Backfire
Episode 3
**
Harvey and Rachel are in the PT Cruiser sitting, watching someone from the City Hall parking lot. Harvey glances at her momentarily, wondering what she is thinking about --- she seems to be off on another planet. The silence is nearly killing him, so he decides to break it. "Hey, Rache..." he waits, but gets no reply. "Hey, Rache..."

"Yeah?" she turns her head towards him, momentarily not looking out the window.

"You okay? You just seem elsewhere today."

"I'm fine, really."

"Oh. How's Nash been doing?"

"Why would I know about Nash?"

"I just thought you had seen him a lot more recently, that's all. I didn't mean to imply anything."

"We're just friends, and right now what Nash needs is... THERE HE IS!" Harvey quickly looks up and sees Ramon Rodriguez running across the empty parking lot across the street. Rachel secures her gun gets ready to open the door "Are you coming?" She opens her door and rushes across the street, nearly stopping traffic. Ramon catches her in the corner of his eye and takes off, but he slips near the trash bin giving Rachel an advantage. He gets up and Rachel leads him to the wall, where she knows she can remain in control.

"Yeah. Let me call it in." Harvey secures his gun and opens his door to get out. He looks ahead and sees Rachel has already dashed across the street. He walks across and moves towards Rachel where she has Ramon pinned to the wall and is ready to handcuff him. "Looks like your little plan didn't work, huh? Guess it backfired. 'Cuff him Rachel, let's drag him in."

"Hey Joe, Harv and Rachel just got Ramon Rodriguez are bringing him in." Antwon is sitting at his desk, hanging up the phone as Joe walks by. "Where's Nash?"

"He'll be in later, he had to take care of some stuff with Nick."

"Oh. I just saw Rachel earlier and I wondered if he was coming in at all, I mean... when he wasn't in with her."

"What are you talking about man?" Joe laughs "Nash isn't with Rachel. That's so last year. Catch up on your gossip." He smiles and walks over to his own desk, throwing some papers down and logging onto his computer. Nash walks in and comes over to his desk, Joe looks up. "Hey Nash, I thought you weren't coming in till later?"

"Decided to come in now and I'll leave early. I've got to pick up some stuff before Nick gets home later on." Nash looks more tired and worn out then Joe has seen him in a long time.

"I can take care of things around here if you want to go home and catch up on some rest."

"Nah, it will do me good. What's new with that Rodriguez case?"

"Harvey and Rachel are bringing him in now. They got him right out side of City Hall."

"That woman..." Nash picks up the case file of Joe's desk and walks away. Joe is left there to think about Nash's comment.

" 'That woman' what is that supposed to mean?" he thinks for a minute as he plays with his pencil. "Nash and Rachel? Huh... Wait till Inger hears about this." He turns back to his computer and keeps working.

Rachel and Harvey are in the "conferencing room" with Ramon, waiting for him to talk. He isn't saying much and Harvey is losing his patience. "Take your time, we've got all day, you know."

"I said I ain't done nothing."

"Well, if you haven't done anything, care to explain the evidence against you?" Rachel fired back at him, Harvey loved it when she so subtlely corrected someone else's grammar. She had the fire in her eyes and looked extremely tense, Harvey loved that about her too. Despite her size, she commanded the room and this guy wasn't going to get away.

"Listen broad, I ain't done nothin' and ain't no way am I gonna confess."

"Whoa, brother..." Harvey looks over to Rachel, whose glaring eyes say a lot more then her words ever could.

"What did you call me? You know --- I gave you the benefit of the doubt and I am
sorry that I did. I should have listened to my instincts. Ronnie! Get him out of here." During her tirade, she didn't even see Nash come up the stairs with Ronnie. As Ronnie comes to take Ramon to lock-up, Nash approaches her.

"Hey, Nash..." Harvey pauses "how..."

"Can I have a minute with Rachel, please?" Nash asks, not sure or really caring what Harvey might infer from the question. Nash looks over at Rachel.

"Yeah, sure." Harvey gets up and pushes his chair in. "Rache, I'll be downstairs for a while if you want to go over some of those files."

"Okay, I'll be down in a minute." Harvey walks towards the stairs and goes down, Rachel is gathering up the case work on the table and tries not to look up at Nash. He can tell what she is doing and gently grabs her hand to get her attention.

"Rachel, about the *other* night..." Nash looks at her, trying not to get lost in her huge brown eyes.

"Listen, Nash, you don't have to explain. I'm not a fool Nash, I know what it was about." She moves her hand out from underneath his and picks up the pile of folders. Not satisfied, Nash puts his hand on her shoulder as she turns to walk away.

"Rachel, can you just listen to me for a minute, please?" she turns around and looks at him. "I know you think I have been avoiding you, but I haven't. Its not you at all; I haven't been able to eat, sleep, work or concentrate lately." Nash pauses for a moment, "I've been going crazy with this Nick thing and I really don't know what to do. Being with you that night seemed like the only logical decision, and I'm sorry"

"You don't have to apologize for it, okay? It was that night, and its over - I know that. There's nothing more to say."

"Rachel, I just want to clarify where we stand" he pauses, "I don't know what to
do about this. I don't know that I want it to be a one night affair."

"What?" Rachel looks at him in shock, not believing what he just said. All along she had thought that it was just a one night stand, never intending it to go any farther and now he is insinuating something else. She stands there looking at him, waiting for him to say something else.

"Hey, Babcock! Come here," Harvey calls from his desk as he sees Antwon walking across to his own. "Tell me what you know about Van Guard Industries."

"I know that its in the harbor, run by a rich guy who hires the cheapest labor he can find."

"Bingo." Harvey looks up and smiles at him.

"Huh?"

"All we have to do is prove it. A woman came in today, with claims that there was some kind of uprising being planned against the business by the workers. Imagine that, a running sweatshop, right here in San Fransisco. Of course, Van Guard probably keeps this a well hidden secret."

"Want me to go check on the stats?"

"Yeah, and take Cassidy. I'll go tell Joe what we've got." Harvey gets up out of his chair.

"You want McCabe on this one too?" Antwon asks, knowing Harvey jumps at every chance to work with her.

"I'll talk to Nash." They both walk off in different directions.

Harvey approaches Joe's desk a few hours later, Joe has just returned from Bayside with some information on Ramon. "Well Harvey, looks like you and Rachel really did the city of San Francisco great justice by getting Ramon Rodriguez in - check this out." Joe hands Harvey the guy's file.

"Wow. You're telling me." Harvey peruses the file.

"So, what do have?" Joe looks up tiredly from his desk.

"Van Guard Industries, a sweatshop. The workers are planning to revolt, the boss is threatening them."

"Interesting," he stops a moment "get me what you can."

"Right away - you want McCabe on this too?" asks Harvey, inquistively.

"Talk to Nash" Joe smiles and Harvey grins as he walks away, back towards the stairs.

Nash is in his apartment, helping Nick to get situated on the couch. He gives Nick another pillow and then walks over into the kitchen. Picking up the phone, he dials and waits.

"You have reached 524-1306, the person you are trying to reach is unable to come to the phone right now. Please leave a voice mail at the tone...Voicemail
for Insp. Rachel McCabe..."

Nash hangs up the phone, wondering about his discussion with Rachel that morning at the SIU --- completely unsure as to if he did the right thing. "I guess I have to wait and see." Nash stands at the counter for a few moments, sipping his wine. Just then, there's a knocking at his door. He wasn't expecting anyone, but thinks it might be Cassidy. He slowly walks over to answer it, wondering why she wouldn't be using her own key. He opens the door, "Rachel..."

"I finally found the name of that doctor you had asked me about earlier, and I wanted to bring it by." Nash smiles at her, knowing that his apartment was completely out of her way.

"Are you just gonna stand there, or are you going to come in?" He smiles again, loosely putting his arm around her shoulders, he leads her into the apartment. "Nick, Rachel's here." Nick turns around to see her.

"It's my hero." Nick gives her a weak smile.

"Don't let that get to her head, Nick - she might change jobs on us again." Nash smiles at her, happy she came over.

"Hey Nick," she pauses, smiles and looks back to Nash. She hands him a business card with the neurologist he asked her to look-up. "I should get going, I just wanted to get this to you right away."

"Why don't you stay?" Nash looks at her, figuring this would be the deciding moment. He knows that if she stays, she had thought about what he said earlier and if she goes, she really did believe he was using her for a one night stand. He looks at her a minute, and waits for a reply.

"Okay." She goes and sits down next to Nick on the couch, and Nash looks on from the kitchen --- smiling.
