MARAGUNDON, Philippines - More than 160,000 people fled to high ground or crowded into schools and town halls Thursday as a powerful typhoon battered the eastern Philippines, where rescuers are still struggling to find scores of missing from an earlier storm that killed more than 420 people.

The Philippines is hit by about 20 storms and typhoons a year. A typhoon and another storm last week killed at least 87 people and left 80 others missing in the east.

Man's HIV Diagnosis Reversed 8 Years Later.

SAN FRANCISCO - A California man who once tested positive for HIV (news - web sites) has learned the diagnosis made eight years ago was mistaken and he never had the virus that causes AIDS (news - web sites).

Jim Malone spent years battling depression and losing weight, expecting to die at any time. He attended support group meetings and accepted free meals from an AIDS charity. Malone's main doctor, Richard Karp, acknowledged the error in an Aug. 4 letter to the Department of Veterans Affairs (news - web sites) clinic where Malone was treated. "As his primary care provider, I take full responsibility," the doctor wrote.

Malone, who is gay and has lost friends to AIDS, said he is relieved but angry at his doctor.

The Oakland Department of Veterans Affairs is investigating.

The clinic performed its own HIV test on Malone to confirm the first set of results and it came back negative, but that information was never shared with the patient, Pridmore said. The mistake was uncovered by the VA's computer system, which tracks HIV patients and conducts a periodic review of cases.

Strong Earthquake Strikes Central Calif.

PARKFIELD, Calif. - A strong earthquake struck Central California on Tuesday that was felt from San Francisco to the Los Angeles area. There were no immediate reports of injuries.

It does not identify the government as the source of the report. It also fails to make clear the person purporting to be a reporter was someone hired for the promotional video.

Those are the same features including the voice of Karen Ryan that were prominent in videos the Health and Human Services (news - web sites) Department used to promote the Medicare law and were judged covert propaganda by the Government Accountability Office in May. The Education Department's video uses "the same exact mode of operation," said Nancy Keenan, education policy director at People for the American Way. The video encourages students to take advantage of tutoring and says that families give the idea an "A-plus."

"It's basically propaganda, not general information about a program," she said. "And it's portraying to the American public, via a video news release, that it's news."

The Education Department says the video was clearly marked as being a product of the agency when it was given to TV stations. Still, since the GAO report came out, the department has stopped using the narration-styled video news releases, spokeswoman Susan Aspey said.

Aspey defended the video as a way to help people understand the law's offer of tutoring.

At least one television station in New York used the package in 2003, substituting its own reporter for the voiceover but following the script and video provided by the department. The department, in turn, put the text of that station's story on its Web site.

Government press offices play a key role in sharing information and pitching story ideas, but sending out videos featuring "pretend" news reports is wrong, said Al Tompkins, who teaches broadcast reporting at the Poynter Institute, a school for journalists.

"Let the alert be loud and clear: Don't use this stuff," Tompkins said.

Official: Paige to Leave Education Post.

WASHINGTON - Education Secretary Rod Paige intends to leave his Cabinet position, a Bush administration official told The Associated Press Friday.

"The secretary has been looking at leaving, and he's been in discussion with the White House about the right time to do so," said the official, who spoke on the condition of anonymity.

A Texan like Bush, Paige, 71, rose to prominence as an award-winning superintendent in Houston before becoming the nation's first black education secretary. He has been an outspoken defender of No Child Left Behind, the education law at the center of Bush's domestic agenda. Paige has not formally handed in his resignation, according to the official, who has talked to Paige about his plans.

The administration official said Paige is content to move on after overseeing Bush's education agenda for four years. The official declined to be identified because Paige has yet to resign. A leading candidate to replace Paige is Margaret Spellings, Bush's domestic policy adviser who helped shape his school agenda when he was the Texas governor. Spellings has a keen interest in schools and may want the Cabinet-level education job.

Paige has presided over the biggest federal shakeup to education in a generation, a law demanding that schools show improvement among all students, regardless of race or wealth. Paige, who grew up in segregated Mississippi, puts No Child Left Behind in the category of Brown v. Board of Education, the landmark case that ended separating schools by race.

Yet Paige has had rocky moments, with none more glaring that when he called the National Education Association a "terrorist organization" in a private meeting with governors. He apologized but maintained that the NEA, the nation's largest teachers union, uses "obstructionist scare tactics" in opposing the law. The union called for his resignation.

LOS ANGELES - The Christmas-themed movie "Noel" most likely won't be coming to a theater near you but if you miss it on cable, there's always the self-destructing DVD.

The movie's producers hope its "trimultaneous" roll out this month, which starts this weekend with a theater release in just five major cities, will prove the public is willing to "rent" movies that must be tossed in the trash after just a viewing or two. Disposable DVDs look and play like normal DVDs, except that their playable surface is dark red. Each disc contains a chemical time-bomb that begins ticking once it's exposed to air. Typically, after 48 hours, the disc turns darker, becoming so opaque that a DVD player's laser can no longer can read it. (Discs can live as little as one hour or as long as 60 hours.)

Oil Slips Below $43 a Barrel

NEW YORK (Reuters) - U.S. oil prices fell below $43 on Monday on continued profit-taking as producer-group OPEC (news - web sites) eyed increases in the coming months in its tight spare capacity, countering worries over stumbling Iraqi oil exports.

U.S. light crude fell 58 cents to $42.60 a barrel, nearly $7 below a record hit earlier this month as hedge funds unwound their speculative long positions. Brent crude trade on London's International Petroleum Exchange was shut for a public holiday.

One-third of the Earth's surface is at risk, driving people into cities and destroying agriculture in vast swaths of Africa. Thirty-one percent of Spain is threatened, while China has lost 36,000 square miles to desert an area the size of Indiana since the 1950s. This week the United Nations marks the 10th anniversary of the Convention to Combat Desertification.

"Entire parts of the world might become uninhabitable." said an environmental scientist. Slash-and-burn agriculture, sloppy conservation, overtaxed water supplies and soaring populations are mostly to blame. But global warming is taking its toll, too.

By 2025, two-thirds of arable land in Africa will disappear, along with one-third of Asia's and one-fifth of South America's. Most at risk are dry regions on the edges of deserts places like sub-Saharan Africa or the Gobi Desert in China, where people are already struggling to eke out a living from the land. As populations expand, those regions have become more stressed. Trees are cut for firewood, grasslands are overgrazed, fields are over-farmed and lose their nutrients, water becomes scarcer and dirtier.

Technology can make the problem worse. In parts of Australia, irrigation systems are pumping up salty water and slowly poisoning farms. In Saudi Arabia, herdsmen can use water trucks instead of taking their animals from oasis to oasis but by staying in one place, the herds are getting bigger and eating all the grass. In Spain, Portugal, Italy and Greece, many farmers in those countries still flood their fields instead of using more miserly "drip irrigation," and the resulting shortages are slowly baking the life out of the land.

TOKYO - A Spanish lab technician needed only two hours to amass a small real estate fortune and drive a Norwegian mutual fund manager's railroad empire into bankruptcy to capture the World Monopoly Championship on Saturday.

Antonio Zafra Fernandez, 36, of Madrid pumped his fist in the air after he bested Norwegian Bjorn Andenaes of Oslo in the beloved board game to take home the $15,140 prize equal to the amount of play money in a Monopoly set. "I'm extremely happy and so proud," Fernandez said after hoisting a giant winner's check in the air. He said he and his wife would spend the prize money on a new car, but added: "It's not about the money. I'm going home as a champion, which doesn't happen often in a person's life." Andenaes, who had worn his Rocky Balboa boxer shorts in training and prepared by memorizing endgame probabilities from a study guide on the Internet, did not have the luck of the dice in the end.

"Luck was the deciding factor," said Phil Orbanes, the tournament's chief judge from the United States.

The companies that sell Monopoly around the world flew players from 38 nations to the Japanese capital for the two-day event, first held in 1973 in Washington. The four finalists, all dressed in tuxedos, competed Saturday while a Mr. Monopoly decked out in a silver mustache, top hat and cane hovered near the stage. A real banker managed the tournament's money. Invented in 1934 by Germantown, Pennsylvania-native Charles B. Darrow, Monopoly is now sold in 80 countries and 26 languages.

But his fate was sealed when he rolled an unlucky six, moved his wheelbarrow to Tennessee Avenue and lost his shirt.

The Spaniard, who took up the game with his family as a child, said he "played to win" but didn't stick to a strategy. Meanwhile, Andenaes did not try to hide his disappointment.

Orbanes, the judge and the author of the "The Monopoly Companion," said all of the players in the championship understand how to win at the game, so it really comes down to a roll of the dice. "If luck is in your favor and you're a skillful player, you will almost always win," he said. "It's like real life: So much of your success depends on how well you get along with the other players and how good you are at persuading them to do something that's in your best interest but not theirs."

Sony-Led Group to Acquire MGM for $3B.

LOS ANGELES - A consortium led by Sony Corp (NYSE:SNE - news) (news - web sites). has agreed in principle to acquire famed Hollywood studio Metro-Goldwyn-Mayer Inc. for nearly $3 billion, MGM said late Monday.

The company said it received a cash deposit of $150 million on Monday from Sony, along with private equity companies Providence Equity Partners Inc., Texas Pacific Group and DLJ Merchant Banking Partners. MGM said its management will recommend the deal, which it called a "proposed merger" to its board by Sept. 27. Sony has agreed to pay $12 per share for MGM, 45 cents more than MGM's closing price of $11.55 Monday on the New York Stock Exchange (news - web sites). The deal also calls for Sony to assume about $1.9 billion in MGM debt. Sony's winning bid comes after Time Warner Inc. dropped out of the competition earlier Monday.

Sony is expected to shutter MGM's current production, with the possible exception of the "James Bond" franchise. MGM also produces films under the United Artists label.

But MGM has a considerable library of more than 4,100 titles, including the "Pink Panther" and "Rocky" franchises. Analysts have estimated MGM's library will generate $440 million in cash flow in 2004 by exploiting only 1,500, or about 36 percent, of its titles on the newer DVD format. Time Warner had been seen as the front-runner for MGM going into the weekend. But Sony raised its offer, setting off a bidding war that Time Warner concluded it did not want.

Time Warner is known to be interested in bidding on the cable assets of bankrupt Adelphia Communications Corp. Comcast and Sony have reached a deal to distribute Sony's Columbia/Tri-Star film library on Comcast's video-on-demand platform, the source said. That deal could expand to include MGM's library of films and result in Comcast making an investment in the new company. A Comcast spokeswoman declined to comment.

The 17th son of Saudi construction magnate Muhammad Bin Ladin, Usama joined the Afghan resistance almost immediately after the Soviet invasion in December 1979. DENVER - Crucial DNA evidence tested by defense experts in the Kobe Bryant sexual assault case might have been contaminated, prosecutors said in a court filing released Wednesday, just two days before jury selection is to begin.

Prosecutors said they had found contamination in DNA "control" samples intended to ensure testing was accurate. They also said data from the defense's experts appears to have been manipulated. Prosecutors asked the judge to hold a hearing Thursday to force the NBA star's attorneys to prove the reliability of the evidence intended to be presented at trial by defense experts.

Those experts include Elizabeth Johnson, who testified in a closed-court hearing in June that DNA evidence strongly suggests the alleged victim had sex with another man after her encounter with Bryant and before her hospital examination the following day. That claim, which attorneys for the woman have denied, is a core part of the defense's strategy to undermine the accuser's credibility. In the filing, prosecutor Dana Easter said some data from Technical Associates Inc., the California company where Johnson works, appeared to have been "whited out or otherwise manipulated."

"The documents requested are essential to complete the documentation of the defendant's DNA evidence," Easter said. Defense attorneys, who are subject to a sweeping gag order in the case, did not return a call seeking comment Wednesday.

Bryant, 26, has pleaded not guilty to felony sexual assault, saying he had consensual sex with the woman at the Vail-area resort where she worked last summer. If convicted, the Los Angeles Lakers (news) star faces four years to life in prison or 20 years to life on probation, and a fine up to $750,000.

Because Bryant has acknowledged having sex with the woman, DNA evidence is unnecessary for identification purposes. Defense attorneys have suggested the evidence would show the woman had sex with other men in the three days surrounding her encounter with Bryant, which they claimed was part of a pattern of behavior designed to gain the attention of a former boyfriend.

In the June hearing, Johnson explained in detail why she believes the DNA evidence suggests the woman had sex in the 15 hours after her encounter with Bryant.

WASHINGTON - The next president's most enduring legacy may be in an area little mentioned in the campaign so far: the federal courts, where rulings on such hot-button issues as abortion, gay marriage and the death penalty could have lasting impact.

With an aging Supreme Court, it's likely that over the next four years either President Bush (news - web sites) or Democrat John Kerry (news - web sites) will choose one or more new justices, along with scores or even hundreds of federal appeals court and trial judges.

Courts can have the crucial last word on important and contentious issues, as recent rulings on affirmative action and presidential war powers attest.

That's a departure from the 2000 campaign, when both Bush and Democratic nominee Al Gore (news - web sites) pointed to particular Supreme Court justices they admired and partisans on both sides spoke with certainty about an expected Supreme Court retirement.

---

Next month the current court begins its 10th term without a vacancy. Only one justice, Clarence Thomas (news - web sites), is younger than 65. Speculation about retirements has focused on Chief Justice William H. Rehnquist, who will turn 80 in October, and Justices John Paul Stevens (news - web sites), 84, and Sandra Day O'Connor (news - web sites), 74.

Stevens is still there 29 years after he was Gerald Ford's lone Supreme Court pick.

Olympic champion Michael Phelps would be a likely candidate for probation if he's found guilty of drunken driving, legal experts said yesterday. But his age - Phelps, 19, is more than a year and a half shy of Maryland's legal drinking age - could come back to haunt him in front of a judge deciding whether to grant probation before judgment, a finding that would keep any conviction off his record, experts said.

And because underage drivers have an alcohol restriction on their licenses, they can temporarily lose their driving privileges even before going to trial, according to an official with the Maryland Motor Vehicle Administration.

Phelps was charged with driving under the influence of alcohol after running a stop sign in Salisbury, police said. Lawyers weighed in on possible punishments. An official with Mothers Against Drunk Driving urged parents to use Phelps' arrest to educate their children about the dangers of drinking and driving. And students near Phelps' Rodgers Forge home alternately expressed disappointment in -and forgiveness toward - their hometown hero. "Everybody makes mistakes," said Corey Liberatore, 16, a junior at Towson High School, Phelps' alma mater. He said he believes the news coverage has been overblown.

County Executive James T. Smith Jr., who welcomed the swimmer home from the Olympics with an event dubbed the "Phelpstival," said he was happy to see the teen taking responsibility for his actions.

Swimmer's arrest

The trooper "observed signs" that led him to believe the driver may have been under the influence, according to police.

Phelps was arrested and charged with driving under the influence of alcohol,(DUI) driving while impaired, violation of a license restriction and failure to obey a traffic control device. Police said Phelps was "fully cooperative" and was released just after 1 a.m. Friday. State police spokesman Maj. Greg Shipley refused requests yesterday to provide additional information on Phelps' arrest, including whether the teenager took a blood-alcohol test or what it might have registered.

WBAL-TV said, quoting an unnamed source, that Phelps recorded a blood-alcohol level of 0.08 - the legal limit for driving under the influence. The television station also reported that Phelps drew the attention of a state trooper after nearly hitting an unmarked police car.

The citations issued to Phelps were unavailable yesterday. A Wicomico County District Court clerk said it could take four to six weeks for a traffic ticket to be processed by data entry clerks in Annapolis.

Beitman, who was two years ahead of Phelps at Towson High, said he admonished the swimmer not to "party too much" when he heads to the University of Michigan to join his longtime swim coach.

Two judges, who spoke generally about drunken-driving cases, said they look at a variety of factors when deciding on an appropriate punishment for a first-time drunken-driving offender - including prior infractions and age. Chief District Court Judge James N. Vaughan said underage violators "carry a burden" in his court because they've already broken the law just by drinking.

Whether an offender has caused an accident and whether he or she has an alcohol problem also go into the mix. "What, if any, alcohol dependency is important because I want to know, 'What is the likelihood of future danger to the public?'" said Judge Keith E. Mathews, the administrative judge for Baltimore District Court. Yesterday, Phelps' fans continued to weigh in, some on an unofficial fan site where hundreds of people posted reactions.

"I'm still a huge fan, but I didn't think he would do something so utterly stupid," one 13-year-old wrote. "I mean[,] fine[,] drink, even though I don't think he should since he's underage, but don't drive."

Just how tricky was a point of debate during a hearing last year before Circuit Judge John N. Prevas.

In the case, Cantie Evans was handcuffed March 10, 2002, by detectives conducting a major drug sweep in West Baltimore. Officers found six vials of crack cocaine inside his Lexus, according to testimony by Evans and a police sergeant.

Following instructions from officers, Evans called a friend and had the friend deliver a gun in a brown paper bag to a nearby trash canister, according to testimony. The detectives checked to make sure the pistol worked, set Evans free and never charged him.

But days later, Evans was arrested for alleged drug dealing caught on tape by the same sting operation. His attorney argued that those charges should also be dropped based on the gun trade.

Police say he was about to hand money to a person who was arrested with cocaine.

Both Rogers and the police account confirm that he was arrested on charges of attempting to possess drugs. Rogers, who enrolled in the Army National Guard and recently left for basic training, says he previously had a drug problem but successfully completed rehabilitation. Upon arrest, he says, he asked police how he could avoid going to jail, and they suggested getting a gun. The only one he could think of, he says, was the one kept by the woman who helped raise him in Morrell Park.

No deal

Sheila Harding didn't accept the gun-for-freedom deal proposed to her that day. At the time she had a broken, triggerless shotgun upstairs in a closet, she says. A neighbor had given her the gun because he didn't want it around his children, she says.

Rogers was taken to Central Booking and Intake Center, and several hours later, prosecutors declined to prosecute the case because the charges were legally insufficient, they say.

A group calling itself Ansar al-Zawahri claimed responsibility for the abduction on an Islamist website, but experts gave the claim little credence.

The abduction looks likely to trigger an exodus of foreign workers with NGOs. A co-ordinator for such groups, Jean-Dominique Bunel, said he expected at least 50 workers to pull out. The organisation which employed the Italians, Bridge to Baghdad, is an anti-war group which has been helping Iraqis since the 1991 Gulf War.

High court protects cable companies' broadband. WASHINGTON (AP)The Supreme Court ruled Monday that cable companies may keep rival Internet providers from using their lines, a decision that will limit competition and consumers' choices. The 6-3 decision is a victory for the Bush administration, which sought exclusive control to promote broadband investment from deep-pocketed cable companies. Judges should defer to the expertise of the Federal Communications Commission, which concluded that limited access is best for the industry, the high court said in an opinion by Justice Clarence Thomas. TECHNOLOGY. More than 19 million homes have cable broadband service. At issue is whether cable Internet access is a "telecommunications service" under federal law that makes it subject to strict FCC rules requiring companies to provide access to independent providers. The FCC said no, voting in March 2002 to exempt cable companies from the strict rules to stir more investment. The agency reasoned that high-speed Internet over cable was just an "information service," making it different from phone service.

The stakes were high. Cable companies have invested billions to set up broadband networks and are now reaping the benefits. Last year, the industry earned about $10 billion in revenue from cable-modem subscriptions, which represent its fastest growing segment.

The cable industry also had the backing of phone companies, which will now push the FCC to deregulate their rival Internet services on digital subscriber lines. Currently, DSL is regulated as a "telecommunications" service that requires companies to share their lines with independent providers such as Brand X and Earthlink. Consumer groups, however, argued that subscribers should be able to choose their own Internet service provider rather than be forced to use the cable company. Left unregulated, cable companies will monopolize the market, with unfettered ability to raise prices and restrict content for their business advantage, they said.

Fast broadband connections are growing, but most computer users still access the Internet through dial-up services. Broadband, through phone and cable lines and satellites, costs about $30 to $50 a month, depending on location.

Although there are alternatives for high-speed access such as telephone line-based DSL, fixed wireless and satellite, an estimated 60% of high-speed Internet users subscribe to their cable company's service, according to recent studies.

The Geological Survey raised the mountain's eruption advisory from Level 2 to Level 3 out of a possible 4 on Wednesday, prompting officials to begin notifying various state and federal agencies of a possible eruption. In addition, scientists called off a plan to have two researchers study water rushing from the crater's north face for signs of magma.

BAGHDAD, Iraq - The Arab news network Al-Jazeera on Wednesday broadcast footage of British hostage Kenneth Bigley pleading to British Prime Minister Tony Blair (news - web sites) to work for his release.

The footage showed a sobbing Bigley talking from behind bars of what appeared to be a prison cell. He was dressed in an orange jumpsuit and kneeling on the floor.
The authenticity of the tape the second purportedly showing the man appealing for his freedom could not be verified independently. "He doesn't care about me, I'm just one person," Bigley was heard saying, referring to Blair. At one point Bigley, whose legs and hands were chained, cradled his head in one hand. The Jazeera announcer said Bigley accused Blair of lying and added that the prime minister was not conducting any negotiations to effect his release.

Gruesome videos of the slayings of the Americans, Eugene Armstrong and Jack Hensley, have appeared on the Internet, and their decapitated bodies were found in Baghdad.

U.S. Says Troops Now Occupy Fallujah.

FALLUJAH, Iraq - U.S. military officials said Saturday that American troops had now "occupied" the entire city of Fallujah and there were no more major concentrations of insurgents still fighting after nearly a week of intense urban combat.
