1. Purchaser agree to pay a non-refundable amount of 50% of Total Price ($_____________) to the Artist upon signing this contract and the remaining 50% ($______________) upon satisfactory completion of the painting described above.
2. The Artist will create a painting based on the description above. The Artist agrees to create up to three preparatory drawings from which to obtain Purchaser's approval before beginning the commissioned painting. Should purchaser require additional preparatory drawings, he may purchase them at $75.00.*
3. The first three preparatory drawings described above in Item #2 are property of the Artist.
4. The Artist agrees to complete and deliver the Commissioned Painting on or before
the date of ____________________
5. In the event that the Artist cannot deliver the painting or the Purchaser cannot pick it up, Purchaser agrees to pay all necessary shipping expenses. Purchaser must retrieve the Painting within 30 days of completion or it becomes property of the Artist.
6. In the event that purchaser resells the Painting for any amount ovr $12999.99, Purchaser agrees to notify the Artist and pay him 10% of the total amount.**
7. Artist retains all copyrights to the Painting.***

* The preparatory drawings are to ensure that you know more or less what the painting is going to look like before I put all the effort into making it. I am usually able to make a satisfactory compsoition by the 2nd drawing and have never required to make more than the stated 3. If i have to do more, i am not strict about the extra cost. The additional $75 is to dissuade anyone from taking advantage of me by asking for an outlandish number of sketches. if you do have to pay for additional drawings, you at least get to take them home with you.
** I am flexible on this item. It rarely applies to commissions since they are often personal, cherished items and thus not resold. I have included it because I offer my skills at a bargain price, even for a young emerging artist, so if in the future people are making alot of money on my work, it would be nice to be compensated slightly for it.
***I am willing to sell the copyright in part or in whole on a case by case basis, such as for posters, album covers, book covers, etc.
