This matter was forwarded to division 9 for ruling on the request to vacate adoption. Since the time for responding has not run under CRCP 121 SECT 1-15, the court does not rule on that request at this time. Based on a sua sponte review of the magistrate's orders, that 4/14/98 order denying the request to set aside the relinquishment is vacated and the case is remanded to division M2 for further consideration of the request. The magistrate ruled on the motion prior to expiration of the time for responding as authorized by CRCP 121 SECT 1-15. After due consideration of any timely filed responses, the magistrate may enter any ruling which she deems appropriate. Copy of this minute order sent to magistrate Schwartz, C.
