 1.0    The enlistment of contractors under Class-I (E) shall be done by Directorate on All India Basis.

1.1    The enlistment of contractors under Class-II (E) shall be done by Chief Engineer (Elect.) on regional basis.

1.2    The enlistment of contractors under Class-IV (E) shall be done by Superintending Engineer (Elect) on circle basis.

2.0     The composition of the Departmental committee for enlistment of Contractors in various categories shall be as below :

3.0      Contractors enlisted in various categories for Electrical works must have a valid electrical licence and in addition whenever they execute works in this Department, they must employ the following technical staff for supervision on works :-

1.         For works costing over Rs.1 Lakh :  One qualified Engineer possessing a University Degree in Electrical Engineering and having experience of not less than 3 years or a Diploma holder with not less than 7 years experience.

2.        For works costing over Rs.50 thousand and Rs.1 lakhs :   One Engineer possessing and recognised Diploma in Electrical  Engineering and having experience of not less than 03 years or  Graduate Electrical Engineer with 02 years experience.

3.        For works costing below Rs.50,000/- :   One recognised diploma holder Engineer possessing a diploma in  Electrical Engineering and having experience of not less than two years. 

4.0       SECURITY DEPOSIT  :         The security deposit shall be collected by deduction from the running bills of contractors in accordance with the rules in force on the subject from time to time.

5.0        EARNEST MONEY    :         The contractors are required to deposit earnest money in accordance with the rules in force from time to time.  The earnest money deposited shall be converted as part of security deposit on acceptance tender.

6.0        The following qualifications are prescribed for enlistment of Contractors for Electrical Works in different Classes :-

Class-I (E) :

(a)        Contractors desiring enlistment in this class shall be required to deposit earnest money along with each tender as per terms and conditions of the tender/agreement.

(b)        Contractors desiring enlistment in this class should possess a valid Electrical Licence and should have a permanent Engineering organisation capable of dealing with large works in all the stages.  They should employ one graduate Engineer having an experience of not less than 03 years or a recognised Diploma Holder Engineer with not less than 07 years experience from the tendering stage onwards.  They should furnish full details about their engineering organisation in the application form itself.  They shall be required to intimate any change in their Engineering staff as and when any such change is made.  They should have sufficient machinery and tolls etc. at their disposal for which they should submit details along with their applications.

(c)        Firms requesting enlistment in this class should have satisfactorily executed at least 3 Electrical works of not less than Rs. Four lakhs each in value in the past five years and must have work execution turn over of not less than Rs.30 lakhs in the past 3 years.  They should have executed at least one Electrical Work of similar magnitude/and nature in the Department of Telecom/Posts in the recent past.

Class-II (E) :

(a)        Contractors desiring enlistment in this class shall apply to Chief Engineer (Elect.) under whose jurisdiction the firm's Head Quarter is located.

(b)        They shall be required to deposit earnest money along with each tender as per terms and conditions of the tender/agreement.

(c)        Contractors desiring enlistment in this class should possess a valid Electrical Licence and should have satisfactorily executed 3 electrical works of not less than Rs.1.5 lakhs each in value in the past 5 years and must have work execution  turn over of Rs.15 lakhs in the past 3 years.  They should have executed at least one electrical work of requisite  magnitude and nature in the Department of Telecom/Posts.

(d)        The Contractors of firms having no past experience of Electrical works is also eligible for enlistment in this class provided the working capital is not less than Rs.2 lakhs. The individual or one of the partners or an employee of the firm should be a qualified Graduate Engineer in Electrical Engineering, having experience of not less than 5 years in execution of Electrical works of similar nature or a recognised Diploma holder engineer with not less than 15 years experience.  The Engineer should have executed satisfactorily in a responsible capacity at least three Electrical works of not less than Rs.1.5 lakhs in value each.

Class-III (E) :

(a)        Contractors desiring enlistment in this class shall be required to deposit earnest money along with each tender as per terms and conditions of the tender/agreement.

(b)        Contractors desiring enlistment in this class should possess a valid Electrical Licence and should have satisfactorily  executed 3 electrical works of not less than Rs.37,500/- each in value in the past 5 years and must have work execution turn over of Rs.5 lakhs in the past 3 years.  They should have executed at least one electrical work of requisite magnitude/and nature in the Department of Telecom/Posts.

(c)        Contractors of firms having no past experience of Electrical work are also eligible for enlistment in this class provided the working capital is not less than Rs.75 thousand.  The individual or one of the partners or an employee of the firm should be a qualified Graduate Engineer in Electrical Engineering with experience of not less than 3 years in execution of electrical works of similar nature or a recognised diploma in Electrical  Engineering and having experience of not less than 5 years in execution of electrical works.  The engineer should have executed satisfactorily in a responsible capacity.  Three Electrical works of not less than Rs.50 thousand in value each.

Class-IV (E) :

(a)        This class of contractors will include petty suppliers as well as those who may carry out petty electrical works.  The contractors shall have a minimum working capital of Rs.20 thousand in the past 6 months on the date of application.  They will be required to pay earnest money and the security deposit at the prescribed rate along with each tender.

NOTE : Works means only item of work relating to electrical or mechanical/electro mechanical installations in administrative/technical buildings and staff quarters of the Department of Telecom including original/maintenance works.  It will not include specialised work such as Engine Alternators, Sub Stations, Fire-Fighting, A.C. etc.

7.0        GENERAL :

(i)           Contractors are required to apply for enlistment in the prescribed form available from the Executive Engineers (electrical) on payment of its cost and apply through the S.E. (Electrical) concerned.

(ii)           Contractors are required to apply to the Income Tax Officer of the area in which they are assessed for grant of Income Tax Clearing Certificate in the month of May every year and the same in original or copy thereof duly attested by a Gazetted Officer or a notary public and should be submitted to the S.E. (E) Telecom/ C.E.(E) Telecom/Telecom Dte. who has enlisted the contractors by the end of June, every year.

(iii)           The Contractors who fail to submit the Income Tax Clearance Certificate or fail to show any justifiable reasons for non supply of the Income Tax Clearance Certificate in their names will be liable to be removed from the approved list of Contractors.

(iv)           Contractors will be required to certify that they will not get themselves registered under more than one name.

(v)            Contractors will be required to obtain Solvency Certificate from the Bank to the extent of the tendering limit of the class to which they apply.

Since the tendering limit for Class I (E) contractors is not laid down as they can quote upto any amount, the contractors applying for enlistment under Class I (E) category shall be required to obtain a Solvency Certificate from the Bank for Rs.25 Lakhs.

(vi)            The list of approved contractors will be reviewed periodically with a view of recommending the weeding out of contractors, guilty of malpractice or otherwise unsuitable.

(vii)            The Contractors should possess a valid Electrical Licence and attested copies of Electrical Licence are to be enclosed to the application form every renewal of the Electrical Licence must be intimated to the enlisting authority and must be kept current and valid at all times.

(viii)            Contractors should strictly comply with all the provisions of the rules.  They should engage supervisor for effective supervision of the work under execution by them as per the provisions of para 4 of these rules and the works should be executed only in the presence of such supervisor engaged by them, qualifications etc of the supervisor engaged by them for the works under execution by them must be intimated  at the time of commencement of the work to the officer in charge of the work. Apart from the electrical licence the contractors should possess all the necessary and adequate tools, plants, measuring instruments and other equipments required in connection with the execution of the work and for inspection purposes.  Such tools etc. should be got tested periodically and certified by the S.E. as to their precision, correctness etc.  List of tools and plants measuring instruments and other equipment available with them together with the details of their Sl.No. makes etc. must be furnished along with the application form and they will be checked and counter signed by the departmental officers.

8.0            The State covered by each zone for the purpose of these rules shall be territorial jurisdiction of Chief Engineer (E) Telecom.

9.0            The following documents have to be submitted ( Original or attested copies ) along with the application for enlistment. :-

(a)            Bank Certificate in original showing the requisite amount in the name of the applicant for the required period.

(b)            Latest I.T.C.C.

(c)            Valid Electrical Licence.

(d)            List of works executed together with certificates of its quality if any.

(e)            The applicant desires enlistment in the name of Co. or Firm the affidavit of sole proprietorship or true copy of partnership deed whichever is applicable shall be attached.

(f)            The character and Antecedents certificates from the Magistrate or Gazetted Officer who is not related to the applicant should be given certifying that to the best of his knowledge.  He knows the applicant for the last three years and there is nothing adverse against the applicant for which he may be considered ineligible for enlistment as Government Contractor.

10.0        The enlisted contractors are required to secure works in this department.  In case they fail to secure any work during three consecutive years the contractors are liable to be weeded out from the approved list of contractors of this department.

11.0        Enlistment henceforth be for a maximum period of THREE years and shall need renewal on expiry of the period.  Contractors shall apply for re-enlistment six months before the expiry of period of enlistment.

12.0        The contractors may be demoted to a lower class if he :-

(a)            Fails to execute a contract or executes it unsatisfactorily or is proved to be responsible for electrical installation defects or

(b)            Has no longer adequate equipments technical personnel or financial resources or

(c)            Litigious by nature

(d)            Violated any important conditions of contracts or

(e)            is responsible for a conduct which may justify his demotion to a lower class

13.0         The name of a Contractor may be removed from the approved list of Contractors of this Department if he :-

(a)            has failed to execute a contract or has executed it unsatisfactorily even on one occasion or

(b)            is proved to be responsible for electrical installation defects in a number of cases or

(c)            persistently violates any important conditions of the contract or

(d)            fails to abide by the conditions of registrations or

(e)            is found to have given false information at the time or registration or

(f)            is declared or is in the process of being declared bankrupt, insolvent, winding up, dissolved or partitioned or

(g)            persistently violates the labour regulations and rules.

14.0        They shall not enter into any fresh partnership without the prior approval of the Department. In case they wish to enter into any fresh partnership they must intimate in advance full details of the intending partnership along with the draft of the partnership deed.  Any departure in this respect will render the contractors liable to be removed from the approved list of Contractors of this Department.

15.0        They should also intimate the change in their permanent address if any, if future, in case they fail to intimate the same their name could be removed from the approved list of contractors of this Department.

16.0        They shall be bound by the enlistment rules of this department as amended from time to time.

17.0        Various requirements for enlistment in various classes are summarised as per enclosed Annexure.

NOTE :-

(i)        For works done in Departments other than the Department of Telecom. Original or attested copies of Certificates officers under whom works were carried out should be enclosed.  If it is not possible to obtain such certificates, the applicant  should clearly indicate this.

14.        Whether the applicant or any of his partners or shareholder is a/are member(s) of the Indian Parliament or any State Legislature.

15.        Whether the applicant or any of his partners  or shareholder is a/are dismissed Government Servant(s).

16.        Has the applicant or any of  his partners or shareholder being blacklisted or removed from the approved list of Contractors or demoted to lower class or orders passed  banning/suspending business with the applicant etc. by any Department in the past.

17.        Whether the applicant has under his employment a dismissed Government Servant.

18.        (a) Whether the applicant possess a valid Electrical Licence and has an office with sufficient technical personnel capable of preparing estimate and submitting tenders and bills for works done and supervision of works ( full details to be furnished).  Attested copies of Electrical Licence to be enclosed ( For Class-I(E) Contractors).

             (b) Whether the applicant has a valid Electrical Licence ( attested copies of the Licence to be enclosed) ( For other than Class-I(E) Contractors).

19.        Whether the Contractor has read the rules for enlistment of Contractors and is prepared to abide by them as amended from time to time.

20.        A list of those persons working with the applicant in any capacity who are near relatives to any Gazetted Officer in the Department of Telecom/Posts/Ministry of Communications should be furnished.  The applicant should also intimate the names of such persons who are employed by him subsequently.

( The Contractors are not entitled to tender for works in the Electrical Circles in which their near relatives is working as Deputy Accounts Officer, Junior Accounts Officer or within the rank of SE and AE (both inclusive) and any breach of this condition by any contractor will be sufficient to debar him from enlistment).

NOTE :-

            By the term near relative is meant wife, husband, parents and grandparents, children and grandchildren, brothers and sisters, uncles, aunts and cousins and their corresponding in-laws.

(i)        I/We certify that I/We will not get myself/ourselves registered as Contractors in the Department of Telecom in more than one name.

(ii)        (a) I certify that I did not retire as an Engineer of Gazetted Rank or as any Gazetted Officer employed in Engineering or Administrative duties in Engineering Department of the Government of India during the last two years.  I also certify that I have neither such a person under my employment nor shall I employ any such a person within two years of his retirement except with the prior permission of the Government. ( for individuals seeking enlistment in their own name).

             (b) We certify that none of the partners/Directors retire as Engineers of Gazetted Rank or as any Gazetted Officer employed in Engineering or Administrative duties in the Engineering Department of the Government of India during the last two years.  We also certify that we have neither under out employment any such person nor shall we employ and person within two years of his retirement except with the prior permission  of the Government.  ( For Ltd. companies and Partnership Firms).

(iii)        (a) All relevant certificates should be attached with the application.

             (b) No column should be left blank.

             (c) Application for enlistment for building and electrical works should be submitted separately.

             (d) I.T.C.C. for the latest Assessment Year should be furnished along with the application. Without      I.T.C.C. enlistment will not be considered.

             (e) Bankers Certificate must be attached in original.

             (f) Attested copies of valid Electrical Licence must be attached.

NOTE 1.    To be eligible for re-validation, the contractor will be required to have executed at least one work in DOT of magnitude appropriate to the which revalidation is sought during last five years that is from 1.1.1995 onwards.

NOTE 2.    The Contractor shall fill up the details of each of the work indicated by him in item No.7 above in the enclosed proforma (Annexure II)  in duplicate. One copy of the proforma should be forwarded by him to the EE in charge of the Division with whom work was executed with a request to complete the proforma and forward the same to enlisting Authority through his SE within 2 weeks of its receipt.  Other copy of the proforma should remain attached to the application.

NOTE 3.    In case where the contractor has executed more than one work of the appropriate magnitude extra copies of the enclosed proforma (Annexure II) may be made so that the proforma is filled in duplicate for each work separately.  The first copy for all works should be attached to the application form and the duplicate copies submitted to the concerned Executive Engineer for further action as indicated above.

NOTE 4.    The contractors they so desire, indicate the details of works of appropriate magnitude for which they unsuccessfully submitted tenders in DOT during last five years ( 1.1.1995 onwards).  They may also submit details of works of appropriate magnitude executed for other Government/Semi Government and autonomous agencies on the basis of their enlistment in DOT.

Subject :    Delay in Submission of application for revalidation of Contractors.

            The revalidation of Enlistment of Contractors is being done for a period of three years from the date of expiry of the enlistment and the contractor is required to apply for revalidation six months in advance of the expiry of enlistment. However in cases, where the contractor does not apply before the date of expiry of enlistment, he is advised to seek fresh enlistment as per guide lines issued vide this office letter no.5-1-22/EW/98 dated 30.10.1998.

            It has now been decided by the Sr. DDG(Electrical), BSNL that the application for the revalidation may be accepted up to three months after the date of expiry of enlistment, if the contractor deposits the late fee as given below.

i)    For Class - I (E) Contractors                                        Rs.10,000/-

ii)    For Class - II (E) to IV (E) Contractor                         Rs.  5,000/-

            Further, as a one time relaxation, it has been decided that for the contractors whose enlistment has expired between 30.01.2001 and date of issue of this letter, their application for revalidation may be accepted, if the contractor submits the application for revalidation along-with the above late fee within three months of date of issue of this O.M.

            The late fee is to be deposited through an A/c payee Demand Draft on a scheduled Bank in favour of the Accounts Officer, BSNL Electrical Division from where the application form is purchased.  For other cases, the Enlistment Authority may issue necessary instructions, for the purpose.
