LILY'S KIDS FAMILY CHILD CARE CONTRACT

To Provide Child Care Services

This agreement between the Child Care Provider Lilian Allen hereinafter "PROVIDER", and «PARENTS NAME» hereinafter "PARENTS", is to provide for child care services for «CHILD'S NAME» hereinafter "CHILD".

The parties agree that the PROVIDER will render child care services in her home, located at “my address”. The PARENTS understand that the service is an extension of the “the name of the army base where I live” CHILD Development Services (CDS), but that this agreement is contracted, solely between the PARENTS and the PROVIDER.

Both parties agree that they have read and understand the Family Child Care Parent Handbook, a document published by Child Development Services; that both parties agree to abide by this document; and that they shall be incorporated by reference herein.

The PROVIDER agrees that she will:

A. provide child care from «START TIME» to «ENDING TIME», «START DAY» through «END DAY», except that service is not available on recognized federal holidays, or military training holidays; B. feed the CHILD one breakfast, one lunch, and one snack per day, such meals to comply with U.S.D.A nutritional guidelines; C. keep hygiene items available in order to keep CHILD clean; D. provide daily activities, toys and materials with which to entertain, educate and develop the CHILD; E. provide her name, address and taxpayer identification number (social security number) for the PARENT to use to qualify for Child Care Credit when submitting their 1996 income tax returns; F. comply with all requirements, policies, and inspections of the Child Development Services.

The PARENT(S) agree that they will:

A. leave and pick up their CHILD within the times set above; B. inform the PROVIDER of illness or problems that could affect other children in the care of the PROVIDER; C. complete forms DA Form 4719-R, Registration Card; DA Form 5222-R, 5224-R,Child and Family Profile; DA Form 5223-R, Child Health Assessment; Statement of Understanding Regarding Home Based Child Care; U.S.D.A Registration Form; and Provider's Child Information Sheet, all which are incorporated by reference herein; D. comply with all requirements and policies of the Child Development Services; _______________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________ The parties agree that in exchange for these child care services, the PARENT(S) will pay the PROVIDER the following fees:

a. a $«DEPOSIT AMT» deposit, due upon signing and execution of this agreement, said deposit being refundable upon the payment of all balances owed at the termination of this contract; b. $«RATE» per week as a flat rate for the times set above, payable in advance; c. $«LATE FEE» per day late fee if weekly rate is not paid in advance; d. $«HOUR LATE FEE» per hour or any fraction of an hour if the PARENT(S) fail to pick up the CHILD by the times stated above.

The parties agree that all such payments shall be made in cash, check, or money order, with a $20.00 fee for returned checks, plus $10.00 per day late fees until balance is settled. PARENT(S) going on leave or vacation may pay one-half (1/2) the weekly rate in order to retain a day-care slot for the CHILD, however, they must give two (2) weeks written notice of their intention to do so.

Both parties agree that if arrangements are made for child care, the PARENT(S) will pay for that service whether they use it or not.

Both parties agree that the following policies are in effect:

A. Touch Policy:

1. Provider recognizes the importance of physical contact to child nurturance and guidance and will respect personal privacy and space of children. 2. Appropriate touching, including hugs, lapsitting, reassuring touches on shoulders, nap time back rubs and responses that affect the safety and well-being of child, such as hand-holding when crossing the street, will be utilized by the provider. 3. Inappropriate touching that exploits children's lack of knowledge, that is for the satisfaction of adult's needs at child's expense, that is in violation of laws against sexual contact between adults and children, or attempts to change child's behavior between adults and children, or attempts to change child's behavior with adult physical force applied in anger is not permitted. 4. Other examples of inappropriate touching includes forced good-bye kisses, corporal punishment, slapping, striking, pinching, prolonged tickling, fondling or molestation and is not allowed.

B. Discipline:

1. Discipline will be constructive in nature, including such methods as: a. Praise for appropriate behavior. b. Diversion. c. Separation of the child from situations. 2. A child will not be punished by: a. Spanking, shaking, or other corporal punishment. b. Isolation away from adult sight and/ or contact. c. Humiliation or verbal abuse. d. Deprivation of meals, snacks, outside or inside play opportunities. e. Extended periods of time out (e.g. in excess of one minute per year of age).

C. Illness/Medication: 1. Child will be denied service based on the following: a. Auxiliary temperature greater that 101 F. b. Obvious illness such as impetigo, scabies, ringworm, chicken pox, head lice, conjunctivitis (pink eye), severe diarrhea, vomiting, strep throat that has not been symptoms of other contagious diseases.

2. Child will be on oral medication at least 24 hours before dosage is administered by provider. Physician or parent will administer the first dosage of medication.

3. If a child is removed from the provider's home due to illness, that child will not be readmitted to the home that same day.

4. No over the counter medication will be administered unless ordered by prescription (this includes tylenol).

5. In the event of the provider's own children becoming ill with a contagious illness, provider will give the parents as much notice as possible to enable them to make alternate arrangements for the care if their child/ren until provider's children are recovered

D. Abuse/Neglect:

1. The FCC Provider is mandated by law to report to the proper authorities any evidence of child abuse or neglect.

Both parties agree that two weeds written notice by either party is required to terminate this contract or notify of changes in the schedule. Parties are still required to perform their contractual obligation throughout the two week period prior to termination. PARENTS failing to pay for child care services on time will have those services terminated immediately.

The parties agree to the following miscellaneous provisions: «MISC»__________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________ THIS CONTRACT IS LEGALLY BINDING ON BOTH PARTIES AND SUBJECT TO ENFORCEMENT THROUGH ANY LAWFUL MEANS. ANY PARTY IN DEFAULT IS LIABLE FOR ATTORNEY'S FEES, COURT COSTS AND ANY OTHER EXPENSES INCURRED IN ENFORCEMENT, IF APPLICABLE.
