WILL OF PHILLIP DAYHUFF (1842) |
In the name of God Amen: I Phillip Dayhuff of Harrison Township and County of Carroll and State of Ohio, being of sound mind and memory but advanced in years and concious of the uncertainty of life do make and publish this my last will and testament. Item first: It is my will that my funeral expenses and all my just debts be fully paid by my executors herein after named, as after my decease may be convenient. Second: I give and bequeath to my beloved wife, Elizabeth Dayhuff in lieu of her dower, one bed and bedding and one cow and also the one fifth part of the farm in said Township known as the Ephart (Ebbert?) Farm containing one hundred and fifty seven acres now in the occupancy of David and Bazle Dayhuff. Third: I give divise and bequeath to my four sons the three eldest, John Dayhuff, Abraham Dayuhuff, David Dayhuff and fifth son, Bazle Dayhuff, the remaining four fifths of the above described farm and I hereby direct that my executors so soon after my decease as practicable shall make public sale of said farm having previously advertized the same in some newspapers for at least six weeks and the money owing from said sale be paid over to my wife and sons above named, share and share alike. Fourth: I give and devise to my son Henry Dayhuff and to his heirs and assignes forever the farm on which I now reside in said Township, containing one hundred and seventy acres and I also hereby acknowledge to receipt in full from the said Henry Dayhuff of the money due on a certain note of hand given by said Henry payable to me and dated as as can be recollected September Eighth, AD one thousand Eight hundred and thirty two given for the sum of Eight Dollars, which said note of hand has been lost or mislaid. Fifth: I give and bequeath to m y youngest son Upton Dayhuff the sum of Two Hundred and seventy five Dollars out of my Estate of which said sum, the said Upton already received seventy five Dollars the price of a gray mare, got from me by him. Sixth: I give and devise to my daughter Hannah Dayhuff the sum of (??) hundred Dollars. Seventh: It is my will htat all the personal estate that I due possessed, be appraised and sold and the proceeds thereof after my funeral expenses, just debts have been first paid shall be applied to the payment of the sum of money herein before bequeathed to my son Upton and to my daughter Hannah, and the sum so bequeated the said Upton shall be paid to him by my Executor within Eighteen months after my decease and the said Hannah shall be paid within two years after my decease. Eight: If the proceeds of my Personal estate shall be more than sufficient to pay my funeral expenses and just debts cost of Administration and the sum of money herein before bequeathed to said Hannah and the said Upton the surplus shall be paid over to my son Henry Dayhuff. But if the proceeds of said Personal Estate shall not be sufficient to pay said funeral expenses just debts cost of Administration and said sums bequeathed to the said Upton and Hannah then my son Henry shall make up such insufficiency by sale of my Real Estate herein before bequeathed to him or by the use of his own property so that the said Upton and Hannah shall not receive less than two hundred Dollars each. Nineth: It is my wish and I hereby to my wife the use and right to occupy the dwelling house in which I now reside so long after my decease as she all remain unmarried, and no longer. Ten: I do hereby constitute and appoint my friend John S. Lren and myh son Henry Dayhuff Executors of this my last Will and Testament hereby revoking and annulling all former Wills by me made and satisfying and confirming this my only true last Will and Testament. In testimony where of I have hereunto set my hand and seal this ninth day of April A.D. One Thousand Eight hundred and Forty Two. Phillip Dayhuff Signed sealed published and declared for the said Phillip Dayhuff as his last will and testament in prescence of us who subscribed the same as witnesses in his presence and at his request.
