Alternatives to Probate

    Your probate may be avoidable, if:

    
· The total assets owned by the deceased person is $100,000 or less;
    
· The assets are held in Joint Tenancy;
   
· The assets are community property and given outright to the surviving spouse;
    
· The assets are contractual matters such as life insurance or annuities and there are beneficiaries named on those contracts;
   
· The assets are held in a Revocable Living Trust.
