Minor's Bill of Rights

The rights of Minors have been incredibly unclear over the years.  Different court cases have said different things about a variety of issues involving minors.  It has never been clear what rights minors have, and what rights they do not have.  My idea is to create the Minor's Bill of Rights.  I want to amend the constitution to specifically say what rights minors have.   This will allow minors to know what they can and cannot do.  It will empower them to have some sort of defined citizenship.

Some important things I believe should be included in the Minor's Bill of Rights...
   1.  Freedom of Expression Applies in Public Schools.  Public schools are big on limiting freedom of expression for their students.  Court cases have varied on this.  Tinker vs. Des Moines Board of Education was the Supreme Court case that upheld freedom of expression in public schools.  It so elegantly said of the board of education "That they are educating the young for citizenship is reason for scrupulous protection of Constitutional freedoms of the individual, if we are not to strangle the free mind at its source and teach youth to discount important principals of our government as mere platitudes."
    2.  No Minor will be tried as an adult.  The simple fact is...minors are not given the rights of an adult.  Since a minor is not considered an adult, nor is a minor given adult rights, they cannot be held accountable like an adult.  If they are not equal in rights, they cannot be tried as though they are. 
    3.  No law will be allowed enforcing curfews by age.  First of all most youth crime is committed during after school hours, therefore curfews make little actual sense.  Also the numbers show youth curfews have no effect on stopping crime.  In fact the number one crime committed by teenagers...you guessed it...Curfew violation.
   4.  School Uniforms are not permissible in public schools.
   5.  Unwarranted search and seizure still applies in public schools.  The atrocity that took place in Berkeley School District north of Charleston South Carolina should have brought the nations attention to this.  Police charging in, guns raised, kids all on the floor, and nothing was found.  We need to keep our schools and children safe, but we cannot do it at the expense of justice. 

The Minor's Bill of Rights is not limited to this.  If I am missing a right you believe a minor should have let me know.  This is something I believe we need in the United States Government and is a plan that I will fight for.
