    In the matter of application for pension of the minors of
Isaac Miller of Co. A Osage Co. Mo, Home Guards-No 533.459

On this 10th day of September, A.D. 1903, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths,
Samuel Miller aged 45 years, a resident in the County of Pulaski and the State of Missouri whose Post-office address is Richmond, MO., is well known to me, to be reputable and entitled to credit and who, being duly sworn, declares, in relationship to the aforesaid case as follows:

He has not been able to get the evidence required for the reason that the captain of his(Isaac Miller's) company has been dead for a number of years; and he has no knowledge of the whereabouts of either of the Lieutenants. Alliant says that he was too young at the time to remember anything about it, he has heard his mother say that when the soldier (his father) came home that he was suffering from his lungs; there was no Surgeon or Doctor with the command from whom he could get evidence of his condition, but he sent the evidence of a Dr. Hafforth a citizen doctor of Osage County showing that his lungs was in bad shape. He went to the Mulanphy Hospital in St. Louis in 1863, where he died on or about the 2 day of November, 1863. Affiant says that he has used all dilefence (defense?), and used every means at his command to get the evidence required but has been unable to do so.

He further declares that he has interest in said case and is concerned in it's prosecution.

On the 29th day of September, A,D. 1892, personally appeared before me, a Justice of the Peace in and for the aforesaid County, duly authorized to administer oaths, Nick. Wolf, aged 58 years, a resident of Boeger's Store, P.O. in the County of Osage and the State of Missouri whose postoffice address is Boeger's Store P.O., Osage Co., MO, and Bridget Wolf aged 54 years, a resident of Boeger's Store P.O. in the County of Osage and the State of Missouri whose postoffice address is Boeger's Store, P.O., well known to me to be reputable and entitled to credit and who being duly sworn declares each for himself in relation to aforesaid case as follows:

We the undersigned witnesses know Isaac Miller was married to Miss Elizabeth Wolf on or about July the 19th, 1847 and we further know that she died about March 1852-and we also know that the said Isaac Miller was married to Miss Mary Wolf on or about the 11th day of April 1854 and we further know that the said Mary Wolf was never married previous to her marriage to Isaac Miller......

and we further declare that we have no interest in said case and are not concerned in it's prosecution.

In the above citied claim, the testimony as to the continuance of soldiers alleged disability, and cause of death is not sufficient. Was the medical treatment at anytime subsequent to discharge other than that given by Drs. Hoffarth and Johnson. If so, the physician who waited upon him should be called upon for a statement of what that treatment was. It appears that the soldier was taken ill while at the Pacific Hotel in St. Louis, was removed to Mullanphy Hospital and died there several days afterwards. The testimony of the hotel-keeper or others stopping then at the time would be filed, showing whether the soldier had any medical treatment while there, and by whom, and the nature of his illness. The presumption is that he was treated while in the hospital and that a thorough search of the records then will discover the cause of death.

    The testimony of Nicholas Wolf as to dates of birth is not satisfactory for the reason that he fails to show his means of knowledge.
