NOTECARD #1
Magazine
Cassell, Paul. "In defense of the death
penalty." Prosecutor, Journal of the National District Attorneys
Association 42.4 (Oct-Dec
2008): 10(14). LegalTrac. Gale.
“In contrast, those opposed to capital punishment have a surety that we find surprising. Abolitionists are certain that the death penalty does not deter--indeed, that it has not ever deterred anyone, anywhere, at any time. They are certain that it has never incapacitated anyone and prevented a subsequent killing. Finally, they are certain that it is not just punishment, despite the contrary views of the majority of the fellow citizens in this country (and in many others).”

NOTECARD #2
Magazine
Bradley, Craig M. "Court upholds lethal
injections." Trial 44.6 (June
2008): 58(3). LegalTrac. Gale.
“To no one's surprise, the Supreme Court--in Baze v. Rees--recently upheld lethal injection as a method of inflicting the death penalty. (1) Chief Justice John Roberts noted in the plurality opinion that if capital punishment is constitutional--which has already been settled--then:
It necessarily follows that there
must be a means of carrying it out.
Some risk of pain is inherent in
any method of execution--no
matter how humane--if only
from the prospect of error in following
the required procedure. It
is clear, then, that the Constitution
does not demand the avoidance
of all risk of pain in carrying
out executions. (2)”
