DYNAMITE CHIHUAHUAS GUARANTEE

We guarantee our puppies to be healthy at time of sale. Buyer has 72 hours in which to have the puppy checked out by a licensed veterinarian. Should your vet find the puppy to be "unfit" health wise upon this initial examination, it will be replaced or a full refund given (your choice) provided the puppy is returned with a written statement from the vet stating the nature of the illness. This does not include minor or normal afflictions commonly seen in pups that are non life threatening (Example: puppy acne, umbilical hernia, worms detected in fecal, etc) It is the purchaser's responsibility to return the puppy, as well as assume any and all expenses incurred in doing so.
If the buyer does not have the puppy checked out within this 72 hour period, they agree to take the puppy AS IS with no guarantee for the full first year of the dogs life what so ever. We do need proof mailed to us of this veterinary visit being performed within 72 hours.

We do not guarantee our puppies against illness brought on by the stress of moving (from our house to yours) or from shipping, or from motion sickness resulting from being transported. Stress can ignite illnesses such as hypoglycemia (blood sugar drop) or coccidia (commonly dormant in many live animals), so exposing the dog, especially as a puppy, to the least amount of stress as possible is always best. This is a small breed of dog who gets nervous under stress.
We also do not guarantee our animals to be 100% free of all internal parasites as this is an on-going process that, once the animal is out of our control, would be the responsibility of the owner. Raising a puppy is very similar to raising a child. We will not be responsible for the new owners inability to respond, lack of knowledge, or any carelessness or neglectfulness to the needs of their new puppy.
 
After the 72 hour period, we will not give compensation for any dog who becomes ill unless it is a severe congenital condition that hinders the ability of the dog to function without pain. Should a puppy be discovered to have such an affliction within the first year of it's life, we require that proof of such defect is provided to us by either a report from OFA or from a specialist. We will not accept simply the opinion of a general practitioner, and will require that the animal is seen by a specialist who has expertise within the field of the affliction in question. This is mainly to be sure that the animal is properly diagnosed and is given the best care possible to offer a better prognosis if possible.
Compensation for such found defect will be in the form of a replacement puppy. We will give a replacement dog only for any dog found with a severe congenital affliction that causes it to be crippled or live in constant pain. We will give a puppy of equal monetary value, but choice of puppy given as a replacement is up to the discretion of the breeder. Replacements and compensation will be dealt with on a case by case basis.
Prior to any replacement commencing, the defective dog must be fixed with proof of such being mailed to breeder along with the proof of defect. All registration papers on the dog much also be returned to breeder. If these things are not received, no replacement will be given. Afflicted dog IS NOT required to returned, however, the breeder will accept back any afflicted dog that the owner/buyer wishes to surrender.

Per this contract, the seller is legally relinquished from covering any costs back to the owner/buyer that are incurred from, but not limited to: vet visits, surgery, wages lost due to time off work, intended future monetary potential expected from the dog or any other costs involved, incurred or implied. The seller is obligated only to give a replacement dog or a credit toward the purchase of another puppy once all requirements are met by buyer/owner per this contract, and only after the defective dog is fixed and proof mailed to breeder/seller, proof of defect is received and the registration papers are received back to the seller/breeders ownership.

In the event of the death of a puppy, we do require an autopsy. This autopsy is required to state the actual cause of death. We require an official copy of this autopsy report to be mailed to us. We will replace the dog only if the cause of death is directly our responsibility due to a clearly proven severe genetic condition. We will not replace any dog whose cause of death was not of a genetic basis or cannot be clearly proven to have a genetic basis.

If the puppy, for any reason, is euthanized without our prior consent, no compensation of any kind will be given.

All of our puppies are up to date on all vaccines when leaving us. We cannot however, guarantee the level of immunity each dog has to the diseases in which vaccinated for. It is the responsibility of the owner to keep the dog away from unfamiliar areas where the dog could contract diseases, as well as it is also the responsibility of the new owner to continue any and all vaccine protocols.
It has been said that some veterinarians do not want to recognize the shots that were given by a puppy’s breeder. To allow a vet to give these shots all over again is detrimental to the health of such a small dog. If you allow your vet to start these shots all over again, you are taking a severe risk with the health and welfare of your newly purchased puppy and we will not be responsible for any subsequent reactions, problems, adverse affects or death of the dog.
We assume no responsibility for any illness to other household pets resulting in being exposed to our puppies. The introduction of a new pet into the household and the health of all other pets is the responsibility of the owner.

We guarantee our animals to be sound with no disqualifying fault at time of sale. We do not guarantee any female to be a "free whelper" or to whelp at all. We also do not guarantee our males to be studs although both testicles shall be descended at time of sale. The state of reproduction and morphology is too complex for any one to predict or guarantee.
We do not guarantee a dog or bitch to "Finish" its championship, even if it is "finishable" at time of sale. Training (or lack of it) can influence the show ability of any animal. We will not give any guarantee that any dog will or will not be of breeding or show potential. We will not guarantee that any dog will grow up to be "fault free" and will not be held responsible if any dog does not turn out to have a specific look that the purchaser had in mind. Any imperfections, if apparent at the time the dog leaves our ownership and goes to new owner at time of sale, will be noted at that time on the purchase contract.

This guarantee shall become void if it is brought to our attention an animal purchased from us is or has been abused or neglected. We consider lack of proper housing, lack of proper diet, lack of proper grooming, lack of proper training and etc to be forms of neglect or abuse. Should the purchaser decide to "change the diet" of one of our puppies, any resulting illness shall be the sole responsibility of the purchaser.  Should we discover one of our animals being abused, it will be repossessed by the breeder/seller if proof to substantiate claim is available. Any expenses incurred to bring the animal back to full health shall be charged to the owner who abused the animal. This stipulation is not negotiable.

This guarantee is being put in place for the protection of the animal and all parties involved. Should a disagreement arise because of this guarantee, it is the right of either party to institute legal actions in an attempt to resolve this matter. All legal matters involving the dog or contract, are to be heard and held within the county of the state of Michigan in which the breeder/seller lives.

Agreement for ownership and care of dog:

1) The breeders kennel name, "DYNAMITE", will be present within the registered name of each Chihuahua sold. At no time shall the kennel name be left out, removed, changed or shortened.
2) The dog must be fed a high quality food, with meat as the first ingredient. A proper diet is essential in proper growth and maintenance of the breed.
3) The dog will receive proper grooming, nail trimming, parasite control as well as yearly heartworm testing with administered heartworm preventative. Yearly vaccines will be maintained.
4) From this date forward, this animal is never to be transferred, leased, sold, given away or surrendered to anyone other than the breeder/seller unless written permission to do so is given by breeder/seller.
5) This dog is never to placed in rescue, nor in any animal shelter. Should this occur, all costs involved for the breeder to obtain dog will be charged to the owner/buyer.
6) Health guarantees given on dog are not transferable. The dog must not change ownership within the first year of life. To do so voids any and all guarantees.
7) Deposits placed for pups are non refundable unless we are unable to provide you with a puppy at all.
8) This dog must be microchipped within the first year of life, and a copy of the chip number mailed to the breeder for their records.
9) The breeder/seller reserves the right to check on the terms of the contract at any point during the dogs life.
