Summary of what took place at the Toba Indian Community,lot 68,province of Formosa, on Friday 16th. of August

  On Friday 16th. of August, at the Estancia "Adelaida", a confrontation between policemen and cattle thieves took place. Here a member of the security force was killed and another one badly injured. 

As a consequence of this action, that same day a Provincial Police Brigade came to the Toba Community settlement, inquiring  about a native of the Toba Community, who is a "mariscador" (hunter), as many others of the community, who do this for their subsistence. The policemen  asked if that morning he had gone hunting. They also wanted to know the names of all those who had gone hunting, presuming that one of them was responsible for the death of the policeman.

Next morning, at the break of day and dressed as civilians, more than 100 policemen, entered the community settlement in a sort of massive attack, violently trampling on the natives and hitting children, women, men and elders, all this without exhibiting a judicial order. When they came to one of the houses they pulled out the woman who lived there and waited for the man they were looking for. When he arrived, at 5 o´clock in the morning, they fired at him, handcuffed him ,also shackled his feet, and only at 7 o´clock an ambulance arrived. He saved his life thanks to the surgery he went through.
 
Several Tobas, both men and women were taken to the Nam Qom and "barrio Evita" police stations. There, they were roughly treated, so as to obtain information regarding the death of the policeman. They were beaten, kicked and insulted by police officials. To one of the women who had been taken to the police station, after turning off the light, they put a gun on her neck(nape), so as to make her talk. Eight Tobas remained arrested and incommunicated. There are many witnesses who can testify and relate all what happened.
This procedure set a great fear in the Toba Community which still persists, as well as a strong sensation of indefensibility.
Several assemblies have been held by the Toba Community since that day, where they have expressed their complaints for all the abuses they suffered.
 
By decision of the Toba Community Assembly, the defense of the eight men who were arrested and the accusation for the violation of the Human and Native Rights was  taken by the Formosa branch of the PAHR (Permanent Assembly of Human Rights ), the ENDEPA (National Council for the Native Pastoral), and the council of Native Pueblos. The Court of Justice number 4 interveres.
