Re: Petition of Smith, ______________
Dear Ms. Smith:
I have received your letter complaining about the actions of Magistrate Schwartz. You did not provide any return address so I am sending this letter in care of the attorney who represented you in the matters recently before Magistrate Schwartz.
Since you included a copy of the minute order entered by Magistrate Schwartz, I know that you are aware that she ruled only on the request to set aside the relinquishment and that any request to set aside the adoption is still pending. Since there may be a pending matter before the Court, it is improper for you to communicate with the Court without sending copies of your correspondence to all of the other parties. In order to correct that problem, I am sending copies of your letter to your attorney and also to Small Miracles Foundation, who was the opposing party in your recent litigation. In the future, make sure that you send copies of correspond3ence to all parties. If they has not been openly disclosed by those copies, the Court will not accept your documents for filing.
Since there may still be a matter pending in Court concerning the subject matter of your letter I will not comment in any way about the issues you have raised. Any party has a right to appeal a final decision of a court in this state. You may wish to discuss with your attorney the appellate rights you may have.
Very truly yours,
