Re: Unauthorized Structures in Podium/External Wall of Amoy Gardens

The unauthorized structures at the captioned have drawn the attention of residents in Amoy Gardens for couple of years and I had reported the case to the Buildings Department on 29.11.2000, see Appendix 1 the letter I wrote to Buildings Department about the locations. The Buildings Department also confirmed to me, see Appendix 2, that those structures were unauthorized building works and a warning letter had been issued to the owner, in such case I believed that it was Hang Lung. So far I do not note that any corrective action has been taken by the owner. Although I do not know whether you, Hang Lung Property Management Limited, is the owner of Podium, you as the management company and within the same group of Hang Lung properties, has the FULL responsibility for the said unauthorized structures.

Having said that, I have to remind you that the said illegal structures not only contravene Clauses B2, Section IV of Deed of Mutual Convenant but also have negative effects on the whole appearance of the estates.

You are thus notified to remove the said illegal structures within fourteen (14) days from the date of this letter, otherwise, we may proceed legal action against you and we will also claim you the legal costs incurred.

Furthermore, having considered the performance of your company in recent years including the Legionella Pneumophila and Atypical Pneumonia, we do not consider that you have done a good job in Amoy Gardens, please go away from Amoy Gardens because we all shame on you, Hang Lung Property Management Limited (previously known as Chi Pan Management Company Limited), you should be aware of how much the management fees in Amoy Gardens which is almost the highest in East Kowloon without any facilities provided.
