TRAINING CONTRACT

WITNESS THIS AGREEMENT this  ___________ day of _____________, 20______, by and between ______________________________,  hereinafter referred to as “Trainer,” and ____________________________________, hereinafter referred to as “Owner.”  Trainer agrees to accept Owner’s horse ______________________________, Reg. No. _______________, Association _____________for training, and it is the plan and intention of the Owner to place this horse into training.  It is understood and agreed that the events or purpose for which the horse as above-described is accepted for training are as follows:
*_____  Halter breaking foals less than 12 months of age includes: leading from both sides, giving to pressure, picking up feet, loading, desensitizing of legs, barrel, head, ears, rump and belly.  Time required is generally three to seven (3-7) days the fee is.......
*_____  Halter breaking yearlings to adults 12 months and up includes:  leading from near side and off side, trailer loading, desensitizing head, ears, neck, poll and bending/giving topressure.  Depending on the nature of the horse picking up feet for trimming may be extra.  Time generally required one (1) week this fee...
*_____ Loading into a trailer.  This includes proper loading into and backing out of a 2 horse front load and a stock trailer.  Fee $100 if horse is properly halter broke with ground manners.
*_____ Starting under saddle a one (1) day program is $250.  Horse must know the basics: ground work (halter, picking up feet, leading and desensitizing of body enough to be handled).  Trainer will teach horse to give head, take a bit and be saddled and follow basic cues under a walk in the saddle.
*_____ Starting colts under saddle includes round pen work and 30-45 hours (varies with weather conditions and time of year) of riding time for 30 days.  Horse will be started and kept in a full cheek snaffle bit and will be trained to give to the bit on the pressure release system
*_____ Continued training applies to horses already started by trainer, 30-90 days will include, giving to the bit, side passing, neck reining (still not refined), trail riding and starting on a particular event of the owners choice:   (  ) barrels, (  ) poles, (  ) reining, (  ) trails, (  ) exposure to cattle, (  ) endurance.  Fee .....

Other training per owners request: ___________________________________________________________________________

1.  Fees, Term, and Location.  Owner shall pay the Trainer for professional services and board as described below, the training fee of $ _________ per month or $ _________ per day, for training.  Training and board being $ __________ per month or $ _______ per day, for a minimum of __________ months.  Board alone being $ __________ per month or $ _______ per day, for a minimum of __________ months.  Current fees for Board (feed/hay/pasture/turnout/minerals) $5.50 per day, if owner supplies feed and hay then Board cost is $3.50 per day, if owner supplies feed only the fee is $2.50 per day plus cost of hay bales.........

2.  Payment of Invoices.  Invoices are payable upon receipt.  Upon completion of this agreement, the remainder of any and all expenses shall be due and payable immediately and the animal will not be released from Trainer’s possession until all expenses are paid in full.  In the event payment is overdue by fifteen (15) days.......

3.  Veterinarian, Shoeing and Related Services.  Trainer assumes responsibility for arranging veterinarian and farrier services as necessary.  Trainer will use a veterinarian and farrier of his choice to provide ordinary and necessary care unless Owner has requested Owner’s veterinarian and farrier be used.  However, if they are unavailable, Trainer will engage his choice.  All veterinarian, farrier and medicine expenses shall be paid by Owner, as further described herein...........

WARNING
UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), AN EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTIN FROM THE INHERENT RISKS OF EQUINE ACTIVITIES.

10.  Hold Harmless.  Owner agrees to hold Trainer harmless from any and all claims arising from damage or injury caused by said horse(s) to anyone, and defend Trainer from any such claims. ....

11.  Emergency Care.  Trainer agrees to attempt to contact Owner should Trainer determine veterinary treatment is needed for said horse(s), but, if trainer is unable to contact Owner, Trainer is then authorized to secure emergency veterinary, and farrier care required for the health and well-being of said horse(s)......
