Joshua and Isabinda were married at George Higginbotham's home. George Higginbotham m. Jane Glasgow, 3 August 1830. Joshua and Isabinda were living with Emanuel Higginbotham in 1860, Garrard County, Kentucky census. They appear on the 1880 census, pg. 545C, in PO Kirksville, Madison. On the 1880 census, Joshua's father was born in Maryland and his mother in Kentucky. Isabinda's father and mother were born in Virginia.
Married 15 May 1851 at Garrard County, Kentucky at the home of George Higginbotham.

This is a current picture taken in 1999 of the renovated home of Joshua Davis. The home is located on the Lancaster-Richmond Road, west of Richmond, in Madison County, Kentucky near Paint Lick.

    Obituary: Mrs. Eliza Davis, 91, Dies at Daughter's Home Mrs. Eliza J. Davis, 93, died at 10 p.m. Monday at the home of her daughter, Mrs. Martha Applegate, after a long illness. She was a native of Rockcastle County, but she lived in Madison County most of her life. She was a member of the Paint Lick Christian Church. Survivors are two sons, Thomas R. Davis and William J. Davis, both of Georgetown; a daughter, Mrs. Martha Applegate, Richmond; four grandchildren and six great-grandchildren. Funeral services were conducted at 2 p.m. Wednesday at the Oldham, Roberts and Powell Funeral Home by the Rev. W.R. Royce. Burial was in the Richmond Cemetery. Pallbearers were Wilson McQuire, Cecil Johnson, Verono Johnson, Albert Clark, James G. Davis, James Mason, Elmer McQuire Weaver.

NOTES:

My mother remembers Joshua and Ellen (Margaret) living together on their father's, Joshua Davis, farm in Madison County, outside of Paint Lick, on the Richmond-Lancaster Road. She thought they where husband and wife when she was growing up. The house is a manse type home and has been recognized as a excellent example of the architectural type. Joshua Davis, the father, did not build the home. Neither Joshua or Ellen ever married.

Louisa was going to move in with Benjamin Hudgens' family in 1938 but died before she could move in. She was staying with Margaret (Ellen) and Joshua after her husband, Joseph Maupin, died.

Joseph W. Maupin was born in 1844 and died in 1915.

Thomas Higginbotham (b.1837) lived next door to Joshua and Isabinda in 1870.

There appears to have been a number of lawsuits between Joshua Davis and George and William Higginbotham. The cases involve the estate of Emanuel Higginbotham, Isabinda's father and her inheritance:

APPEAL FROM GARRARD CIRCUIT COURT.

A petition was filed in the Garrard circuit court by the heirs of E. Higgenbothom against appellees to cancel deeds executed by E. Higgenbothom and wife to them, which were made some fifteen or twenty years prior thereto, claiming that the deeds had been secured by undue influence and false representations. Defendants answering, denied all the allegations of the petition, and claimed the land purchased in good faith, for a valuable consideration. They file with their answer and make it a cross-petition against one of the plaintiffs, Joshua Davis, who had been living on part of the land for a number of years, asking for a writ of possession against Davis, and a judgment against him for $ 1,200 for rent. Defendants also claim the land by virtue of their long possession, and set this up in bar of the action. The preponderance of the evidence showed that defendants had secured the deeds from their father and mother by representing that it would save the land being sold under a supposed claim against one of their uncles which might fall on their father, and that it would be held in the name of defendants for the benefit of all the heirs. The father [**2] continued to live with Davis, cross-defendant, and exercised and openly claimed ownership over the land. Davis took care of the old man, and did considerable repairs to the place, which had begun to deteriorate, and it was shown that all this aid was more than an off-set to any rental that the place was worth. It was also shown that the consideration alleged to have been paid, was purposely paid to the father of the defendants "to make it look like it was legal," and several witnesses testified that the amount had immediately thereafter been returned to defendants. The consideration stated in the deeds was but a small part of the amount the land was worth at the time the deeds were made.

The chancellor, upon final hearing, dismissed the petition against defendant Davis in so far as a recovery of rents was sought, but sustained the cross-petition as to a recovery of the land from Davis and awarded a writ of habere facias possessionem to defendants.

From which decree plaintiffs, and defendant Davis, prosecute an appeal.

DISPOSITION: Judgment affirmed.
HEADNOTES: Implied Trust.
It is shown that a father, for a grossly inadequate consideration, transferred to two of his sons, large tracts of land, on assurances from them, that it would protect him from a possible judgment and loss on a bond then outstanding, and also that the lands should be held by them for all the children, also that the payment of the consideration was denied by witnesses. It was held in the names of the sons for some eighteen years. In a suit by all the heirs, held to be both and express and implied trust.

Limitations of Actions--When right of Action Accrues.

Where property, held under an express or implied trust, which would not accrue until the death of the grantor and a refusal to fulfil the trust, neither a statutory nor presumptive bar will apply.

OPINION:

[*551] Opinion of the Court [**3] by Judge Robertson:

Considering the condition of the old father Emanuel Higgenbothom, the influence of his sons George and William who could mould him like clay in the hands of the potter, the gross inadequacy of the ostensible consideration, the strong probability that none of it was paid by George, and the extreme doubtfulness of any payment by William, and the fact and circumstances conducing to show a fraudulent purpose and sinister consummation by these two sons, and proving that the conveyances now litigated [*552] were finally extorted from their father and mother by assurances that the lands should be held in trust for all their heirs, subject to equal distribution among them at his death; such a trust, both express and implied, is the plain and inevitable conclusion of reason and of law.

Consequently, as the appellants had no cause of action until the old man's death and a refusal to fulfill the trust, neither a statutory nor presumptive bar applies to this case.

Wherefore, the judgment dismissing the petition against George and William is reversed, and the cause remanded for further proceedings for distribution, by sale or otherwise, of the lands among all the heirs [**4] and an equitable adjustment of the rights of all parties.

But the judgment dismissing the petition against Davis is affirmed.

Isaac is in the 1810, 1820 censuses for Madison County. Isaac and Margaret McSwain Davis' burial slabs are close to unreadable. Both slabs are made of limestone and have turned black. Someone has planted lilies in front of Margaret's slab. Next to Isaac's slab are a small American flag and some plastic flowers.   Both items appear relatively new (the flag has faded a little bit). In proximity to Isaac and Margaret you can find Richard and Mary Stephen Davis' head stones (both in very good condition) and Eno's wife Hannah Dowden Davis and three of their children (Hannah's headstone is still readable). I found Eno's and his second wife's daughter Zapra's headstone broken and on the ground. I placed it upright, leaning on what was left of the base of the headstone.

Jane Jameson is most likely buried in the Davis/Witt Cemetery, Rockcastle County, Kentucky. The cemetery appears to have been part of Isaac Davis' farm. Going north from the cemetery, you travel down a hill and his farm was located on the right.

Jane Jameson's parents were Thomas Jameson (b. 7 November 1732, d. 6 April 1830 at Indiana) and Hannah Taggart.
Jane married first Abner Bird, 7 March 1791 at Albemarle County, Virginia. After the death of her first husband, Jean (Jane) Jameson Bird married Isaac Davis at Franklin County, Virginia, bond 28 April 1798 signed by Williamson Davis, a second cousin to Isaac Davis.

There is a handwritten statement by Sallie Ann Davis, dated 11 December 1892 and gives the line of decent from Charles Davis through Isaac Davis. It is available at the National Headquarters of the DAR. Transcription:

"Isaac Davis was born April 11th 1766 he was the third son of Charles Davis (native of Wales) and Sarah (Waters) Davis. He had five broths. Benjamin, Peter, Joshua, Wilson, and Moses. He was married twice and was the father of fourteen sons and six daughters, also step father of two sons his first wife Jane Bird a widow whose parent name was Jimmeson mother of nine children Thomas Bird, John Bird, Charles Davis, Moses Davis, Lewis Davis, (Infant girl died) Alexander Davis, Isaac Davis, Jr, and David Davis. Sons and daughters of first wife. Margaret McSwain second wife mother of eight sons and five daughters Sallie Davis, Peter Davis, Enos Davis, Samuel Davis, Jane Davis, William Davis, Joal Davis, Susan Davis, Nancy Davis, Joshua Davis, Wilson Davis, Margaret Davis, Richard Davis. Lewis Davis third son of Isaac and Jane Davis was born in Franklin county state of Virginia May 6th 1802. He was married to Margaret Coyle January 10th 1837. They were the father and mother of three sons and seven daughters. Elizabeth Jane Davis, Sallie Ann Davis, Nancy Ellinder Davis, Minerva Davis, Mary Ellen Davis, Isaac C.     Charles Davis moved to Montgomery County, Missouri by 1834. Elizabeth Carter's parents were Henry Carter and Mary Price. Char Brown supplied the images of Charles Davis and Elizabeth Davis' tomb stones and obituaries for Isaac P. and Talitha J. Weekly Davis. Charles and Elizabeth had a total of ten children. Isaac P. was the third oldest child.

      OBIT for Isaac P. Davis: "DEATH OF CAPT. ISAAC P. DAVIS" Aged Resident, Esteemed by All, Was Called to His Final Reward On October 10, 1912 Isaac P. Davis was born in Madison County, Kentucky, June 5, 1826. He was the third of ten children by Charley and Elizabeth Davis. Early in life he moved to Montgomery County, Missouri, then to Van Buren County, Iowa, and finally to Scotland County, Missouri. He was a good American citizen, law-abiding, honest, and industrious. He served for a long term in the Civil War, and was honored in his death by the presence of six old soldiers who acted as pall bearers at his funeral. They were Messrs. Johnson, Smith, Bennett, Singleton, Carns, and Jerry Smith. Mr. Davis was not a member of any church but was a liberal supporter of it, and believed he was saved. He left behind him a wife and five children: Stephen, Marion, Loran, Luthena Calahan and Jennie Davis, all of whom were present at the funeral. A large gathering of friends and neighbors gathered at the home Saturday at 1 o'clock p.m. to pay their last respect to one who had been their friend and helper. Rev. Fowler of Mt. Sterling, assisted by Rev. Lloyd Tennant of Cantril, conducted the services. A goodly number of people accompanied the remains to the old home cemetery where it was laid to rest. The sympathy of many friends go the bereaved family. Mr. Davis has passed the eighty-six mark and has spent these years in faithful service. He will be greatly missed by all."

      OBIT for Talitha J. Davis: "AGED LADY OF COUNTY DIED IN MT. STERLING Talitha J. Davis, eldest daughter of Stephen G. and Lydia Weekly, was born in Muskingum County, Ohio, May 18, 1835, and passed away at the home of her daughter, Mrs. Harry Davis, near Mt. Sterling, Sunday, June 27, 1920, at 4:30 p.m., after only a few hours illness, aged 85 years, 1 month and 9 days. Deceased came with her parents to Van Buren County, Iowa, when five years of age, and practically all her girl hood life was lived on a large farm near the Iowa line in Grant township, Clark County, Mo., a few miles southwest of Farmington. She was united in marriage to Isaac P. Davis, of Scotland County, Mo., March 13, 1856, who preceded her in death October 10, 1912. To this union were born eight children, five of whom survive to mourn their loss of a kind and devoted mother, namely: Mrs. Luthena Callighan, Stephen G., Loran, Mrs. Jennie Davis, all of near Mt. Sterling, Iowa, and Frances M. of Kirksville, Mo. All were at her bedside when the end came. Also ten grandchildren, eight great-grandchildren, three sisters, Mrs. Athelia Tackaberry of Cantril, Mrs. Emily House of Kahoka, Mo., and Mrs. Marrietta King of Guthrie, Oklahoma., besides many other relatives and friends. Funeral services were held from the home Tuesday afternoon, June 29 at 2 p.m. conducted by Rev. L.V. Brown of Mt. Sterling. Brs. E.B. Mosier, Mrs. J.H. Dill and Rev. Brown of Mt. Sterling rendered several beautiful songs. The remains were laid to rest in the Jordan cemetery beside her husband and three children gone before. "Farmington Correspondence in Saturday's Gate City"

        From the Van Buren County GenWeb: Stephen G., son of Isaac P. and Taditha [sic] J. Davis, was born Oct. 11, 1861 on the old Davis homestead in Scotland County, Mo., and passed away Dec. 6, 1933, at the age of 72 years, 1 month and 26 days. He lived in Scotland County during his entire life and lived almost 52 years on the same farm where he passed away.
        He was united in marriage to Dora J. Kerr of Mt. Sterling, Iowa, on Nov. 7 1886. To this union were born four daughters, Mae, Bessie M., Elsie D. and Lela Irene, and one son, Leonard. He leaves to mourn his passing his wife Dora, and four daughters, Mrs. Jesse Fritz of Fon du Lac, Wisc., Mrs. J.L. Piper of Mt. Sterling, Mrs. [unk], Mrs. Phil Morris, and his only son, Leonard, all living on surrounding farms; also twelve grandchildren, two brothers, Marion and Loren of Mt Sterling; also one sister, Mrs. Jennie Hervey of Mt. Sterling, and a host of other relatives and friends. The children were all present and able to care for him to the last. He was a loving husband and father, a kind neighbor and friend. He will be greatly missed.

        From Char Brown, OBIT: " Harry True Davis, son of Joseph H. and Susanna Davis, was born near Mt. Sterling, Iowa, Nov. 5, 1872, and he died at his home April 2, 1923, Being at the time of his death 51 years, 7 months and 27 days. He married Jennie Davis in 1900. Surviving him is the wife and aged mother, two nephews and a host of other relatives. The father and one sister have gone before him." From the Kahoka Courier

        Kahoka Free Press, April 5, 1923: ACCIDENTALLY KILLS HIMSELF MONDAY. On Monday Morning, Harry T. Davis, of Mt. Sterling, Iowa, arose and built the fire, did his chores and then got his gun to clean it up and when doing so it was accidentally discharged and took effect in his head and he expired in twenty minutes. He was manager of the Produce County. there and a capable man and highly respected. The tragedy caused a pall of sadness in that town and vicinity. He leaves a wife and many relatives who deeply mourn his tragic death. Funeral services were held at the Christian Church in Mt. Sterling, on Tuesday at 2 p.m. Conducted by Rev. Shaw, of Cantril, Iowa."

    A Moses Davis is found in the 1838 Van Buren County, Iowa Territory census, 2 males, 5 females. While this may not be the same Moses Davis, it is a curious coincidence. Nothing is found on this Moses Davis in Van Buren County after 1838. Also, see below regarding an Appeals Court decision involving one of Isaac Davis' sons. This court case most likely refers to Moses Davis early death.

    Lewis' death record states he died of consumption/T.B. It also states his father as Isaac Davis, and that Lewis was born in Virginia. Isaac Coyle signed marriage bond 6 January 1837. Lewis signed the marriage bond for Washington Baker (PG: Basil and Rachel Baker) and Elizabeth Coyle (PB: Isaac Coyle and Massy Percival).

He was honest and lived in peace with his neighbors and acquaintances. He minded his own business. He never married. He was esteemed by all who knew him. The funeral services were at the church in Vernon, Sunday, July 7 at 2 o'clock p.m., Eld. C.L. Wheeler of Keosauqua preaching the sermon. The burial was in the Vernon cemetery.

      From Van Buren County GenWeb: Joshua, son of Isaac and Sarah Ann Davis, was born on a farm near Vernon, Iowa, May 18, 1855, and departed from this life April 27, 1934, at the age of 78 years, 11 months and 9 days. He was the next to the youngest child of a family of eleven children, all of whom preceded him in death excepting Perry L. of Pocatello, Idaho.
      Joshua had made his home for the past several years with his niece, Mrs. Mellita Lackey of Bonaparte, where he received kind and devoted care. He had been for years and was at the time of his death a member of the Mason Lodge of Bonaparte.
      Joshua, or Uncle Josh, as he was familiarly called, was well known and liked in his circle of old friends who were numbered by his acquaintances, as his personality was one to inspire friendship and which won for him many friends wherever he went.

    Keosauqua Republican Thursday, 11 February 1915 p. 2 col. 5: "Mrs. Margaret Witt was born in Kentucky in 1833 and lived there all her life until the death of her husband about five years ago, after which she came to Van Buren County, where three of her six children reside, viz.: Mrs. J.A. Duvall of Vernon township and Charles and John Witt of Henry township. She died at the home of her son, Charles, Monday morning of this week, where she was making her home, her age being past 81. Funeral services, in charge of Eld. Lewis of Keosauqua, were held at the Charles Witt home, Tuesday afternoon at 2 o'clock, interment being in the Fellows Cemetery. We will have an obituary next week."

    Keosauqua Republican Thursday 18 February 1915 p.2 col. 6-7: "Margaret Davis, daughter of Isaac and Margaret Davis, was born in Rock Castle County, Kentucky, 4 June 1833 and departed this life 8 February 1915 at the home of her son, Charles Witt near Keosauqua, Iowa aged 81 years 8 months and 4 days. She was united in marriage to Stephen Witt, 2 February 1854. To this union were born eleven children, five having preceded the mother in death.
    About 32 years ago she gave her heart to Jesus and lived for him until death called her.
    In January 1910, she came to Iowa to make her home with her son, Charles. She leaves to mourn their loss two daughters and four sons. They are Margaret Richmond of Boon, Kentucky; Sally Duvall of Keosauqua, Iowa; Charles W. Witt, near Keosauqua, Iowa; Samuel D. of Wenatchee, Washington; John near Verono, Iowa, and Dick of Tennessee. Besides these she leaves 20 grandchildren and 10 great grand children. "Grandma Witt", as she was known was a true blooded Kentuckian and loved her native state. While her sons did what they could to make her new home in the south. Funeral service were held at home of her son, Charles, Tuesday afternoon, 9 Feb. by H.L. Lewis, pastor of the Christian church, of Keosauqua, and burial was made in the Fellows cemetery."

Isaac Davis was born in Maryland and moved to Virginia with his father Charles Davis. Isaac was in Henry and Franklin Counties, Virginia during the later part of the 1780's. He moved to Kentucky between 1802 and 1806 based on the birth dates and states of his children. Kentucky Land Warrants show Isaac Davis receiving two land warrants for 100 A. in Madison County. on Silver Creek, 31 March 1817, and 50 A. in Madison County. on Clear Creek, 28 May 1819. Isaac purchased 100 A. from his son or brother Moses the 22 December 1836.

From Cheri Salz, descendent of Enos and Nelly Mullins Davis, as told to her by her grandmother:

"There were 22 children in all. Three of the girls were Margaret, Jane and Nancy. Some of the sons were Peter, Lewis, William, Wilson, Enos, and Isaac, Moses and Richard (Grandfather of Nda Shearer who collaborated some of this information for me.) Moses died real young.

My grandfather Davis (Enos) believed in education. He gave ground and timber to build a school on his land and all of his children, Sarah (Williams), Louisa (Roberts), Alice (Shifflet Tudor Barlow), Mary (Lane), Nettie (Baily) and Lewis could read, write and "cipher", their name for arithmetic. Lewis did not marry and was killed by a train about 1906. Sarah had 5 children, Louisa had 16, Alice had 5 and one still born, Mary had 1 and Nettie had 5. The name Lewis and Richard keep showing up in children in the family.

Some animals were not so lucky in their association with Alice Davis. I've heard her tell of being out hunting (in Kentucky) with her brother Lewis. He saw a copperhead snake and shot it and they suddenly discovered that they were in a nest of hundred of snakes. They jumped off a ten foot cliff to escape.

One time the same two were down by the "branch", a small creek, and the geese were swimming along. Uncle Lewis said "Alice, I'll bet I can hit that old gander in the head." He threw the stone and did hit the gander and killed him. They knew "mammy" would be after them so they pulled his head off and stuck his neck between the fence rails of the pig pen and let their mother think the pigs had killed him.

I've heard my mother tell how she and her three sisters were to go to a "play party" really a dancing party. They all had new knit wool stocking except for one stocking and this was the day of the party. Aunt Nettie went to the pasture and pulled wool off the sheep, my mother, Alice, "carded" and spun it into yarn, Aunt Low dyed it and Aunt May knit the stocking in time to go on horseback - two to a horse, to the party.

A very short time before her last illness, my brother took my mother back to Kentucky and they went out to the old place. The house and buildings were gone but the willow tree by the gate was still there. Mama said once when she brought in the cows she had picked a willow switch to drive them with. When she got to the gate, she struck it in the ground and it grew. The tree was about 70 years old when she last saw it.

My mother used to tell of the time that all the cousins sat up with cousin Tom who was dying. The doctor had ordered them to give him a little toddy now and then. Toddy as a drink made with hot water, sugar, whisky and a dash of nutmeg. Every little while they would make up a new batch and say "Have a little toddy Tom". Tom got a tablespoon full, the others each a glass full and by the time Tom was past taking his share, all the rest where hilariously drunk."

Regarding Enos and Hannah Dowden Davis:

"He courted a girl named Hannah Dowden. They were to be married but a man came thru driving a drove of hogs to New Orleans market. Enos went with this man and did not get a chance to tell his sweetheart goodbye. He was gone six months and she thought she had been deserted but he returned with enough money to marry on."

Rockcastle was formed in 1810 from portions of Pulaski, Lincoln and Madison Counties.

I found an interesting Rockcastle County District Court case which may help in determining what happened to Moses Davis. Isaac Davis died in 1847 and Moses Davis is supposed to have died before then. In 1822, Moses had a patent issued to him. If this court case involves the patent issued to Moses Davis, then it might be possible to determine time and date of Moses death. Records in Rockcastle County were destroyed in the 1850s, but supporting material for this case may be still available in the state archives:

OPINION: [*656] Opinion by Judge Pryor:

In this case the fact that the land patented to the appellee was in Rockcastle county instead of Madison did not invalidate the patent, nor give to the appellant the right to enter it or patent it as wild land. His patent to the extent that it embraced land already patented was void. The agreed facts show the existence of the elder patents and the derivation of title by the appellee from the original patentees. The original patents were issued to Davis, and, he dying without children, the land descended to his father, Isaac Davis. Isaac died intestate and after his death the land was sold and purchased by West.

The land shortly after these patents issued was in Madison county, but the county line being changed between Madison and Rockcastle counties placed the land, or the most of it, on the Rockcastle side of the line. The boundary of the line is given in the patent, its location fixed and definite by this boundary; and the appellant to the extent of [**2] his interference is guilty of a trespass, and is without title. After the agreed facts admitting the title to be in West, if the patents are valid, we see no reason for controversy. The land in dispute belongs to the appellee and the judgment is affirmed.

Judgment affirmed.

Sallie Anne Davis, daughter of Lewis Davis son of Isaac Davis, wrote in 1897 that Charles Davis' first wife as Sarah Waters. She was told this by Lewis Davis her father and Samuel Davis, Lewis' brother. She also wrote that one of Lewis' brothers was Wilson Davis. Thomas Blackburn Davis is not listed in her notes but he is listed in Charles Davis' will. All of the others listed here are given as brothers to Isaac Davis. A search of Trinity Parish, Charles County, Maryland records shows a Sarah Waters, b. 10 September 1740, as the daughter of James Waters and Mary Waters.

Note: Sallie Anne Davis' hand written notes on the Davis family can be found at the national headquarters of the DAR. She wrote that Isaac Davis' first wife was Jane "Jimmeson" Jameson and that Jane married first Abner Bird. Records in Franklin County, Virginia show an Isaac Davis marrying a Jane Bird on 28 April 1798. Sallie Anne also writes that Jane Jameson had two children by Abner Bird, Thomas Bird and John Bird. The only mistake in her notes is the statement that Charles Davis was born in Wales. From Trinity Parish and Charles County will records it is known that he was born in Charles County, Maryland. If you read Sallie Anne Davis' will, it is meticulous in noting her brothers and sisters, whether they are dead or alive, and how many children they each had. In the context of the will, these notations are frivolous to the deposition of her estate. It is because of her meticulous nature that I am placing a heavy weight on her notes. While other researchers show Sarah as either Cooksey or Moreland, there is a possibility that her surname was Waters, based on Sallie Anne Davis' notes and the Trinity Parish record of a Sarah Waters being born in the right time period. More research on this Sarah Waters needs to be made before she can be eliminated as a possible spouse of Charles Davis. It is possible that Sarah married a Moreland first. Records of Trinity Parish show a Charles Davis marrying Sarah Moreland on 11 May 1762.

Anne Dent was the daughter of John Dent III and Mary Blackburn/Blackman. Their children were: Anne Dent; Hatch Dent; Mary Dent; Sarah Dent; Tabitha Dent; John Dent IV; Bennet. When John Dent, Sr. died he left to his oldest son John, Jr., a plantation called "Dent's Inheritance," John, Jr. conveyed 144 A. to his brother Hatch Dent. He gave others to his syblings and kept 250 A. for himself.

According to a researcher, as quoted in the Abstracts of Revolutionary War Pension Files, pgs. 890-891, Charles Davis was born in England. Also, in the History of Henry County Virginia, states Charles as being born in England. These two sources are incorrect. Charles Davis was born in Charles County, Maryland. Charles Davis' father David was also born in Charles County, Maryland. Trinity Parish in Charles County is where Charles' marriages to m/1 Sarah Moreland and m/2 Anne Dent are recorded as well as where the births of his children are registered. Charles married Sarah Moreland on the 11th of May 1762 at Trinity Parish, Charles County, Maryland. Sarah was, however, may be a Moreland by marriage, according to a Davis family researcher. Her supposed maiden name was Cooksey.

Charles Davis was a revolutionary War veteran and pensioner. Charles' service record was lost due to a fire at the War Office in 1800.  In 1777 Charles Davis is on the muster list as Sergeant in Captain Henry Clarkson's Company, 12 th Battalion. Early in 1778 Charles Davis is on a constable's list in Charles County, Maryland. Between the years 1779 to 1780 Charles' name appears on a number of documents, however, until the birth of Thomas Blackman Davis on 23 August 1782 does Charles' name again appear in Charles County, Records. Given a conception dated of either December 1781 or January 1782, Charles maybe the Charles Davis who's name appears in a list of men who "received from Robt. Denny such sums as were due them, October 13th, 1781." Lt. Robert Denny was with the Fifth Regiment of the Maryland Line on 3 January 1780 (Regiment numbering is a little confusing during this time period, Robert Denny also shows up in the Seventh Regiment during the same time period). If this Charles Davis was demanding "sums due" from Lt. Robert Denny then Charles would have been in South Carolina during the year 1781. The Maryland Fifth was detached from the main army on 14 August 1780, two days before the disastrous Battle of Camden with 100 Maryland Continentals (Line) and 300 North Carolina militia and sent to reinforce Colonel Thomas Sumter a few miles away from Camden. They captured a British baggage train bringing supplies to the British Army at Camden. Two days later the Maryland Continentals were surprised by Lt. Col. Tarleton as they were resting at Fishing Creek. 300 Marylanders were captured. Prisoners taken at Camden and Fishing Creek were transfered to Haddrel's Point across the river from Charleston, South Carolina. The prisoners there were exchanged between 12 May 1780 and 15 June 1781.

After the war Charles moved his family to Franklin and Henry Counties in southern Virginia and lived in the Reed Creek District prior to 1787.

Charles is listed for a poll taken for Delegates at Henry County Virginia on the 9th of April 1787 for Abraham Penn and Thomas Cooper. He also served on a jury for the inquisition on land located on Beaver Creek, Henry County Virginia on 10 December 1790.

Charles Davis died 1 February 1807 at Henry County, Virginia. Charles owned 155 acres, surveyed on the 1st of November 1785, at Henry County, Virginia on Reedy Creek. According to a deed, before his death, a Charles patented two 50 acre tracts in Madison County Kentucky. Moses Davis sold the land to his father or brother Isaac Davis, son of Charles Davis, on 22 December 1836. It may have been an inheritance from Charles or land Isaac sold to his son or brother and then bought back. But regardless the reasons, part of the Davis family was now established in Kentucky.
