INTRODUCTION

The European Court of Human Rights was set up in 1959 under the 1950 European Convention on Human Rights to hear complaints of violations by the Contracting States [fn1] of the rights and freedoms set out in the Convention, including the right to life, the prohibition of torture, the right to liberty, the right to a fair trial, the right to a private and family life and the freedoms of expression, of religion and of association.

On 1 November 1998 Protocol No. 11 to the Convention entered into force, replacing the two original enforcement institutions, the part-time Court and European Commission of Human Rights, by a full-time Court with compulsory jurisdiction.

La Cour européenne des Droits de l’Homme a été créée en 1959 en vertu de la Convention européenne des Droits de l’Homme de 1950 pour connaître des allégations de violations, par les Etats contractants [fn1], des droits et libertés énoncés dans la Convention, dont le droit à la vie, le droit de ne pas être soumis à la torture, le droit à la liberté, le droit à un procès équitable, le droit au respect de la vie privée et familiale et à la liberté d’expression, de religion et d’association.

Le 1er novembre 1998, avec l’entrée en vigueur du Protocole n° 11 à la Convention, elle est devenue une Cour permanente avec juridiction obligatoire, mettant fin au système initial où deux institutions, la Commission et la Cour européennes des Droits de l’Homme, fonctionnaient à temps partiel.

Only a minority of applications result in a judgment Between 1 January 2002 and 31 December 2002 the Court delivered 844 judgments overall, 17,915 applications were either struck out or declared inadmissible and 577 were declared admissible.
