Given only the detail in the book, for me, Ms. Garcia and among the others (Jaime Noel Santos, and Cesar Manalac) are guilty, in the following reasons:
(a) Garcia committed a crime "unauthorized access" even if she said that password of Thames is given to her by Mr. Manalac. In fact, Mr. Manalac is not authorized person and Garcia knew it.
(b) As for "common practice" of Thames employees, it is not the reason to acquit Garcia, where those employees are also considered violating if Thames restricting the account.
(c) If Garcia felt Thames hatred then why she attempt to intrude Thames jurisdiction that will be an opportunity for Thames against her.
(d) Finally, in a first place, it is unlawful and unethical to intrude other business information system, as for what good intention? It entails Thames to draw Garcia suspicious crime. |

Yes, a good start. I am strongly in favor because at least there are laws governed the ICT in the Philippines than nothing. We are in the jurisdiction of the Philippine Republic which controlled only in the constitution. It is my pleasure as an 'IT boy' that there are laws regulates this field as an applied ethics.
Regarding the content of the laws, I feel it is good but isn't enough, not the fine, but the coverage or maybe because I am not a lawyer. |
