Sumner County

1786 - Sumner County, Tennessee formed from Davidson County, North Carolina, becoming part of the Territory South of the River Ohio (popularly called the Southwest Territory) from its creation in May 1790 until Tennessee became a state in 1796. [County Courthouse Book, Elizabeth Petty Bentley, Genealogical Publishing Co., Baltimore, MD] United States Census reports are available for each year from 1820 through 1880. The capital is Gallatin. The County Clerk has marriage and probate records.

The petition of James B. Rippy, Mary A. Witham and husband Wm. Witham, Martha J. Rippy and husband Andrew Rippy, Sarah Brewer and husband A. H. Brewer, Nancy Witham and husband F. M. Witham, and S. L. Rippy, filed in the county court of Sumner county against Susan Rippy and husband Thomas Rippy, R. J. Brown, John W. Brown and Geo. W. Brown, minors who have for their guardian M. D. Anglea and Edward Duffer, Administrator of Elizabeth Mayberry deceased, all citizens of Sumner County.

Petitioners would respectfully show unto your honor that Josiah Rippy departed this life in the county of Sumner in the year 1845 and that at the November term 1845 of the county court of Sumner a paper writing purporting to be the last will and testament of the said Josiah Rippy deceased, was admitted to probate in common form at the instance of Elizabeth Rippy who is married as executor in said will.

Petitioners would show your honor that they are children of said Josiah Rippy, deceased, by a former wife and were aged at the time of his death and probate of said will respectfully as follows: J. B. Rippy about fifteen years, Mary A. Witham about thirteen years, Martha J. Rippy about eleven years, Sarah Brewer about nine years, Nancy Witham about seven years, and S. L. Rippy about two years, all of whom as your honor will observe were minors and the most of them very young.

Petitioners would show your honor that Elizabeth Brown, the widow of the said Josiah Rippy and Executrix named in the said paper writing has since dec’d, leaving us his only heirs and distributors the defendant Susan Rippy who was the only child of the said Josiah Rippy by the Elizabeth who has since intermarried with Thomas Rippy and Mary E. who intermarried with Wm. M. Rippy, Sydney M. Brown, R. J. Brown, Jno. W. Brown and Geo. W. Brown, grandchildren of the said Elizabeth, being children of her deceased son, Robert S. Brown, the four last of whom are minors and have for their regular guardian the said M. L. Anglea as his only heirs and distributors of law. The said Edward Duffer administrator of the said Elizabeth Mayberry who had previous to her death intermarried with Philip Mayberry.

Petitioners charge that said instrument or paper writing purporting to be the last will and testament of the said Josiah Rippy deceased is not his will because he was as four petitioners are informed and believe not possessed of sufficient mind and memory to make and execute the same and that he was improperly influenced to make and publish the same at the time it purports to have been executed, petitioners therefore pray that the said Susan Rippy and husband Thomas Rippy, Mary E. Rippy and husband Wm. M. Rippy, Sydney M. Brown, R. J. D. Brown, Jno. W. Brown, Geo. W. Brown, minors and their guardian M. L. Anglea and the said Edward Duffer administrator of said Elizabeth Mayberry the executrix named in said will be summoned and appear before your honor to answer this petition that said probate of said paper writing be set aside and the paper writing purporting to be a will be transferred for reprobate to the Circuit Court of Sumner County where your petitioners may contest its validity on open of (divisions vel non) (?) to be made up for that purpose that petition such and general relief as the nature of the application demands.

Horse - $120. Wounded and captured at Lee and Gordon’s Mill, near Chickamauga, Georgia, Sept. 12, 1863. Horse killed. Musket ball through calf of leg. In U.S. hospital at Chattanooga.

James Wesley Rippy 20th Tenn. Infantry Co. F

Enlisted June 1, 1861 for 2 years. From Bethpage.

9th Tenn. Calvary Co. E

Enlisted Sept. 1, 1862. From Fountainhead. 4th Sgt. Furnished horse. In Battle of Greasy Creek near Somerset, Kentucky, June 9, 1863. Wounded in left hand. Left sick with chronic diarrhea on Indian Creek in Wilson Co., Tennessee, when the Ohio raid was made. Escaped capture at Buffington’s Island and came home. Oath at Gallatin in August, 1863.

Jerry M. Rippy 9th Tenn Co. E

Enlisted March 1, 1863. From Sumner County. Furnished horse. At Greenville, Tennessee, Sept. 4, 1864, General Morgan’s command was surprised, defeated and badly scattered. General Morgan was killed. Made his way home although sick. Was 6 weeks getting home. Never served again. From Bethpage.

Enlisted May 9, 1861.

9th Tenn. Calvary Co. E

Enlisted Sept. 1, 1862. From Sumner Co. Furnished horse. In battles at Hartsville, Lavergne, and Murfreesboro. Detailed with Thos. G. McQuirter, Calvin B. Holmes and William Simpson to care for the sick at Cookeville. Deserted Sept. 9, 1863. Captured as a deserter near Chattanooga, Sept. 11, 1863. Oath. To be released at Gallatin.

Discharged on disability, overage, July 16, 1862, at Vicksburg, Mississippi. From Pondville, Sumner County, Tennessee.

Enlisted Sept. 22, 1862. In battles at Hartsville and Lebanon, Tennessee. Escaped across the Ohio River at Buffington’s Island, O., July 19, 1863. From Bethpage.

Sidney M. Rippy 20 Tenn. Infantry Co. F

Enlisted June 1, 1861, at Camp Trousdale. Sgt. March 11, 1863. In battles at Wildcat, Kentucky; Fishing Creek, Kentucky; Shiloh, Tennessee; Beech Grove (Hoover’s Gap), Tennessee; Vicksburg, Mississippi. Left thumb shot off at Shiloh. While the army was camped at Tyner’s Station, near Chattanooga, was given a furlough home. Captured by U.S. forces. Sent to City Point, Virginia. Eschanged. Rejoined regiment at Chattanooga. Captured again on Atlanta Campaign. Paroled on oath.

Sept. 1, 1862. 2nd Sgt. Furnished horse. In battles at Hartsville and Cainsville. Thrown from horse at Battle of Hartsville and ruptured. Sent home by his captain. Shown on roll through Dec. 1862. From Witham.

Enlisted Sept. 1, 1862. 3rd Corp. From Nubia. Furnished horse. In battles at Salmon, Kentucky; Elizabethtown, Kentucky; Hartsville, Tennessee and Greasy Creek, Kentuck. Deserted July 8, 1863.

W. Alford Rippy (Big Bill) 20th Tenn. Infantry Co. F

Enlisted June 1, 1861. Deserted at Murfreesboro Dec. 14, 1862.

9th Tenn. Calvary Co. E

Enlisted Sept. 1, 1862. Captured at Cheshire, Ohio, July 20, 1863. Sent to Camp Chase, Ohio, then to Camp Douglas, Illinois, where he died of pneumonia, April 1, 1865. Grave no. 124, block 3, Chicago City Cemetery. A brother in prison with him states that he froze to death. Practically no bedding, a cold climte and in a weakened condition.

Enlisted June 1, 1861. Discharged on disability from throat and lungs at Murfreesboro, Oct. 20, 1862. (Pension records) Army records show deserted at Murfreesboro, Dec. 14, 1862. From Westmoreland.
