Original Claim

Declaration in order to be placed (on) the Pension List under the Act of the 18th of march 1818

State of New York St Lawrence County-----On this eighth day of February 1831 personally appeared in open court being the Circuit Court and Court of ---- and ---- for the County of St Lawrence held in the state of New York. I being--Court of Record, Jonathan Allen of the Town of Madrid in the said county and state aged Seventy eight years who being duly sworn according to law doth on his oath make the following declaration in order to obtain the provisions made by the act of Congress of the 18thMarch 1818 and the 1st May 1820 that he the said Jonathan Allen enlisted for the term of three years ---- -----[scratched out] in the month of May in the year one thousand seven hundred and seventy five in the now state of Vermont in the Company commanded by Colonel Seth Warner in the line of the State of New Hampshire in the Continental establishment. That he continued to serve in said Corps until the month of November in the year one thousand seven hundred and seventy seven when he was discharged from the Service at Fort Edwards in the State of New York; that he hereby relinquishes every claim what ever to a pension except the present that his name is not on the roll of any State and that the following are the reason for not making an earlier application for a pension.

That shortly after the passage of the act of Congress of the 18th March 1818 he applied to Rupert Attwater Esquire, then one of the judges of the Court of Common Pleas of the County aforesaid to assist him in procuring the provisions of the act. That a Declaration was prepared which this Deponent (?) Signed and left with the said Attwater to be forwarded to the proper office. That he was afterwards informed that his application was denied for want of sufficient proof of his services. That it was not until about a years time that he was informed that Nathan Beman with whom he had served during the Revolutionary War was still alive, and that it was not until a journey had been undertaken to procure the affidavit of the said Nathan Beman that he heard that Samuel Barton was also still alive.

And in pursuance of the Act of the first of May 1820 I do solemnly swear that I was a Resident Citizen of the United States on the 18th day of March 1818 and that I have not since that time by gift sale or in any manner disposed of my property or any part thereof with intent thereby so to diminish it or to bring myself within the provisions of the act of Congress entitled "an act to provide for certain persons engaged in the Land and Naval Service of the United States in the Revolutionary War' passed on the 18th day of March 1818 and that I have not nor has any person in trust for me any property or securities contracts or debts due to me nor have I any income other than what is contained in the Schedule hereto annexed and by me intended(?).

One cow, now 6 years old raised by the Declarant from a cow owned by the Declarant on the 18thMarch 1818 which was killed & consumed in the family of Declarant in the year 1825. That he has not since the 18th March 1818 owned any property other than this cow, except his necessary wearing apparel for himself and wife which was consumed by the burning of Declarants house in the spring of 1830. The Declarant further states that he is by occupation a farmer, that in the year 1819 he became totally blind but afterwards partially recovered, but not so much as to enable him to perform any labor that his family consists of his wife aged Seventy Seven years, who is in poor health, and a grandchild about seven years old who in the duties of the family.

I, James C. Hopkins Clerk of the County of St Lawrence in the State of New York and Clerk of the Circuit Court and of the Court of Age & Terminence(?) In the for said County do hereby certify that it appears to the satisfaction of the said court that the said Jonathan Allen, the above named Declarant did serve in the Revolutionary War as stated in the preceding Declaration request the pension ----- being for more than the term of nine months under one engagement on the Continental establishment. I also certify that the forgoing(?) Oath and the Schedule there to annexed are truly copied from the records of the said Court, and I do further certify that it is the opinion of said Court that the total amount in value of the property exhibited in the aforesaid Schedule is fifteen dollars. And I further certify that the said Jonathan Allen being unable to write made his mark to the Declaration in my presence.

Declaration

In order to obtain the benefit of the third section of the act of Congress of the 4th July 1836

St Lawrence county

On this twenty seventh day of February 1837. ------------------- personally appeared before Phineas Attwater a justice of the peace in the State of New York in said county of St Lawrence, Margaret Allen a resident of the town of Madrid County and State aforesaid aged eighty three years who being first of July sworn according to law doth on her oath make the following declaration in order to obtain the benefits of the pension made by the act of Congress passed July 16th 1836. That she is the widow of Jonathan Allen who was a private soldier in the Army of the Revolution and was in Colonel Seth Warner's Regiment enlisted in the spring of 1776 and was until the fall of 1779 was in the battle of Bennington and some other battles, he resided in the town of Winchester now State of Vermont at the time he enlisted. This Declarant has no documentation in her possession in support of her claim to a pension. Her husband the late Jonathan Allen was ------ on the pension list-roll of the Albany Agency on the Seventh day of January 1832 and drew his pension until the fourth of March last. She further declares that she was married to the said Jonathan Allen in the month of May in the year seventeen hundred and seventy in the town of Dover, County of Duchess, State of New York by a Justice of the Peace at which time no record was kept or required by law, she resided in the town of Manchester, State of Vermont for about --- years after marriage. That her husband the aforesaid Jonathan Allen died on the seventeenth day of March 1836 and that she has remained a widow ever since that period, as will more fully appear by -------- to the proof hereto annexed.

That it was understood in the family that they were married in the town of Dover State of New York and have ever since this defendant(?) --- ------ --------- together as husband and wife until the time of said Jonathan Allen's death on the 17th day of March 1836 and since that period said Margaret has lived in the family of this deposing and remained a widow.
