Company E seems to have suffered heavily in desertion. Nearly half of its members were substitutes. Its officers also were notorious for creating discontent within the regiment. Captain Alfriend was perhaps the last officer in the Army of Northern Virginia to be court-martialed. Captain McConnell repeatedly tendered his resignation whenever he disagreed with his superiors. Company E withdrew en masse after the Seven Day's Battles and joined the 19th Battalion Va Heavy Artillery. They were, however, ordered to return to the 44th in late February of 1863.
