To the worshipful Court of Norfolk County sitting in chancery humbly complaining herewith to your worships your orators James Cuthrell, John Cuthrell, Richard Cuthrell and Teagle W. Cuthrell.
That Thomas Cuthrell, father of your orators, formerly of this county departed this life intestate in the year 1812 seized and possessed of a tract of land in said county containing about ninety acres situated near Bell's mill. That the said intestate left six children at his death to wit your orators, and Nathaniel and Nelson Cuthrell, the latter of whom hath since departed this life in his minority and without having been married or leaving issue by which the interest which he was entitled to in the land passed to his other brothers who are now entitled to the whole land.
And your orators further state to your worships that being entitled under the death aforesaid to portions of the said land they are anxious that their interests respectively may be allotted & set apart. That the said tract of land is not worth more than three hundred dollars so that the dividend of each heir would not be worth one hundred dollars and as under these circumstances the law authorizes a sale of the land & division of the proceeds your orators desire that the same may be sold and the money owing be equally divided among those entitled. But as the said Nathaniel Cuthrell is under the age of twenty one years they are advised that no such sale and division can be made so as to be affected without the aid of this court.
In tender consideration whereof and for as much as your orators are powerless (?) in the premesis at law and can only be relieved in this worshipful court where matters of this nature are alone cognizable to the end that your worships will turn a sale of said land and division of the proceeds between the person interested, and that the said Nathaniel Cuthrell may be made a party and defendant hereto his guardian or next of kin compelled to answer all and singular the allegations of this bill and say if they are not true and that your worships will grant to your orators such other and further r4elief in the premesis as to your worships may appear to be just and equitable. May it please the court to grant the Commonwealth writ of subpoena, Ye; S. Whitehead (?) Justice (?)
The answer of Nathaniel Cuthrell infant orphan of Thomas Cuthrell deceased by Richard Cuthrell - his guardian, to the bill of complainant exhibited against him in the court by James Cuthrell and other defendants.
This deposition by his said guardian for answer to the said bill sayeth that he admits all facts therein stated and contained to be true and that he has no objection to make against the court ordering a sale of the land herein mentioned and division of the proceeds equally between the plaintiffs and this defendant: Signature -- not legible (probable witness)

In the name of God Amen !
I James Cuthrell of the state of NC and the County of Craven,planter being at this present writing prostrated on a bed of sickness with the prospect of death before me yet being of a sound mind and of a disproving memory do pronounce the following to be my Last Will and Testament; revoking all others of previous date.
Item 1-- In case of death I bequeath my Soul to my Almighty Creator who gave it and recommend it to his infinite Mercy for my Saviors Sake.
Item 2-- I give and bequeath to my dear brother David fifty acres of land lying on the Green Branch community known as the Paul land.
Item 3-- I give and bequeath to my dear brother David One hundred acres of land, lying on Sofsen's Branch commonly known as the Joe West land.
Item 4-- I give and bequeath to my dear brother, David a Tract of land containing about twenty three acres included in the David Cuthrell Patent.
Item 5 -- I also give and bequeath to my dear brother David another Tract containing about one hundred and eighty acres beginning at the Beginning at a poplar and running with the patent line to the ?(run?) of the Shingle Swamp thence down the said run to the run of the main Creek and continuing the said course to the back line and from thence to the Beginning.
Item 6-- I leave unto my dear aunt Solly (Sally?) Cuthrill the place on which I now reside, during her natural life with all the privileges as pertaining to the plantation and I desire that my dear brother David, pray keep the plantation in order. And at the death of my dear Aunt Sally Cuthrell I direct that the said plantation shall be sold, and the proceeds equally divided among my heirs.
Item 7-- I also give and bequeath to my dear brother David fifty acres of land called the David Cuthrell patent lying on the marked beech branch.
Item 8-- I give and bequeath to my dear brother Thomas Twenty five acres more on less out of the John Jones patent.
Item 9-- I also give and bequeath to my dear brother David twenty five acres more or less out of a patent granted to David Cuthrell.
Item 10-- I also give and bequeath to my dear brother David my Negro man Peter.
Item 11-- I give and bequeath to my dear brother Thomas my Negro woman Chloe and child providing he shall pay the balance which still remains due for her.
It is also my desire that as my brother David and self were doing business in partnership that the said business should be carried on to the close of the year and that my brother David should reap all the profits arising from said business. And at the end of the year I desire that all my perishable property shall be sold and the proceeds equally divided between my two brothers David and Thomas and my dear sister Polly It is to be clearly and distinctly understood that the money ? shall arise from the sole of my perishable property shall not be subject to any division until my proportional part of the Negro hire for the present Year 1836 shall be paid.
It is to be further understood that I desire each and all of my just debts shall be paid, before any division shall take place from the sole of my perishable property.
I appoint my dear brother David my Executor.

Summary of Will data by Addie Wallace:
James named his brothers as David and Thomas(1797) and sister Polly.
The will of Thomas Cuthrell, no county given, dated Jan 24, 1784,
states that
land will be given to James Cuthrell, son of Gowin Cuthrell,
this is out of a patent dated 1766.
Gowen is the grandson of Thomas who died in 1784.
Thomas of 1784 brothers were Gowen, and Joshua,
Sons of Thomas dated 1784 are Thomas, Joshua, Peter amd Charles.
Thomas's will of 1784 names some younger children John, Gowin , Elizabeth.
He also, names a son Amos as getting 150 acres of land, which
joins the plantation where Amos now lives. Amos must be older and married.
From this source we can add to the info from B. B. Cuthrell
