Subject: Requesting further assistance
Dear Dr Kohli and members of Grievances Committee;
First of all, let me thank the grievances committee from the bottom of my heart for
sending a letter to my past employer in my support. The letter was sent in the third week
of May 2001. As suggested in the reply received three weeks after from Dr Martin Gizzi, my
past program director and chair, the matter was forwarded to the affiliated University.
I have my reservations in communicating further with the University as described in my
letter to the hospital CEO, a copy of which has been forwarded to EGC. The matter is no
longer purely academic as depicted below in a brief summary of my case for the new members
of the Ethics and Grievances Committee. I am fully aware of the fact that some of these
details below are inconceivable and I have sufficient evidences to support each and every
matter.
Brief Summary:
- I joined New Jersey Neuroscience Institute, JFK Medical Center, Edison, NJ as Neurology
Chief Resident in July 1997. From the first week I noticed differential treatment,
discrimination and hostile work conditions. I worked hard ignoring these factors so as to
complete my residency and received superior evaluations and reference.
- In March 1998, I was placed on probation on manufactured grounds and was not allowed
grievance procedure.
- Probation Extended for another month in April 1998 despite satisfactory evaluation.
- I was terminated on May 5 1998, one week after receiving a national scholarship from
American Academy of Neurology. I was not allowed grievances mandated by my signed
residency contract prior to termination.
- On 23rd May 1998, I recorded a break in my apartment in my absence on an
audiotape, clearly suggesting surveillance purpose on the recording.
- In first week of July 1998, my results of USMLE step 3 were intercepted in the mail
(from my P O Box) and replaced by a fraudulent result suggesting I failed.
- Multiple invasions of my privacy in different forms have occurred since then. I have ran
in to infinite roadblocks in my pursuit of justice as well and have not been able to find
an attorney over the past three years despite constant efforts. Despite the depleted
resources in the absence of my medical license, under normal circumstances, similar case
would easily attract an attorney on contingency base.
Despite the circumstances, I will continue to look for an attorney and pursue justice.
Making a resolution with the hospital could bring a speedy end to the ongoing anguish of
my family and possibly salvage my Neurology career. As stated above, there are multiple
civil rights violations after termination that could only be negotiated with the hospital
and not the University.
Due to my limitations, I am requesting further assistance from AAPI in the form of:
- Sending another strongly worded letter to the Program Director / Hospital for directly
negotiating the matter.
- Simultaneously providing me a general support letter that could help in finding an
attorney / law firm. The letter could mention furnishing Amicus Brief and
Amicus Note if needed in future.
- Reporting the program to ACGME and AMA for discriminatory act if not responded to the
second letter.
- If still unable to find an attorney, a legal defense aid / loan that could be used as a
retainer.
