EMPIE and Catherine Mary LEHMAN. Solomon died 10 Jul 1861 in Sharon, Schoharie Co., NY, USA, and was buried 13 Jul 1861 in Sharon, Schoharie Co., NY, USA.

BIRTH: Date of birth computed by Personal Ancestral File genealogy program from date of death on tombstone.

BURIAL: People's Cemetery, located on Route 10 near Beekman's Corners, T-Sharon, Schoharie Co., NY USA, per People's Cemetery records.

TOMBSTONE: Died July 10, 1861, Ae 51y 2m 19d.

NOTE: It was difficult to determine Solomon's parentage. After due deliberation and considering his age it was decided to place him in the family of Petrus E. Empie, 2nd child. (Barbara Empie Greene and Herman Witthoft think this is correct.)

(BEG - 1 June 1998) I think we should note the fact that "this Solomon could be the son of Solomon, now listed as a "probable son of Johannes and Anna Maria Kilts." Since the placement is very tenuous, however, for now we are leaving young Solomon, b 1810, in Peter's family - subject to further change.

431. John Peter7 EMPIE <See pg. 80> (Petrus6, Anna5, Johann4, Johann3, Johann2, Hanss1) was born 2 Jun 1813 in Sharon, Schoharie Co., NY, USA. He was the son of Petrus E. EMPIE and Catherine Mary LEHMAN. John died 29 Jun 1885 in Sharon, Schoharie Co., NY, USA, and was buried 1 Jul 1885 in Sharon, Schoharie Co., NY, USA.

NOTES for John:

REAL ESTATE: According to legal documents on file, John apparently leased his farm on May 10, 1882, with an option to buy to one Virgil Winne who brought a lawsuit against the executors after John died to insure transfer of title upon completion of payments under the contract. This document refers to his farm of 135 acres in the town of Seward, Schoharie Co., NY, occupied by Mr. Winne who wanted to complete the contract and receive the deed as of April 1, 1891. This document also says that "on or about the 25th day of June, 1885, the said John P. Empie departed this life leaving a last will and testament dated January 20, 1885." (Thomas W. Planck data) (The purchase price of the farm to Mr. Virgil Winnie was $7,000.)

Deeds are recorded in the County Clerk's office, Schoharie Co., NY. No Liberor Page reference is given: (Information is copied verbatim from TWP sheets.)

1. Warranty deed dated March 16, 1832 John Empie and wife Sophia sold 51 acres and 2 rods of land for $500 to Peter Empie town of Sharon in patent to Johannes Lawyer on Aug 14 1761 as lot No. 12. Instead of signature their X mark was certified by Wm Beekman for John and Sophia Empie who apparently could not write their names.

2. A warranty deed dated March 27 1849 in which Peter Empie sold 125 acres of land to son John P. Empie for $2,000 in lot No. 13 of the Lawyer patent and was subject to the support and maintenance of Simmion Empie son of Peter Empie. Peter signed with an X at the bottom with "his mark" written in.

3. A warranty deed dated April 4 1868 for the sale of 100 acres for $2,500 from John P. Empie to Wesley C. Planck. This land was known as the Adam Empie farm, the same farm and lands conveyed to John P Empie by John A Empie and wife on March 28 1865.

4. Warranty deed dated April 3, 1879 from John P. Empie & wife Marie to Wesley C. Planck for $2,800, 100 acres formerly known as the Adam Empie farm. It was signed by John P. Empie and Maria Empie with her mark of an X witnessed by Leuemma C. Planck (Mrs. Wesley C. Planck).

5. Warranty deed dated May 27 1876 from John P. and Marie Empie to Wesley C. Planck 10 acres for $450.

BURIAL: Slate Hill Cemetery, T-Sharon, Schoharie Co., NY USA.

TOMBSTONE: Died 29 June 1885, Ae 72 yrs.

WILL: Will admitted September 5,1895, to Surrogate Court, Schoharie Co., NY USA. (Copied with spelling and punctuation exactly as written.) "I John P Empie of the town of Sharon County of Schoharie and state of New York being of sound mind and memory, do make, ordain, publish and declare this to be my last will and testament that is to say - FIRST after all my lawful debts are paid discharged I hereby direct that at my decease there shall be erected at my grave a headstone as near like that of my deceased wife as may be. Also a stone for my deceased brother Simian (provided I shall not have procured one). Also at the decease of my present wife to erect at her grave a headstone all to be as near like the one referred to as may be. I hereby charge the property hereinafter bequeathed to my grandson John P Planck with the payment of said stones. SECOND To my beloved wife Marie Empie in lew of her dower I give devise and bequeath during her lifetime the use and occupancy of

the sitting room bedroom and clothes room the right and privilege of going through any part of the dwelling in which I now reside. Also I give devise and bequeath to my said wife and in lew of her dower the interest on one thousand dollars at 6 per cent per annum during her lifetime and all necessary clothing support of all kinds during her life both in sickness and in health according to her station in life the interest to be paid by my grandson John P. Planck and the support and maintenance to be by him furnished and at all times while my said wife remains with my grandson he is to furnish her with a horse and carriage whenever she may wish to use it. In the event of my said wife not remaining at the home of my grandson then and in that event and in lieu of her support therein before devised I give devise and bequeath to her the sum of fifty dollars yearly in addition to the interest on the one thousand dollars, the bequests herein made a charge upon the bequest thereafter made to my grandson John P Planck that is to the payment of my said wife. THIRD I give devise and bequeath to my daughter Catherine wife of George Voorhees during her lifetime the interest on the sums due on two contracts viz one with Virgil Winne dated 10 day of May 1882 and which there is now due the sum of fifty three hundred dollars. The other with Frank Eldridge dated Jan 16 1883 and on which there is now due nineteen hundred and fifty dollars and after her death I give devise and bequeath the entire sum to her children then living to be equally divided between them and to their heirs and assigns forever. FOURTH I give devise and bequeath to my daughter Almina Soden wife of Thomas Soden during her lifetime fifty acres of land now occupied by her being a part of the farm I purchased of Nathan Sees (?) and also the interest on five hundred dollars during her lifetime and after her death I give devise and bequeath said lands and the five hundred dollars to her two sons Seath A Mereness and Walter A Mereness share and share alike to them their heirs and assigns forever. However if either of said sons should die before arriving at the age of 21 years without issue the share of such deceased to pass to the survivor and if both die before arriving at the age of 21 years without issue then the same to be equally divided among my grandchildren then living to them their heirs and assigns forever. FIFTH To my grandson Sanford E. Planck his heirs and assigns forever I give devise and bequeath forty five acres of that farm I now live on being that portion of the farm I bought of Wesley C. Planck and lying opposite David Fritcher, Reserving the right of way over said lands where it now is to my grandson John P Planck and his heirs and assigns I also give devise and bequeath to my said grandson Sanford E. Planck, to his heirs and assigns forever the sum of one thousand dollars to be paid to him by my executors when he shall arrive at the age of eighteen years to be paid out of my residuary estate. SIXTH I give devise and bequeath to my grandson John P. Planck and to his heirs and assigns forever the old farm on which I now reside being about one hundred and twenty five acres of land more or less reserving the right of way over said lands to my grandson Sanford E Planck and his heirs and assigns together with all the farming utensils and stock on said farm or which may belong to me at my decease SEVENTH I give devise and bequeath to my daughter Catherine wife of Geo Voorhees and to my grandson John P Planck their heirs and assigns all my household furniture to be equally divided between them EIGHTH The rest residue and remainder of my estate I give and bequeath to my two granddaughters Anna E Sturnburg wife of Howard Sturnburg and Ida May Voorhees daughter of Geo Voorhees to them their heirs and assigns forever share and share alike" (This will was copied verbatim from the copy supplied me by Thomas W. BENJAMIN EMPIE

An honored and an aged resident of the Sharon Road, Town of Seward, departed this life Oct. 7, ripe in years and generally honored and respected.

The funeral services were held in the Gardnersville Lutheran church, Rev. Weaver officiating. (Pastor A. H. Weaver was Pastor, 1897-1901.) Deceased, who was 91 years of age, is survived by four children--Mary Frederick, his wife, having departed eleven years ago--Charlotte, relict of Peter H. Frederick, late of Middleburgh, deceased; Reuben L. Empie of Seward, Peter L. Empie of the State of Maryland, and Squire George Empie of the old homestead.

Benj. Empie was a worthy descendant of sturdy stock. His father, Adam Empie, who with his brothers John, Peter and Solomon, came from Stone Arabia and purchased a large tract of land in the town of Sharon. Adam, by precept and example, showed his son Benjamin the proper way to go, and the lessons were not unheeded nor unimproved. Soon after marriage, and in the year 1846, deceased purchased the Major Bellinger place and proceeded to establish a home. There his children were born, and there he demonstrated good citizenship and good farming; there he lived, and there he closed his eyes forever on the scenes of earth. He was a man of vigorous intellect, and with this went an honesty of purpose and a fairness of dealing which brought to him the confidence and respect of all people. He was a member of the Lutheran church, in which, in his early years, he held office acceptably. He was considerate of the need and rights of others. No person ahunger was turned from his door empty handed. In politics he was a Democrat, staunch and true. He held political town offices, but he cared not about politics for this purpose. He believed in the principle of Democracy, and fearlessly and ably represented the same.

But few of the companions of youth are left to drop a tear over the departure of the aged, but relatives and friends know of his worth and his virtues, and the record was long ago made by his works--an honest man has departed.

He married Maria FREDERICKS about 1834 in NY, USA. She was born 6 Dec 1812 in Seward, Schoharie Co., NY, USA, and was christened 3 Jan 1813 in Sharon, Schoharie Co., NY, USA. She was the daughter of Peter H. FREDERICK and Nelge (Cornelia) LOUCKS. Maria died 4 Mar 1889 in Seward, Schoharie Co., NY, USA, and was buried 7 Mar 1889 in Sharon, Schoharie Co., NY, USA.

There are also small footstones with the inscriptions: "Mother", "Father", "Avis M.", "Jacob", "Vina", and "Aurie J.". Also, there is another very old looking tombstone which reads (I think): "A. Vergil, son of Wm. & J.A. Kilts, died Sept. 2, 1861, aged 9 years 7 mos & 7 ds".

Miss Carrie Kilts whose school teacher influence over two generations of St. Johnsville natives is legend, was 90 years young Monday of this week. Miss Kilts is a descendant of the Timmerman branch of the Snell-Zimmerman-Timmerman family and was born in Snells Bush in 1872. She taught 38 years and four months, 31 of those years in St. Johnsville. Miss Kilts' mother was one of seven sisters and she herself was an only child.

Born in Manheim, Oct. 8, 1872, the daughter of Jordan and Maria Timmerman Kilts, she was a school teacher for many years until her retirement several years ago. She was a member of St. John's Reformed Church, St. Johnsville.
She is survived by several cousins. Funeral services will be Monday at 2 p.m. at the Lull Funeral Home, St. Johnsville, with the Rev. Robert Geddes, St. John's pastor, officiating. Burial will be in St. Johnsville Cemetery.
