In ye name of God amen the 16th day of January 1703/4 in ye Second yeare of ye Reigne of Our soveraine Queene Ann of England Etc., I ANDREW SMITH of ye Township of Hopewell in ye County of Burlington in New Jersey alias Nova Ceserea, Yeoman, being sick and weake of body but of sound and perfect memory and remembrance, thanks be to almighty God for the same, calling to mind the uncertaine Estate of this transitory life and that all flesh must yield unto death whensoever it shall please God to Call and being desirous to settle things in order doe make this my Last Will and testament, wherein is contained my Last Will and Testament in manner and forme following Revoking and absolutely unwilling by these presents all and every testament and testaments will and wills heretofore by me made and declared either by word or writing notwithstanding any promise to the contrary or clause derogatory in ye same and this to be taken only for my Last Will and Testament and no other. And touching such temporal Estate of Land Goods Chattles and Debts as doe belong unto me I doe order give and bequeath and dispose the same in manner and forme following.
First, I doe give and bequeath unto my son ANDREW SMITH the whole plantation I now dwell upon and also one half of ye moveable(?) Goods and Chattles personall within ye house and without I doe give to my son Andrew and to his heirs for Ever.
Also, I doe give to JOHN FIDLER now servant with JOHN PARKE twenty shillings.
Also, I doe give and bequeath to my daughter ELIZABETH SMITH thirty pounds in silver money.
Also, I doe give to my daughter MARY wife of WILLIAM SCOOLEY twenty pound in silver money Lastly the other halfe of my personal goods and Chattles within the house and without as also the Remainer of all sum and summs of money to me due or that are to become due.
I doe give and bequeath unto my Three Daughters SARAH, wife of JOHN PARKE, and ELIZABETH SMITH, and MARY, wife of WILLIAM SCOOLEY, to be equally divided amongst them and I doe hereby nominate and appoint my onely(?) Son THOMAS SMITH and my Daughter ELIZABETH SMITH Executors of this my Last Will and testament in Witness whereof I have hereunto set my hand and seale the day above written.

Then appeared before me THOMAS ROWELL Esq. Surrogate in and for the province of New Jersey, JOSHUA WOOD and CALEB WHEATLEY two of the witnesses to ye within written will and having been duly sworn and attested upon the holy Evangelist doe declare that they saw the testator ANDREW SMITH sign, seal, and publish the within written Instrument to be his Last Will and testament and that at the time of his publication he was of Sound and perfect understanding to ye best of these deponents knowledge and that at ye same time saw WILLIAM HIXON the other witness signe the same.
March ye Seventh 1703.

To all to whome these presents come or may come, Greetings - Know yee that at Burlington in ye province aforesaid the seventh day of March ye Last will and [testament] of ANDREW SMITH was proved, approved, and allowed of by me having whilst he lived and at ye time of his Death Goods, Chattles, and Credits in divers places within this province by meanes Where of the full disposition of all and singular ye Goods, Chattles, and Credits and the Granting the administration of them Also the hearing of accounts(?) calculation or Reckoning and the final discharge and definition of ye same unto me solely and not unto any other Inferior Judge are manifestly known to belong and ye admision of all and singular the Goods Chattles and Credits of the said deceased ANDREW SMITH and his said last will and Testament in any manner of ways concerning is Granted unto THOMAS SMITH and ELIZABETH SMITH Executors of ye said Last Will and Testament of the said ANDREW SMITH named cheifily? of Well and duely administering ye same and of making a true and perfect Inventory of all and singular the said Goods Chattles and Credits and Exhibiting the same into ye Secretaries Office of ye said province at or before the first day of April next ensuing and of Rendering a Just and true account Calculation or Reckoning (When however he shall be Lawfully Required). In Testimony whereof ye THOMAS ROUELL Esq. Surrogate Commissioned and appointed by ye said Lord Cornbury have hereunto set my hand and seale this Eighth day of March 1703/4.
