Deed for the Knobley Church of the Brethren This deed made this the 30th day of July, 1956, by and between Charles G. Dettinburn and Bertha J. Dettinburn, his wife, and Bertha J. Dettinburn and Charles G. Dettinburn, her husband, parties of the first part, and Otis Rotruck, George T. Leatherman and Walter Whittaker, Trustees of the Knobley Church of the Brethren, and their successors in office, parties of the second part. Witnesseth: That whereas the said parties of the first part, along with other members of the Knobley Church of the Brethren, desire to build and erect a new church on the real estate herein conveyed and to obtain sufficient land for the future building of a parsonage and sufficient land for a cemetery; whereas the said parties of the first part are desirous of making a conveyance of the real estate necessary for this purpose if there is a new church erected on the real estate; Now therefore, in consideration of the promised aforesaid and the conditions hereinafter set out, the said Charles G. Dettinburn and Bertha J. Dettinburn, his wife, and Bertha J. Dettinburn and Charles G. Dettinburn, her husband, parties of the first part, do hereby grant convey here and unto the said Otis Rotruck, George T. Leatherman and Walter Whittaker, Trustees of the Knobley Church of the Brethren, and their successors in office, parties of the second part, the following described real estate situate on the northwest side of the Knobley road in Grant District, Grant county, West Virginia, which is described by notes and bounds according to a survey and play made by Earl H. Martin, surveyor, in June, 1956, as follows: Beginning at a stone in the line of George T. Leatherman and Dettinburn Land; thence N 29 30 E 38.7 poles to a stake; thence S 52 15 E 38. 6 poles to the edge of the Knobley Road on the northwest side of same, a stake now placed there, and stone to be placed there; thence with the edge of the road S 33 w 9.76 poles to a stake; thence S 35 15 W 9.56 poles to a stake; thence S 30 W 10.68 poles to a stone in the George T. Leatherman line; thence with said line N 65 45 36.76 poles to the beginning, containing 7.97 acres more or less. The real estate herein conveyed adjoins a part of the present Church property and is located on the northwest side of Knobley Road, and is a part of the second tract of 120 acres which was convey to the said parties of the first part along with other tracts of real estate, all adjoining, by Arnold F. Rotruck and wife in deed dated November 18, 1955, on record in the office of the Clerk of the County Court of Grant County, West Virginia, in Deed book 55, page 165. There is also granted and conveyed the right to take water from a spring located on the residue of the 120-acre tract which spring is situated northwest of the property herein conveyed, which right includes the right to lay a pipe line and maintain the same for the use and benefit of the 7.97 acres herein conveyed; however, this right shall not be exclusive to the Church, but shall be in common with the owners of the residue of the 120-acre tract and all of the residue of the lands of Charles and Bertha Dettinburn, they to have the right to obtain the overflow from the spring and to tap onto said water line. It is fully understood that the Church shall maintain and upkeep the water line, but that other parties shall bear the share of maintaining any line they may lay in tapping on to any water line or source of water. There is also excepted and reserved a right of way and road over the road being used in order to get to the residue of the Dettinburn lands, which right of way shall be of sufficient width so that it can be traveled for all purposes to and from the residue of said land. It is expressly understood and agreed that if the Knobley Church of the Brethren does not build the new proposed church building on the real estate herein conveyed, then said real estate shall automatically revert to the said parties of the first part, their heirs and assigns.
