Stephen Hosey's Will

17 May 1856

In the name of God, Amen. I, Stephen Hosea, do make and publish this my last will and testament hereby revoking and making void all other Wills by me at any time made.

1st-I direct that my funeral expenses and all of my just debts be paid as soon after my death as possible out of any money that I may die possessed of or may first come into the hands of my executor or administrator.

2nd-I give and bequeth unto my dearly beloved wife, Rachael Hosea, all of my household and kitchen furniture of every kind and also all of my farming utinsels, my wagon and oxen, my stock of cattle, all of stock of hogs and poultry about the yard, of all kinds and all claims that may be due me at my death.

3rd-I have an orphan boy living with me at this time by the name of John Finch, which I wish to make my principal heir with these provisions:

1st-if he the said John Finch live with me and my wife as long as we both live I grant him to have all of my property of every kind that may remain after making the distributions herein after mentioned; if he remain with us until he is 21 years of age only, I desire that he have a good horse, saddle and bridle given him out of my estate or its equivalant.
4th-I have grand daughter living with me at this time by the name of Nancy Solomon I give unto the said Nancy Solomon one feather bed and furniture if she remain with me until my death or before if I think it best to do so in my life time.

5th-I give and bequeath unto my beloved son Smith T. Hosea one feather bed and furniture after the death of myself and my wife Rachael Hosea.

6th-my reason for disposing of my property in this way is that I have given all I had to give to my children as they left me and that the said JOHN FINCH & Nancy Solomon are assisting me in my old age.

7th-I give and bequeath unto my daughter Jane Corbitt, my son James Hosea, Jesse Hosea, Betsey Mays, Nancy Long, Mary Ann Clifton, Rebecca Boroughs, Anderson Hosea, Benjamin F. Hosea, each one dollar apiece after the death of myself and wife Rachael Hosea.

8th-And lastly I hereby nominate and appoint my wife Rachael Hosea my sole executrise and it is my express desire that she shall not be compelled to qualify in court for her performance in the usual way.

In witness hereof I do to this my last will set my hand and seal this 17th day of May A.D. 1856.

Invocation of the county court
Be it remembered, that on this 25th day of August 1859 personally appeared before me the undersigned, -----------Clerk of the county Court within and for the County afore men. F. E. P. Crain and Stephen Mayfield the ----------- witness to the foregoing will of STEPHEN HOSEA and being by me first ------------------that the said STEPHEN HOSEA the testator who executed the same by making his mark in their presence and published the said will or instrument affirming as his last will, that he the said testator was at the time of publishing his said will of mind sound and more than twenty one years old, and that they the said deponants, attested the said will as witness thereto by entering their names to the same in the presence of will testator which signing and attending was done about the spring of the year 1859.

I, Jacob Ables clerk of the county court within and for the said county do hereby certify that the foregoing proof is by me considered sufficient to establish said will of STEPHEN HOSEA, deceased and entitle the same to be entered of ---------. 25 August 1859.

November term, 2,Nov 1859 the will was confirmed by the court.
