CRIMES AND PUNISHMENTS

(Nevada Revised Statutes – N.R.S.)

 

N.R.S. 453.3385:

1)      Possession or sales of a controlled substance (drug) of 4 grams to 14 grams (Trafficking level 1), a Category B Felony.  All offenses: a minimum of 1 year to maximum of 6 years in prison and a maximum fine of $50,000.

2)       Possession or sales of a controlled substance of 14 grams to 28 grams (Trafficking level 2), a Category B Felony.  All offenses: a minimum of 2 years to a maximum 15 years in prison and a maximum fine of $100,000.

3)      Possession or sales of a controlled substance of 28 grams or more (Trafficking level 3), a Category A Felony.  All offenses: a minimum life sentence (with the possibility of parole in a minimum 10 years) or a definite 25 years (minimum parole eligibility in 10 years) and a maximum fine of $500,000.

 

N.R.S. 453.411:

Use or be under the influence of a controlled substance; a Category E Felony, minimum 1 year to a maximum 4 years in prison, and a maximum fine of $5,000.  1st offense: sentence suspended with 3 to 5 years on probation.  2nd offense: possible probation.  3rd or subsequent offense: prison sentence mandatory.

 

N.R.S. 453.336:

Possession (not for sale) of a controlled substance (less than 4 grams); a Category E Felony, minimum 1 year to a maximum 4 years in prison and a maximum fine of $5,000.  1st offense: sentence suspended with 3 to 5 years on probation.  2nd offense: possible probation.  3rd or subsequent offense: prison sentence mandatory.

 

N.R.S. 453.337:

Possession for sale (less than 4 grams); 1st offense: a Category D Felony, a minimum 1 year to maximum 4 years in prison and a maximum fine of $5,000.  2nd offense: a Category C Felony, a minimum 1 year to a maximum 5 years in prison and a maximum fine of $10,000.  3rd or subsequent offense: a Category B Felony, a minimum 3 years to a maximum 15 years in prison and a maximum fine of $20,000.

 

N.R.S. 453.321:

Unlawful to import, transport, sell, exchange, barter, supply, prescribe, dispense, give away or administer a controlled substance or a counterfeit substance, manufacture or compound a counterfeit substance or offer or attempt to do any such act (less than four grams); a Category B Felony.  1st offense: minimum 1 year to a maximum 6 years in prison and a maximum fine of $20,000.  2nd offense: minimum 2 years to a maximum 10 years in prison and a maximum fine of $20,000.  3rd or subsequent offense: minimum 3 years to a maximum 15 years in prison and a maximum fine of $20,000.

 

N.R.S. 453.322:

Unlawful to manufacture or compound a controlled substance (other than marijuana), possess a majority of the ingredients required to manufacture or compound a controlled substance (other than marijuana) or offer or attempt to do any such act; a Category B Felony.  All offenses: minimum 3 years to a maximum 15 years in prison and a maximum fine of $100,000.
