Canadian Bottle and Stoneware Collector – Auction No 18-21 – Terms of Sale

 

1.         Absentee Auction: The items in this catalogue will be sold at absentee auction. Closing date for the current auctions will be: Auction 18 – Saturday October 14th, 2006, 10:00 PM; Auction 19 – TBD, October 2006; Auction 20 – TBD, January 2007; Auction 21; TBD, January 2007.

2.         Descriptions: We have made every attempt to describe correctly the property being sold. Descriptions are guaranteed to be accurate as regards authenticity, age, condition and measurement to within ¼ inch, as represented in this catalogue. In describing damage, exterior wear or manufacturer’s flaws that, in our opinion, do not significantly detract visually or monetarily from the value of the item are not listed and will not be considered for refund. Please note that we are known for being VERY exacting in our descriptions. One of the best values we can give you is our independent trained eyes. With over 10,000 bottles sold, we have only had three requests for refunds – all of which we have given, without question.

3.         Bidding: Bidding may be done by mail, phone or email. Your bid, oral, written or electronic, grants us permission to protect you up to the amount of your stated bid. You may telephone or email at any time during the auction, prior to the closing date, to check the status of your bids, to find the current high bids, to open a bid or to raise a bid on an auction lot. The current bid is determined by taking the second highest bid and increasing it by one bidding increment. Increments are as follows:

up to $100         Increments of $5                       $100-$250         Increments of $10

$250-500           Increments of $25                     $500+               Increments of $50

An example: you bid $250 on a lot which is the highest bid received to date. The second-highest bid is $120. The current bid would be yours for $130. Any other bids submitted by others below $250 will be automatically topped by us, bidding on your behalf. In the event of tie bids, the earliest bid received will be the winning bid. We will NEVER disclose bids pledged by others; only the current high bid of a lot will be stated upon request. The highest bidder shall prevail. Is it the sole right of the auctioneer to settle any dispute between bidders and to regulate the bidding procedure. The auctioneer reserves the right to refuse any bid he believes not have been made in good faith. Each lot in the sale has a minimum bid, as well as an estimated sale range, based on past and current values as an intended guide to bidding. Bids may be made by phone, daily until closing day, from 6PM to 10PM Eastern Time. If you call at any time and get the answering machine, you can leave the lot number and your bid on the answering machine, but you should call back to verify your bid, as we place NO GUARANTEES on the answering machine. Incoming phone and email bids will be accepted on closing day until 10PM Eastern. No calls after this time will be answered. The mail is not prompt – we urge you to send your mail bids as soon as possible.

4.         Return call or “Call back” process: If requested, the top three bidders will be given a “call back” in order to resolve the final sale of a lot. You can request this service by mentioning so in your letter or email to us or by verbal agreement on the phone. Please indicate the telephone number where you can be reached between 6 and 10 PM Eastern. Only the three highest bidders at sale closing are entitled to call backs, and only if their final bid was $250 or higher. It is the responsibility of the bidder to ensure he is qualified for this service. The bidder will forfeit his rights to a “call back” if the auctioneer is unable to reach him.

No “call backs” for bids placed that are under $250.

5.         Successful bidders: Successful bidders will be notified by mail or email. Payment is due IMMEDIATELY on receipt of notification of purchase. If you are an Ontario resident, 8% PST will be added to your bill, unless you provide us with a tax exemption permit. Purchases will be shipped only after full payment has been received. Items will be shipped via Canada Post. Shipping, handling and insurance are extra.

6.         Refunds: Refunds will be given at the discretion of the auctioneer. Items purchased must be examined and request for refund made immediately upon receipt of the item. Since opinions can differ, particularly in the matter of condition, the auctioneer will be the sole judge in consideration of refunds. Refunds requested on the grounds of authenticity must be made within 15 days of the date of auction, and such refund requests must be accompanied by at least one supporting statement in writing from an authority recognized by the auctioneer. Absolutely no returns after one month after the auction closing date. It is the auctioneer’s sincere intention to consider any reasonable request for a refund.

7.         Reserves: Certain lots in this auction may be subject to a reasonable reserve agreed upon between the consignor and CB and SC. The reserve is confidential and will be executed by a representative of CB and SC.

8.         Buyer’s Commission: There will be a 12% buyer’s commission applied to the purchase price (before taxes and shipping) of each lot in this auction.

9.         Bidding on an item indicates your acceptance of these terms.
