INSTALLMENT PURCHASE AND SECURITY AGREEMENT
WITHOUT WARRANTIES

2. HORSE(S) PURCHASED: The Seller hereby agrees to sell and the Buyer hereby agrees to buy, upon the terms and conditions set forth, the following described horse(s), hereinafter referred to as “the horse(s).”

3. PURCHASE PRICE: The total purchase price shall be __________, payable according to the following terms:
TERMS (one or more may be selected according to the Owner and Agreement reached by purchasing party)
* Purchaser to put half down with the return of this signed contract and the remainder due when foal(s)/horse(s) is/are picked up.
* Purchaser to put $_____ down and make consecutive payments due on the same date each month or twice per month, with final payment due when horse is picked up including all cost of maintenance and upkeep.
* Purchaser will cover feed/farrier/water/mineral and any shots that are due after contract is signed and until horse is picked up. Seller will keep/hold horse one week before starting itemized statement.
* Once purchaser signs contract, horse becomes responsibility of purchaser, insurance on horse is dropped by seller and should be picked up by buyer.
* Seller will maintain horse in same condition/pasture with diligent care for horse, as all other horses are treated until purchased horse is picked up. Feed (pasture, grain & hay), mineral and water cost generally run $3.70 per day. Farrier cost is $25 every eight weeks, shots vary with type and if transportation to veterinary clinic or farm call is necessitated.
* Note: Horses maintained in a herd environment with free roaming on pastures do acquire cuts, scrapes, kicks, kick marks, bite marks, ticks and other parasites, snake bites and other injuries as associated with daily activity in pasture and herd conditions. Sellers horses are maintained in herd environment and pastured with few injuries. Weanling foals do not run with yearlings or older horses, unless being maintained with mares in mare pasture. Yearlings do not run with foals or older horses unless they have been raised and kept in same pasture. Geldings are generally not run with mares and foals or horses under two years of age. Stallion is maintained with mares and offspring. Stallion and geldings are not pastured together. Weanlings and yearlings may or may not be halter broke at time of departure.
* Purchaser to put half down with the return of this signed contract and the remainder due in Monthly installments. Monthly payments of $____ are due by the fifteenth (15) day of each consecutive month until payoff.
* Foal may be picked up one week after foal is weaned. Weaning will be done when the foal is 3 ½ to 4 ½ months of age depending on condition of the mare. If buyer decides to wean foal at their facility then seller needs to be informed. Weaning is a critical time and this is when most injuries occur. Seller must have a safe secure environment to wean foal. Foal may or may not be halter broke at time of departure.
* If foal suffers any major incidents such as: death, bone breakage, torn tendons, buyer will be notified. If buyer decides not to continue with purchase of foal, then all monies shall be refunded. This does not include snake bites, lacerations/sutures, mars or marks, abrasions, skin scrapes as associated with daily activity of foals in pasture or weaning.

UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), AN EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES.
