Judicial and Political All Fools Day in Canada By Stephen Gray December 9, 2004 should be known as; “ Judicial and Political All Fools Day” in Canada. The declaration on this day, by the Supreme Court, that abnormal couplings between persons of the same-sex also constitute a “marriage” is hogwash by judges with unlimited power. “This extraordinary power grab by the Canadian courts has occurred because there are no checks and balances on them, and the courts rightly reason that they can do whatever they please, no matter how spurious their reasoning, or how unhealthy their decisions are to democracy and society.” ( lawyer C. Gwendolyne Landolt writing in her article: “How The Courts In Canada Swept To Power.” Some Judges in the lower courts who had already lost their ability to reason logically had already said, “same -sex marriage” was an “equality right” under the Charter. The Charter of course is a “living tree” in judicial parlance, so it looks like this tree gives off fumes or a noxious gas that destroys the normal judicial brain cells. This causes our “finest legal minds” to become confused and to be unaware they have lost their ability to reason or speak coherently. This foolish reasoning has now contaminated the nine judges on the Supreme Court and now they have become infected as well. This is what happens when they all ruminate under the branches of the diseased Charter tree. What should be done with this contaminated Charter. The country’s only hope is for it to be destroyed, burning it would be fast and clean. But, before doing this, the only healthy branch left in the diseased Charter tree, the not withstanding clause, should be used to annul all unstable judicial decisions that were handed down under the Charter. The old BNA Act could be used to return sanity to the land. The country was sane and sensible before this abomination called the Charter of Rights and Freedoms was imposed upon us. So do we really need a Charter? We survived for many years without this appendage to the Constitution. This diseased Charter: This “ living tree” was never voted on by the people individually, but was imposed by the elites so it was an undemocratic, rotten piece of lumber, bizarrely called “rights” and “freedoms.” One great step for real freedom would be to remove those judges from the bench who have subverted the law and the judicial system by imposing “rights” on society that were never in the Charter but were “read in.” But I would not bet on it. The reason all this mockery of law has come down the tube is because our elected politicians have abdicated their responsibilities to the people of the country. Preferring to accede to nonsense rather than to normalcy they have in fact become political fools. The politicians are a big problem because judge appointing is a patronage system and it is not the judicial finest who are appointed but political judicial favorites. Still, politicians can be voted out of office. But, by then the damage has been done and we are left holding the bags of dictatorial judicial appointees until 75 years of age. “The [Supreme] Court is more powerful than the federal Cabinet, Parliament and the provincial governments because it has the power to trump their decisions - and often it does….Reform of the appointive process to the Supreme Court is not only much overdue, I believe the existing system is also unconstitutional.” (Jacob Ziegel, professor of law emeritus at the University of Toronto, in his article: “A Supreme democratic deficit” page A14, National Post, August 12, 2002.) The politicians have handed over our democracy to non-elected appointed judicial dictators. This is not the independence of the judiciary as we are brainwashed into believing. This is the imposition of the judiciary and it is not healthy for a so-called free society. We are not free when unnatural “rights” called “same-sex marriage” are approved by non-elected, appointed judges whose main claim to fame is they used to be lawyers. Somebody once said: “Oh, to be rid of those accursed lawyers.” What they really meant to say was: “Oh, to be rid of those accursed judges who used to be lawyers and the politicians who appoint them.” This latest judicial and political nonsense on “same-sex marriage” will be remembered for its date; December 9, 2004; Judicial and Political All Fools Day in Canada.
