Unfortunately I receive all too many e-mails from families that are upset with their breeders regarding promises, guarantees and contracts or lack of any paperwork, (not even a receipt).  For all of you who  have needed  advice and guidance concerning your  rights as a buyer and how to enforce them I've decided to address this issue at your request..

To put it very bluntly........  The Attorney General’s Office of each state has state rules to protect consumers.  Some have laws specifically for the sale of puppies called “Puppy Lemon Laws”.   The law applies in the state where you purchased your puppy.  These rules safeguard buyers from being “screwed over” by questionable breeders.   Hopefully you have enough sense to have a contract, however the terms of your contract written by your breeder CANNOT cancel the laws in that state, even if you sign a contract.  A breeder can always give you more but not less than the laws allow.
Here are just 3 Examples from the state of "
Pennsylvania”

You sign a contract, the breeder gives you 48 hours to have your dog checked by a vet or she’s not responsible…etc. etc.…ANSWER   You are joking right?????… The State’s Attorney General’s office gives you 10 days.  A breeders contract CANNOT VOID THE LAW.

Your breeder informs you that under no circumstance will he give a refund or pay for any vet bills if you have a sick puppy.  ANSWER Again, you’re kidding me?? The State’s Attorney General’s office has strict rules for breeders responsibilities.  See individual States.  AGAIN…  A BREEDERS CONTRACT DOES NOT VOID THE LAW.

Your breeder for whatever reason doesn’t have the AKC papers and informs you she will mail them to you. Months later you still haven’t received them. . Guess what?? Either the breeder comes up with the papers within 120 days or you can return the dog receive a full refund or are entitled to a 50 percent refund.

If you are truly dealing with a respectable reputable breeder they will be following the guidelines for breeders suggested by their specific kennel clubs  ( AKC, CKC etc.)

When searching for that perfect dog to add to your family, your concerns should be with the breeder as well.  Don’t get lost in the “heat of the moment” seeing all the adorable puppies.  All puppies are cute, but you have to be able to walk away when any flag goes up concerning the breeder, surroundings and the breeder’s ethics.

Food for thought… Did you know it is Illegal in some state for the Breeder to “meet” you to deliver a puppy, Why would anybody settle for not seeing the breeders facilities and meeting the dam and sire as well as the entire litter???  That is definitely a big FLAG in my book.

As a perspective buyer you should expect at the very least:

Full physical access to the breeder and the dam and sire on the premises.

The puppy to be AT LEAST 8 weeks old (again, in some states this is the law, and breeding ethics also suggest 8-10 weeks of age).

Written Contract with specifics including sale price of the puppy and registration information.

A written Health Certificate from a certified Vet.

Proof of Vaccines.

Proof of Fecal checks and treatments.

Registration Papers or registration numbers of the dam and sire and Pedigree registry

Registration Papers are NOT to be given to the buyer BLANK!!!!!!!

Be committed to finding a responsible breeder.  You obviously have put a great deal of thought and research in what breed of dog is right for your family, why not find the perfect breeder as well??  You deserve a healthy puppy from day one.  Do your part to avoid any unnecessary heartache, emotional distress or a hefty financial lesson.  Pay attention to the “FLAGS” that these breeders fly so loud and clear.  It will pay off by having a positive experience worth remembering.
