSBY, I give one negro girl named Mariah, one bed and one cow and calf. To my daughter MARY HERNDON, I give one negro girl named Hester, one bed and one cow and calf. To my daughter NANCY COLEMAN, I give one negro girl named Frankey one bed and one cow and calf. To my daughter PATSEY COSBY, I give one negro girl named Clary, one bed and one cow and calf. To my daughter AMADIAH GRIFFON, I give one negro girl named Kiziah, one bed and one cow and calf. To my son ARCHIBALD COSBY, I give one negro boy named Ben, one bed and one cow and calf. To my son WILLIAM COSBY, I give one negro boy named Kent, one cow and calf and one bed. To my son NATHAN COSBY, I give one negro girl named Caroline, one bed and one cow and calf. To my son VALENTINE COSBY, I give one negro boy named Jordan, one bed and one cow and calf.

The above property, I had given into the possession of my children, except my son John, one cow and calf he has not yet got; NANCY COLEMAN has not yet got a bed nor cow and calf. PATSEY has not yet got her negro, bed, cow and calf. Amanda Griffon has not yet got her cow and calf. My son ARCHIBALD COSBY has not yet got his negro boy, cow, calf or bed. VALENTINE COSBY has not got his negro boy, bed, nor cow & calf. Which property is to be given them when they leave me or at my death so as to make them all [____?] negro, bed and cow and calf.

The Balance of my estate to my wife JEMIMA COSBY [for] her life time - negroes, household and kitchen furniture, stock and plantation tools. At her death to be sold and equally divided among all my children. It is also to be understood - the property I left to ELIZABETH LANDRUM is at her death to be given to her son JOHN C. EMERSON. It is also to be understood that If any one or more of my children should die without an heir of their body, the property given them shall be equally divided among the surviving.

Also I make choice of my son WILLIAM COSBY & NATHAN COSBY to be my Executors of this my last will and testament, hereby revoking all former wills, by me made, ratifying and confirming this one and no other. In witness thereof I have hereunto set my hand and seal this 12th day of [June 1824?]

Signed, sealed, published and declared by the JOHN COSBY testator JOHN COSBY to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator.

Codicil:

I, JOHN COSBY of Barren County, state of Kentucky, do this nineteenth day of September 1840 make and publish this codicil to my last will and testatment for good reasons to me thereunto moving I desire by may. . . I do hereby constitute & appoint my Grandson JOHN C. EMERSON as trustee in trust for the management of the part above bequeathed to my son ARCHIBALD Y. COSBY to be by said trustee applied to the use and benefit of my said son ARCHIBALD COSBY in that manner that said trustee may conscientiously believe would be most beneficial to my said son, and I further desire and wish RUSSELL BARRACK & FRANKLIN SETTLE to be my Executors in the room and stead of them that is named in my foregoing will as above. In witness whereof I have hereunto set my hand and seal the day and year above written.

The foregoing writing purporting to be the last will of JOHN COSBY, deceased, and the codicil attached thereto and said will was proven in due form of law by the oath of JOHN BECKHAM and WALLER [LARRANCE?], subscribing witnesses thereto and said codicil was proven by the oath of JOEL DICKINSON and WASHINGTON SMITH, subscribing witnesses thereto, whereupon the same was ordered to be recorded as the true last will of said JOHN COSBY, deceased.
