How the FEDS Got Gotti and Kept Him

The third time the Feds would take no chances. This time they HAD to have him.
The public humiliation of losing another
trial (the fourth in six years) would be
too much for the Justice Department.
The Media loved him. The people
admired him. BUT the FBI and Organized
Crime Task Force would make "Getting
Gotti" their number one priority.
With RICO in there corner,a jail shy Sammy
Gravano turned informer they would
take no chances. The following is
a breakdown of HOW the FBI and Justice Deparment were able to GET GOTTI
Presiding Judge Glasser waited until
eight weeks before the trial date to disqualify
Gotti's lawyers Bruce Cutler (who had helped
him win his 3 previous trials), Shargel, and
Pollok, from representing him, claiming they
were "house counsel" for the Gambino Crime
Family. Gotti was still in jail after
seven months.

The prosecution prevented Gotti from hiring his next choice of lawyer, James LaRossa (Castellano's lawyer) by subpoenaing him as a witness and then without explanation, never calling him to testify. It is widely held that Prosecutor Gleeson has refused to discuss the case with reporters he likely wanted to deny Gotti the tactical advantage of having the attorney for the murder victim representing the man accused of killing him.

They prevented LaRossa's law partner from questioning witnesses on behalf of Gotti's co-defendant Frank Locascio.

Glasser also issued a gag order, banning all "official" discussion of the case, and then he unsealed the Gotti tapes (which the government had leaked already) which soon were broadcast all over the country.

Judge Glasser also refused to allow the defense to reopen its cross examination of a key eyewitness to the Castellano/Bilotti killings. A witness who police has said was an embezzler and a liar.

For the most part practically none of the defense evidence was allowed to be presented

Two of the jurors were taken off the case for reasons which were sealed to the defense and to the public.

When the jurors did in fact ask to review certain things, points they were unsure about, they were not allowed this privilege.

Sammy Gravano served less than 5 years for admitting to commiting 19 murders. He entered witness protection when presented with the option of either spending the rest of his life in jail or being free to run a construction business outside of Phoenix, Arizona. Which would you choose? Phoenix can't be THAT bad.

The tapes were DEFINITELY taken out of context. Ridiculously taken out of context. In fact a piece of the tape which was underplayed carried the following:

"Whoever killed this cocksucker probably the cops killed this Paul, whoever killed him, the cocksucker, he deserved it"--- John GOTTI (speaking to Gravano and Locascio at the Ravenite Club)
And another taped conversation between Gotti, Shargel and Joe Corrao: "The shootout was in the paper today. I wasn't there. It must've been a ball.- John GOTTI

LOCKDOWN conditions Marion Penitentiary

On June 23, 1992, John Gotti was sentenced to life without the possibility of parole and delivered to Marion Penitentiary in Illinois, the toughest and most inhumane prison in the country. Nobody has ever stayed at Marion more than three years straight without getting transferred to another prison because it is so tough, twenty-three hours a day lockup. John Gotti's stay there had made it the longest stay ever at Marion, over 9 years.
