AGREEMENT BETWEEN MR STEPHANOS KYRIAZIS AND MRS OLENA SHAPOVALOVA
Mr Stephanos Kyriazis and Mrs Olena Shapovalova are hereinafter referred to as the "Contracting Parties"
Mr Stephanos Kyriazis, born in Lefkosia of Cyprus on the 9th of September 1961, a citizen of of the Republic of Cyprus, and Mrs Olena Shapovalova, born in Nikolaev of Ukraine on the 20th of May 1980, a citizen of Ukraine, got married at the municipality of Ayios Athanasios in Cyprus on the 29th of March 2002. A child was born to them, a son named Dionysis Ellis Kyriazis, on the 30th of October 2002 at Lemesos General Hospital in Cyprus. The marriage between the Contracting Parties was dissolved, with the issuing of a divorce by the Lemesos Family Court in Cyprus, on the 19th of December 2005, registered as case number 331/2005 in the aforementioned Court.
The Contracting Parties hereby agree:
1. When Mrs Olena Shapovalova, the mother of the child Dionysis Ellis Kyriazis, will come and reside in Cyprus with her child Dionysis Ellis Kyriazis, her child will reside with her and she will have the care and custody of her child.
2. When the child Dionysis Ellis Kyriazis will be in Cyprus, the father of the child, Mr Stephanos Kyriazis, will have the following visitation and communication rights regarding his child:
A. To see, visit, communicate and spend time with his child on an everyday basis, unhindered and without any obstacles by the mother of the child.
B. That the child will be spending two consecutive days and nights at the residence of his father every week, unhindered and without any obstacles by the mother of the child.
3. When the child Dionysis Ellis Kyriazis, will not be in Cyprus, the father of the child, Mr Stephanos Kyriazis, will have the right to see, visit, communicate and spend time with his child, unhindered and without any obstacles by the mother of the child.
The Contracting Parties will both herein undersign this agreement, thus validating this agreement. Each Party will have an exact duplicate of the document of this agreement, bearing the signatures of both the Contracting Parties on each duplicate document. These documents will be signed by the Contracting Parties, first in Cyprus by Mr Stephanos Kyriazis, and then in Ukraine by Mrs Olena Shapovalova, following an exchange of the documents by post. This agreement will come into force on the 1st of March 2006.
