Will of C J Burgess

     I, C J Burgess, of Grant County, West Virginia, do make this my last Will and Testament, hereby revoking all former Wills made by me and directing the payment of my just debts and funeral expenses and the cost of administering upon my estate.
     First, I direct that all of my just debts and funeral expenses, including cost of a modest monument at my grave, and the costs of administering upon my estate be first paid from the money and property that I may have when I die.
    Second, subject to the foregoing provisions, I give, devise and bequeath to my daughter, Myrtle Burgess, all of my household and kitchen furniture, and one-half of my money and personal property, tangible and intangible, absolutely.
    Third, Subject to the foregoing provisions, I give, devise aand bequeath unto my two sons, Woodrow Burgess and Norman C Burgess, each to take one-half of all of the balance of my money and personal property, tangible and intangible.
    Fourth, I give, devise and bequeath to my daughter, Myrtle Burgess, three tracts of land, one of about 20 acres which came to me from my father, Thomas Burgess, another of about 7 acres which I recieved from my sister, Jennie Burgess, and the other of about 4 acres, which I purchased from Jesse Fisher; and I also give, devise and bequeath to her, said Myrtle Burgess, all that part of my Ziegler tract of land of about 165 acres which is situate above and west of Dry Run Ford, and right of way 16 feet wide on present road over part hereinafter willed to Woodrow.
    Fifth, I give, devise and bequeath unto my son, Woodrow Burgess, all that part of my Ziegler tract of 165 acres which is situate below and west of Dry Run Ford, this subject to right of way 16 feet wide on present road which right of way was above devised to Myrtle Burgess.
    Sixth, I give, devise and bequeath to my son, Norman C Burgess, about 20 acres of land which I purchased from Maggie Burgess.
     I name and appoint my two sons, Woodrow Burgess and Norman C Burgess, as Executors of this my last Will and Testament, and ask that they be allowed to administer upon my estate without giving bond.
      Witness my signature on this the 10th day of August 1948.

Signed, published and declared by C J Burgess as and for his last Will and Testament in the presence of us, who in his presence and at his request, and in the presence of one another, have hereunto subscribed our names as witnesses on this the 10th day of August 1948.


In the Clerks Office of the County Court of Grant County,
West Virginia, June 6th, 1958 -- In recess of said Court;

    This day Elton M Hiser, Clerk of the county Court of Grant County, produced  to the Clerk a paper writing purporting to be  the last Will and Testament of C J Burgess, late of Grant County, deceased; and upon motion of Norman Burgess and Woodrow Burgess, said Will was proven by the affidavit of J M K Reid one of the subscribing witnesses thereto, W F Hiser and H E J Oates, the other two subscribing witnesses thereto being deceased; whereupon came D E Cuppett, Jr and Lelia D Keiter, who being duly sworn stated that they are familiar with the handwriting of the said W F Hiser and H E J Oates, affixed to said Will as subscribing witnesses are the genuine signatures of the said W F Hiser and H E J Oates as they the said D E Cuppett, Jr and Lelia D Keiter verily believe and further the said W F Hiser and H E J Oates, are now deceased,; therefore on motion of  Norman Burgess and Woodrow Burgess, and there being no objections thereto, the same is ordered to be recorded as the true last Will and Testament of the said C J Burgess, deceased, as the law requires.
