Rental Agreement

1. Parties:  The parties to this agreement are ___________(owner) and  ____________(Tenant).

2. Lease:  Owner leases to tenant the property located at _____________, Crystal Beach, Texas.

3. Term:  For the length of stay being __________ ,2003.  Check in: 3PM, Check Out: 12 Noon

4. Rental:  Tenant shall pay in advance $400.00 (reservation/damage deposit).  Reservation deposit is due within seven (7) days of making reservation.  This deposit is payable by cashier’s check or money order.  Reservation deposit and /or rental monies are nonrefundable and nontransferable unless I am able to rent the vacation rental for your designated time period. Full payment of $___.00  (Rent) in cash, money order or cashier check is due 14 days in advance of the rental period.  Failure to pay this amount is cause for forfeiture of reservation and deposit.  Any and all requests for refunds or transfers of deposit must be submitted in writing. For your protection, phone calls will not be accepted.  Upon the start of your rental period, the reservation deposit will serve as your damage deposit.  This damage deposit will be refunded to you within twenty one (21) business days of your designated rental departure date, assuming there are no damages and the rental unit is left clean.  You will be notified in writing of any damages.  $100.00 of the reservation/damage deposit can be retained for cleaning if you wish.  Owner should be made aware at time rent is paid if you want to schedule a maid.

5. Occupancy and use of Property:
The vacation properties are for adult groups only. Spring break, prom, graduation or un-chaperoned groups are not allowed.   Any violation of these rules is cause for immediate removal of all occupants.  By signing this agreement lessee agrees to this specific clause. Tenant shall not assign this agreement or sublet any part of the Property. ______ Initialed

Upon your initial arrival to the home I would like you to do a check of the facilities within the first 30 minutes.  If you find conditions unsafe, I request you call me at the number below and let me know.  If I cannot remedy the situation, you may vacate the premises with a refund of deposit and rental monies.  Please remember these are my private homes and I ask that you care for them as if they are you own.  Upon check in please inspect the cabin and let me know immediately if there is anything in need of repair.  Upon arrival or when discovered, it is your responsibility to let me know if anything is broken or not working properly.  Otherwise you will be held liable for damages. _______Initialed.  I can be reached at the following number: __________.

Because of the limited capacity of septic systems, please limit occupancy to the designated capacity (this includes adults and children).  Designated occupancy for this property is 6/2.  Overcrowding, out of control parties or unlawful acts will not be tolerated and all parties will be escorted off of the property with no refund of rental deposit monies. _______ Initialed

6. Linens:  Linens are not provided. Please bring you own sheets, pillows, towels, dishtowels and washcloths.

7. Pets:  Pets are not allowed in any of our properties.  Pets on the property are cause for forfeiter of damage deposit. ________ Initialed

8. Smoking:  Please restrict all smoking to outside areas. Smoking in the rental unit is cause for forfeiture of damage deposit.  Yard/ash trays should be free of any cigarette butts upon your departure. ______ Initialed

9. Refrigerators:  Do not attempt to accelerate the cooling effect by lowering the thermostat.  This will only cause the units to freeze up.

10. Washer/Dryer:  If your home is equipped with a washer/dryer unit please take care not to overload these units.  Please use outdoor shower to pre-rinse sand out of any clothing going into the washing machine.  Sand in the machines is cause for forfeiture of deposit. ______ Initialed

11. Barbecue Grills:  Grill is provided.  Do not BBQ or grill on the decks.  This is a direct violation of Galveston County fire codes and may result in a fine.  All grilling should take place on the ground level and far enough away from the home to protect against fire/spark damage. Grilling on the deck is a violation of this agreement and cause for forfeiture of your deposit. Used coals, once cooled, should be placed in a garbage bag and thrown in the dumpster, not in the yard or the dunes.  Please use aluminum foil on grill or clean for next guest. _______ Initialed

12. Septic Systems:  All of our properties operate on a septic system. Please take care not to abuse them.  Dispose of sanitary napkins, tampon dispensers, used tampons, condoms, diapers, large wads of paper, etc. in the trashcan in the bathroom, not the toilet.

13. Parking:  Due to the buried utilities and septic systems, parking is allowed in the designated areas only. Do not park in areas past any barriers or drainage ditches.  RVs, tents and any type of recreational vehicles are not allowed on the property.  No electrical or water hookups are allowed.  Parking in non-designated areas is cause for forfeiture of deposit. _______ Initialed

14. Deck Furniture:  Deck furniture is provided for your convenience.  Do not take these items to the beach.  Please return them to the interior of the cabin upon departure.

15. Dunes:  Our dunes are a very fragile environment, please do not walk or play in them. According to Galveston County codes, operating bicycles or motorized vehicles in the dunes is unlawful.  Also, there are snakes in the dunes.  No dumping trash, seafood shells, coals or anything in the dunes.

16. Garbage:  Please use garbage bags in kitchen, bath & outside garbage cans.  Deposit all bagged trash in large trashcan downstairs.  Garbage pick up is Monday & Thursday.  Put cans by the road at 7am on the mornings of pick up or when your rental is over.  Everything goes into garbage bags that are put in the large garbage cans; nothing is to be thrown in the dunes or yard.

17. Beach Tar:  Please check your feet for tar before entering the living and deck areas.  Tar is easily removed with baby/ mineral or Shout.  Tar on the carpet/decks/tile is cause for forfeiture of deposit.

18. Telephone:  A telephone is located in 1323, not 816.  The number is 409-684-____.  It is restricted to local calls only.  Please use a calling card for long distance calls.

19. Check Out:  It is your responsibility to leave your rental unit clean and in move-in condition.   A minimum of $100.00 of the deposit will be retained to clean the house if necessary.  Entire deposit is forfeited if unit is not left clean and causes loss rental; you will be financially responsible for difference of lost rental. _______ Initialed

 20. Inspections:  Owner may enter the homes at all reasonable times to inspect, complete, replace or repair the improvements.

 21. Law:  Tenant shall obey all applicable state and county laws, restrictions, ordinances, rules and regulations with respect to the property. ________ Initialed

22. Repairs and Maintenance:  Tenant shall bear all expenses, including loss rental monies, of repairing any damages to the property caused directly or indirectly by the acts or omissions of the Tenant or any person therein or thereon by the consent, invitation or sufferance of Tenant. Repairs shall be completed immediately. _______ Initialed

23. Indemnity:  Tenant shall indemnify owner from all claims for the injury or damage to the persons or property of such third party arising from the use or occupancy of the property by the Tenant.  This indemnification shall include costs and expenses incurred by the owner, including attorney's fees. _______ Initialed

24. Default: If Tenant fails to perform or observe any provision of this Lease and fails to remedy same immediately after notice by Owner, Tenant shall be in default under the provision set by this agreement. _______ Initialed

25. Termination:  This agreement shall terminate upon (a) expiration of rental term, (b) Tenant's default under the terms of this agreement.  Upon termination of this agreement, Tenant shall vacate the premises.

26. Holding Over:  Any possession by Tenant after the termination of this agreement shall not operate to renew or extend the term but shall be construed as a tenancy at sufferance of Owner. Tenant shall pay at a rate of two (2) times the rentals rate during any possessing after termination. _______ Initialed

28. Attorney's Fees:  Prevailing party in any legal proceeding brought under or with relation to this agreement shall be entitled to recover from the non-prevailing party all cost of such proceedings and reasonable attorney's fees.

29. Notices:  All notices by Owner shall be in writing and effective when delivered to the property.  All notices by Tenant shall be in writing and effective when delivered to the designated address for the owner for payment of rent.  Consult your attorney.  This is intended to be a legally binding agreement.  Read it carefully before signing.  If you do not understand the effect of this agreement consult your attorney.

819 _____________: Upstairs – 2 bedroom, each with Full size beds;
Living Room - 2 daybeds.  Note – There is no telephone in this house.

1323 _____________ Street: open concept– 1 Queen, 1 Full, 1 full sleeper sofa.
Air Conditioning:  Upon arrival allow the air-conditioning units time to cool the home. Keeping the doors and windows shut will accelerate the cooling effect. Please utilize the fans during your entire stay. 816 House: Central unit should be no lower than 74 degrees. Downstairs unit should not be adjusted above #8 setting. 1323 House: A/C fan knob on medium/high temp knob ¼ turn from coolest setting.  Using lower fan settings without lowering A/C temp will cause the unit to freeze up.

Other suggested items:  suntan lotion, charcoal & lighter fluid, fishing gear, first aid items, beach chairs, umbrella, paper goods – towels, cups and plates, ice chest, laundry detergent, insect repellant, aluminum foil, beach shoes/sandals.
