Brett
Cook actually had his head caved in within 15 minutes of being released
into the population at the facility that he was transferred to - which is
best known for its Aryan gangs and to where the Warden and Major at his
previous facility threatened to transfer him if he persisted in
complaining about Jewish programs being canceled. There’s no doubt in
anyone’s mind that the Major was in collusion with the perpetrators, but
proving it is another thing.
The following is the report made by
TX into the activities leading up to and following the murder of Brett
Cook.

42USC 1983/Retaliation for Exercise of Religion - Plaintiffs
were inmates at the Wallace Pack Unit in Navasota, Texas. Wayne Scott is
the Executive Director of the Department of Criminal Justice, Jerry Groom
the head of the Chaplaincy Department , Douglas Drelke was the Warden as
Wallace Pack, and Earl Fox was the Building Major at Wallace Pack.
Plaintiffs, all Jewish, claimed they were not allowed to have
Kosher food, wear a Star of David, etc. On 1-10-95 they filed a pro se
suit seeking to practice their religion freely. Beginning shortly after
filing suit, plaintiffs alleged they were retaliated against.
Reynaldo Lopez, who typed the lawsuit, had the same typewriter
confiscated within days of the suit being filed and was thrown into
solitary confinement. Before the lawsuit, he had worked as a teacher’s
aide but was sent to the hoe-squad after the suit was filed.
Reynaldo Lopez and Ramon Solanas , before the lawsuit, had each
resided in two or three different cells. After the lawsuit, they were
shuffled around over 13 times in the same period of time.
Ramon
Solanas had no major disciplinary cases before the lawsuit. Within the few
months after the lawsuit was filed, he was written up four times; each
case was graded as “major” by Earl Fox. The offenses included such things
as having jalapenos without permission. As a result Solanas’ release date
was pushed forward over a year.
In April of 1995, plaintiffs were
given lay-in passes for Passover. Earl Fox called the inmates together,
told them they would nevertheless have to work, and made anti-Semitic
remarks. Brett Cook, one of the Jews at the meeting and a plaintiff in the
1-10-95 lawsuit, questioned Fox’s authority to cancel the passes. He was
shortly transferred to Amarillo where he suffered a mortal blow to the
head the day he arrived. The coroner’s report was entered into evidence.
Carl Davis was allegedly told by Fox that if Fox’s name appeared
on any lawsuit, Davis would be shipped off to a “hard farm”. The day after
the retaliation suit was filed, (6/95), Davis was transferred.
Phillip Ray Robinson complained of anti-Semitic remarks by Fox. In
addition, Robinson went to his bunk shortly after Brett Cook had been
killed and found a magazine opened up to a picture of a swastika and a
gun. The subscription indicated it was Earl Fox’s. He also found a
religious tract on his bunk which said “The Time is Coming!” The magazine,
(with subscription label), was entered into evidence. Defendants argued
Robinson stole it from the trash.

Michael
Cain was dismissed from the lawsuit.
All claims against Jerry
Groom and Wayne Scott were dismissed.
Jury found Robert White did
not prove his case.
After three days of trial, the jury found

$13,602 Total Award
Settled past judgement for $34,102 without judgment being entered.
Ramon Solanas’ disciplinary actions are to be expunged from his
record and he is to be released from prison.
