Attorney Stewart Harris, the Northside Civic Association and Jacksonville City Attorney office have stopped this facility. It was costly. Additional legislation is indicated.


History, previous posts:

A 7 year court battle [is continuing] against the citizens of Florida.....what some "inexperienced waste brokers" will do to make a profit and waste taxpayer dollars.

100% of the Florida Legislature voted against this AES of Pennsylvania Facility (S1390 / HB 3701).

The Federal Court in Atlanta threw out the case by AES of Pennsylvania.

[Now] on Aug. 2, 2000, AES has filed another court case against the State and Citizens and DEP of Florida. This case was filed in the Florida 4st Judicial Circuit Court, Duval County Florida.

OPINION - S1390 / HB 3701

18,000 Florida citizens have signed a petition against locating the American Environmental Services (of Penn) facility in a city of one million people: Jacksonville, Duval County FL.

AES refused for more than 4 years to remove certain chemicals from the permit application:

Sarin Gulf War warfare agent;
Tokyo Subway Terrorism;
Released in Kurd area of Iraq)

Hydrogen Cyanide (WWII gas chamber/warfare agent)

Phosgene (WWI warfare agent)

etc., etc.

What are you going to tell the citizens of Florida if we have an fire or spill or terrorist incident at this facility?

Are you aware that sperm counts are zero and every child is resulting in miscarrage in the Kurd area of Iraq?

10 REASONS TO STOP THE A.E.S. HAZARDOUS WASTE TYPE FACILITY


1. THREAT OF LETHAL CHEMICALS

a.. Many chemicals on the A.E.S. ‘Chemical List' are capable of killing human beings or animals in extremely small quantities ( i.e. Parts Per Million / Parts Per Billion ).

b.. Exposure may be through inhalation, ingestion or absorption.


2. LOCATION

a.. The proposed A.E.S. location is approximately 350' from 9-A, the ‘soon to be' primary North-South Interstate artery through Jacksonville.

b.. Railroad adjacent to the A.E.S. site is the only one that services the Jacksonville Port Facilities at Blount Island and Dames Point.

c.. During Operation Desert Storm, approximately 90% of the Military ‘Hardware' was shipped through the Jacksonville Port at Blount Island.

d.. Prime target for Terrorism. Could be a matter of National Security.


3. SHERIFF / POLICE & FIRE UNIONS / JEA

a.. Sheriff's Office and Fire Department are not capable of handling a fire involving the vast array of chemicals A.E.S. intends to handle and store.

b.. Large highly populated areas could not be evacuated in the event of an accident or fire.

c.. St. Johns River Power Park and Northside Generating Station cannot be evacuated in the event of an accident or fire.


4. QUALIFICATIONS

a.. Owners have never built, owned or operated a Hazardous Waste Storage/Transfer Facility.

b.. Owners have only functioned as ‘Brokers' of Hazardous Wastes handling the paperwork connecting Clients with Haulers.


5. CULPABILITY

a.. Attorneys representing A.E.S. routinely set forth partial truths when questioned about the requirements of the law, the 2010 Comprehensive Plan, the City's Zoning Code and their Clients proposed business activities.

b.. A.E.S. only plans to carry the "minimum amount of insurance" required by Law (1 million dollars per occurrence / 2 million dollars annual aggregate).


6. SCIENTIFIC TESTS / EXPERT TESTIMONY

a.. Computer generated CAMEO Projections illustrating a "Fire Scenario" show that some of the chemicals A.E.S. plans to store at the facility have an IDLH Zone (Imminent Danger To Life And Health) of over 7 miles in amounts as small as 15 and 25 pounds.

b.. Expert testimony in the Record expresses great concern for the Public Health, Safety & Welfare and the environment.

c.. Deadly toxic fumes could be carried downwind to heavily populated areas of Arlington, to Regency Square Mall, or to ALLTEL Stadium in a matter of minutes.


7. IMPORTATION

a.. A.E.S. proposes to "Import" Hazardous ‘Military-Type' Chemical Wastes to Jacksonville from 37 States and from Foreign Countries as well.

b.. Hazardous chemical wastes would arrive by truck, by ship and possibly by rail.

c.. Hazardous chemical wastes that would not ordinarily be traveling through Jacksonville, would travel through our neighborhoods on a daily basis.


8. ECOLOGICAL & ENVIRONMENTAL THREATS

a.. The Timucuan Ecological & Historic Preserve, a valuable wetland area and nursery ground for fish, shellfish and other wildlife, reaches within approximately one half mile of the proposed A.E.S. Hazardous Waste Storage/Transfer Facility site.

b.. The proposed A.E.S. Hazardous Waste Storage/Transfer Facility site is subject to flooding during Category 4 & 5 Hurricanes.

c.. Drainage ditches in front of, and behind, the site empty into Dunn Creek and then into the St. Johns River.

d.. Possible Groundwater contamination from leaks, spills or leaching of hazardous chemical wastes on site.


9. LOCAL OFFICIALS UNANIMOUSLY OPPOSE THIS SITE

a.. Jacksonville Planning Department - Recommended "Denial" of the Exception!

b.. Jacksonville Planning Commission - Voted Unanimously To "Deny" the Exception!

c.. Jacksonville City Council - Voted Unanimously To "Deny" the Exception!


10. LOCAL OPPOSITION

a.. Over 18,000 Individuals have signed Petitions in opposition to the proposed A.E.S. Hazardous Waste Storage/Transfer Facility.
