Proven April 24, 1767

In the Name of God Amen, I ANDREW SMITH of the township of Hopewell in the County of Hunterdon and Western Division of the Province of New Jersey, Yeoman, being well stricken in years but of perfect mind and memory thanks be to God there for and calling to mind the certainty of Death as Knowing its appointed for all men once to Die Do make and ordain this my Last Will and Testament and as touching such worldly Estates as it hath pleased God to Bless me with in this life, I Give and Devise the same in the following manner -

Imprimis, It is my will that my remains be Decently buried and all my Just Debts and funeral Charges be paid by my Executor Hereafter Named.

Item, I give and Bequeath to my Eldest son ANDREW SMITH five Pounds for his Birth Right to be paid to him in sum Convenient time after my Decease by my Executor hereafter Named.

Item, I Give and Bequeath to my son JONATHAN SMITH five Pounds to be paid to him in sum convenient time after my Decease by my Executor hereafter Named.

Item, I Give and Bequeath to my son GEORGE SMITH five Pounds to be paid to him in sum convenient time after my Decease by my Executor hereafter Named.

Item, I Give and Bequeath to my Daughter ANN TITUS five Pounds to be paid to her in sum convenient time after my Decease by my Executor hereafter Named.

Item, I Give and Devise to my grandson JONATHAN SMITH the following peace of Land (Whereon his father CHARLES SMITH lived), Beginning at a small hickory that is my son JONATHAN SMITH's corner standing in _________, thence Eastwardly part by said Price and Part by Thomas Fidler's land to said Fidler's tied Whiteoak corner standing before his Door(?), thence South twenty five Degrees West Eighteen chains and fifty Eight links to a post, thence to ____ with a Direct line to a White Oak tree standing on a point of land between two small Runs of Water that comes out of James Larows land standing also in James Larowes line, thence Westerly East (?) by said Larowes land and part by John Cornel's land to my son JONATHAN SMITH's corner stone in said Cornel's line, thence North by said JONATHAN SMITH's line to the Place of Beginning and containing by estimation Sixty acres be the same more or less to him his Heirs and assigns forever to be enjoyed by him When he comes to the age of twenty one years together with a Legacy of twenty Pounds, but if it should happen that my said Grandson should Dye before he arrives of age as aforesaid, then it is my Will that my Grandaughter RACHEL NORTH should Possess the Sixty acres of Land as aforesaid together with his Legacy to her and her heirs and assigns forever.

Item, I Give and Bequeath to my Grandaughter RACHEL NORTH twenty Pounds to be paid to her at a Convenient time after my Decease by my Executor hereafter Named.

Item, I Give and Devise unto my son TIMOTHY SMITH all the Remainder Part of my Lands and appurtenances thereof with all the Improvements together with all my whole Residue(?) moveable Estate to be Enjoyed by him his heirs and assigns forever.

Item, And lastly I do Nominate, constitute, and appoint my sd. son TIMOTHY SMITH Sole Executor to this my last Will and Testament hereby utterly Revoking, Disannuling, and Disallowing all former and Every other Wills, testaments, Bequeaths, Legacies, and Executors by me at any time heretofore made. Ratifying this and no other to be my last Will and testament. In Witness whereof I have hereunto Set my hand and Seal this Second Day of November in the year of our Lord one thousand Seven hundred and Sixty three.

FELIX LOTT and JOHN CORWINE two of the witnesses to the foregoing will being Duly Sworn on the holy Evangelist of Almighty God Did Severally Depose that they saw ANDREW SMITH the Testator in the foregoing will Named Sign and Seal the Same and heard him Publish, Pronounce, and Declare the foregoing Instrument to be his Last Will and Testament and that at the Doing thereof the said Testator was of Sound and Disposing mind and memory as far as the Deponants Know and as they veryly believe and that THOMAS WILLSON the other Subscribing Witness was Present and Signed his Name as Witness to ye said Will together with these Deponents in the presence of the said Testator.

TIMOTHY SMITH Sole Executor in the foregoing Testament Named being Duly Sworn Did Depose that the foregoing Instrument Contains the True Last will and Testament of ANDREW SMITH the Testator therein Named so far as he Knows and as he veryly believes and that he will well and Truly perform the same by paying first the Debts of the said Deceased and then the Legacys in the said Testament Specified so far forth as the goods, Chattles, and Credits of the said Deceased Can thereunto Extend and Render a Just and true Account when thereunto Lawfully Required.
