Preface

 

 

This information has been written and put together as a book (The Dark conspiracy) in order for others to gain true knowledge on what  have really transpired with the certain key persons while the cases was being crafted against the former Philippine President Ejercito Estrada.  The public will learn on how the cases against the former President were fabricated, manipulated and on how the public was made to believe on the allegations against the legitimate President.

 

The readers will also gain additional knowledge on how GMA participated to guarantee the imprisonment of the former President.

 

This will also show the public on how two (2) conspiracies in the highest form was concocted by the concern personalities and got away with it until now.  The book will name names on all of the  conspirators and together with its roles respectively.

This book is sincerely dedicated to the family of the writer, wife & children, to the people who supported the writer in this endeavor, to the people of the republic of the Philippines, to President Estrada & family and most especially to those who have suffered most due to these said irregularities.

 

The writer hopes that with this book, the mistake will be corrected and rectified and that a lesson for all that “  Only the truth shall set us free”  and coming out to the hope is not always too late”

Flaws on the second perjury case

 

 

a.      The Amended Information in Sandiganbayan dated April 4, 2001 that was based on the complaint filed by VACC was filed by the ombudsman five (5) months ahead of the supposed complaint of VACC which is dated September 10, 2001.

 

b.     The supposed letter-request for vital documents of VACC that was used as basis for filing of the second perjury case was fabricated on orders of then Ombudsman Desierto et al.

 

c.      Said letter-request mentioned in item B was antedated of which the record clerk refused to record it in the incoming logbook.

 

d.     The original draft complaint was manufactured by the Ombudsman and was prepared for signature by the supposed complainant, the VACC.

 

e.      Said draft complaint was revised and corrected in her own handwritings by Atty. Percy Acosta, the chief of the Public Attorney’s Office/Department of Justice.

 

f.        Atty. Percy Acosta represented herself as defense Attorney of ERAP and for many times submitted a motion to be excluded as counsel of the accused but never mentioned that she is one of the brains in the fabricating and filing of the said case.

 

g.      With the full knowledge of PGMA of this conspiracy, she then personally orchestrated, obstructed and prevented the truth on this said conspiracy to come out.

Sometimes last 2001, a particular lawyer from the Office of Ombudsman Aniano Desierto contacted the writer and was convinced to file another case against the former president in the spirit of fighting corruption.

 

The writer was made a request in writings some particular documents from the office of the Ombudsman Desierto, the request was prepared by said lawyer and was antedated but the record clerk refused to record the said request-document in the in-coming transmittal logbook and the lawyer himself recorded it himself in the said logbook, inserting it in the date that would jive with the antedated request.

 

Few days later with the same lawyer, while attending the hearing of the another case against the former President in Sandiganbayan, the lawyer invited the writer to pick-up the requested documents from the Ombudsman’s Office in Arroceros, Manila.  In the Ombudsman Office, to the surprised of the writer, the documents also included the draft-complaint, complete with all its attachments.

 

Said documents, per instructions of Chairman Dante Jimenez of the Volunteers against Crime and Corruption (VACC) was brought to him and was reviewed.  Upon instructions of Mr. Jimenez, the documents were brought to the Public Attorney’s Office (PAO), to Atty, Percy Acosta.  Atty. Acosta made some hand-written corrections on the draft-complaint.  And few days after, the case was finally filed by VACC at the office of the Ombudsman with several media outfits.

 

Troubled by how it was executed, about later part of 2002, the writer decided to come out to the public.  Death threats became increasingly disturbing, the writer consulted several friends on how to deal with the situation.

 

Until the early part of 2003, representatives and supporters of the administration was already squabbling to get hold of the  writer, several high ranking government officials and supporters was already involved in controlling the writer.

 

On the 14th of March 2003, the writer had a confidential meeting with President Arroyo in the Presidential palace.  Exactly after a week, the entire family of the writer was changed and had to hide for fear of their lives.  The entire family of the writer was secured by the Presidential Security Group (PSG) and was placed in one of the hotels in Roxas blvd., was booked using different name.

 

While under the protection of the PSG, the writer noticed something was wrong, the entire family runaway.  Dante Jimenez and some other government officials convinced the writer to return back to the protection of the administration for there was only a misunderstanding.  This time the writer chooses the Philippine National Police (PNP) as their security.  Several months passed by, transferring places several time with PNP bodyguards, threats and harassments was still increasing.

 

After noticing suspicious looking person in the palace, bodyguards felt the heat and requested for additional personnel and also requested to be issued by long firearms to supplement their present arms.  Unfortunately and allegedly there were no available required firearms in the armory.

 

The family with their bodyguards luckily escaped from pursuing bad elements when they moved hours earlier to another location in the province.  The local residents noticed also the presence of said elements and did not know on why they were there and why they even have to fire their firearms.

 

On the 10th of August 2003, arranged by President Arroyo, the entire family was moved out from the country but the writer was still not convinced on were the threats and harassment must have came from.

 

The suffering did not stop, for they did not live a normal life, something was not right! The writer was still determined to tell the truth, but how?  Months passed by and after several Sunday masses, the writer finally decided to do this.

 

Who was behind the numerous harassments?  Who do you think benefited most on the relocation of the family?  What was the actual reason on why they have to be relocated immediately?

 

The writer has included herewith a copy of his sworn statement and its attachments, to shed light to the truth and justice.

 

 

 

 

 

On the later part of October 2001.

 

 

          The writer was contacted, by a lawyer from the office of the ombudsman.  The lawyer introduced himself as the head of the fact finding team of the prosecution group of the office for the erap cases.

 

          The lawyer requested the writer to file another cases against the former president, to strengthen their cases against ERAP because they were filed without sufficient evidence.

 

          The writer was surprised, he asked the lawyer on why him.  The lawyer simply replied that they need someone but not from the office of the ombudsman to file the cases to avoid and negate the growing public perception that indeed the Ombudsman is persecuting ERAP and is filing cases without sufficient evidence.

 

          The lawyer intimidated to the writer that he was acting upon the instructions of Ombudsman Desierto.  After consulting Chairman Jimenez, the writer agreed and told the lawyer of his willingness to cooperate in the interest of justice.

 

          Initially, the lawyer asked for a bond paper with a VACC letterhead from the writer for he knows that the writer always usually said kind of paper with him all the time.

 

          The lawyer volunteered to prepare the supposed letter-request on the VACC letter head.  Right at that very moment the lawyer made the letter-request but it was antedated to August 21, 2001, the writer questioned this.

 

          The lawyer explained to the writer on why it has been antedated.  To make it appear that even at such early date, there was already an interested complainant who was already asking for documentary evidence to prove that indeed the ombudsman is not the only one interested in prosecuting ERAP but by the civil society as well.

 

          The writer sought the clearance from Chairman Dante Jimenez and signed on the letter-request as prepared by the said lawyer.

 

          Immediately upon affixing the signature of the writer, the lawyer caused the posting of the supposed date of entry in the “incoming” logbook of the office of Assistant Ombudsman Edward Harun Pagunsan by intercalating thereto the receipt of the supposed letter-request to correspond to AUGUST 21, 2001 entries;  this the lawyer did, because the receiving clerk was hesitant to do it considering irregularity of the entry.

 

          Only after the lawyer had posted the fact of the receipt of the letter request in the “Incoming” logbook that the clerk had stamped “RECEIVED” on the face of the letter-request and reflected therein the date of AUGUST 21, 2001 as the date of receipt to correspond to the intercalated entry into the “Incoming” logbook.

 

 

Sometime in September 3, 2001

 

 

          While attending on a regular hearing of one of the ERAP cases.  The lawyer approached the writer and told him that the “documents” that has been requested are now ready for pick-up at the office of the ombudsman in Arroceros, Manila. The lawyer and the writer went together to pick-up said documents.

 

          In the ombudsman office, the lawyer indeed all the documents but the writer insisted that there should be a written document to show that he legally obtained the said documents.

 

          The lawyer acceded to the request of the writer by personally enumerating in his own handwriting of the face of the letter-request all the documents that was supposedly requested from the Ombudsman.

 

          Immediately upon receipt of the documents requested, the lawyer handed to the writer a draft of the ‘SUPPLEMENTAL COMPLAINT”

 

          Upon completing the transaction in the office of the ombudsman, the writer proceeded to Makati City to met Chairman Dante Jimenez with all the documents.

 

          After reviewing the documents with Chairman Jimenez, the Chairman instructed the writer to also present the same to ATTY. PERCY ACOSTA, the chief of the PUBLIC ATTORNEY’S OFFICE of the Department of Justice for checking and review.  While on a meeting with Chairman Jimenez,Ombudsman Desierto called and talked to Chairman Jimenez.  The ombudsman was basically checking if he got the documents and was checking also on the writer.

 

          While the writer was with Atty. Acosta, the latter made some hand-written corrections on it.

 

          After incorporating all the corrections made by Atty. Acosta on the final draft complaint, it was filed and received before the Office of the Ombudsman on September 10, 2001 in front of the press and was subscribed sworn to before by the Overall Deputy Ombudsman Margalito P. Gervacio.

 

 

On the later part of 2002

 

 

          The writer was trying to talk to Chairman Jimenez but had always been turn down for he was having problems with the new officers of the VACC.  The writer was convinced that a character demolition was being conducted on him.

 

          Feeling that his group has dumped him and that he just been used only by the organization, having experienced on what the organization is capable of doing, he started of thinking of how to protect himself from the organization.

 

          The writer started thinking of coming out to the public on everything he has done in the organization and put it on the right tract as it was the original concept of the organization, it was the right things to do and the same reason on why he join the organization.  He thought of starting it from his role on the most controversial case at that time.

 

          The writer fell that the organization was basically being used for personal purposes only and that there was somebody else was controlling.  The public was already aware that there was a problem within the organization for there were several releases about it.

 

          To put the record straight, the writer was already convinced to come out and tell the truth.  While in one of the hotels in Quezon City in his regular hang out, a gentleman who introduced himself as one of the lawyers of the former President, he offered him protection and helped him in preparing a sworn statement, on his knowledge on the preparation of the cases that was filed against the former President.

 

          As agreed, the lawyer and the writer met again the next day in the same place at about the same time.

 

          The writer was made to bring and show all documents concerning the “cases” the writer voluntarily cooperated with the lawyer helped prepare the sworn statement.  After few hours it was finalized, the writer took all the documents including the sworn statement and told the lawyer to give him more time to re-study the statement and will get in touch with him as soon as possible.  Realizing the magnitude of the would be effect, the writer consulted many closed friends on what and how should he treat the situation.

 

          The writer got several contradicting and confusing result on his consultations.  The writer had been trying to see and talk to Chairman Dante Jimenez and Atty. Nick Conti but was always had been turn down.

 

          The lawyer keeps on pressuring the writer to see them again and to bring all the documents together with his signed sworn statement.  But the writer keeps on avoiding them.

 

          Death threats and harassment on the writer was increasingly disturbing.  The writer started making notes on his diary.

 

 

Sunday, on the 12th of January 2003

 

 

          Finally, the writer had a breakfast meeting with Atty. Nick Conti in KFC in East Avenue branch.  Atty. Conti is a personal friend of the writer and is connected with the Office of the President Arroyo.

 

          While having a breakfast, Atty. Conti suggested that the writer should ask Atty. Acosta of PAO to set a meeting with him and President Arroyo for this primarily concern her and the President.

 

 

Monday, On the 13th of January 2003

 

 

          2 p.m. with Atty. Acosta at the Public Attorney’s Office, the writer showed to Atty. Acosta the documents.  Upon viewing the documents, she was very frightened and pleaded to the writer not to sign on it and that she is not involved with the problem within the organization.

 

          Atty. Acosta pleaded also to the writer to see and talk first to Secretary Dinky Soliman or Chairman Dante Jimenez.  She immediately suggested to the writer that he should talk first to the President before making his decision.  She was confident that either of the two can set a meeting for him with the President.

 

 

 

Monday, On the 20th of January 2003

 

 

          While on a meeting with Chairman Jimenez in Intercon Hotel in Makati, the writer showed to him the “documents” Chairman Jimenez was frightened and surprised to find out that the writer has been keeping all the documents.  The Chairman appeared to have been briefed by Atty. Acosta before the said meeting.

 

          Chairman Jimenez convinced the writer not to sign on it and was convincing him instead, to burn all the documents including its original copies.  And that his problem with the Organization is being addressed upon by the VACC Board.

 

          Chairman Jimenez verified and made sure that the lawyer who prepared the sworn statement has no copy of the attachments.  Chairman Jimenez was very afraid that the information might leak to the public.

 

          At that time, it was the only copy.  They went to the business center of the hotel and made photocopies of the documents, the writer gave a copy to Chairman Jimenez.

 

          Chairman Jimenez arranged again another meeting with the writer the next day, the writer agreed.  This time the meeting was with Atty.Nick Conti and Atty. Ramon Cuyco.  The venue was set at the same place.

 

 

On the 21st of January 2003

 

 

          Sensing that something bad might happen to him and that very few people knows about his latest actions,  the writer started photocopying the documents and distributing it to all his trusted friends.  Most of them do not know that they have a copy of the information.  The original copy of the documents was entrusted to a custodian with a particular instructions.

 

          While in Intercon Hotel with Chairman Jimenez, Atty. Conti and Atty. Cuyco, they talked about on how the situation should be handled.  They were also preparing the security arrangement for the family of the writer for they were very concerned with their security.

 

          They all concluded that this has to be deal with utmost urgency and confidentiality.  The writer was very confused for his intention was for the truth to come out.

 

 

Friday, On the 31st of January 2003

 

 

          At Manila Hotel with Chairman Jimenez, Mr. Lauro G. Vizconde and Atty. Cuyco, Atty. Cuyco arrived late.  The same subject was discussed.

 

          Only this time, Mr. Visconde was contesting that he was the one that obtained the documents from the Ombudsman.  Not until Chairman Jimenez told him that indeed the writer got it from the Ombudsman.

 

          The writer was surprised on the initial reaction of Mr. Vizconde; this would only mean that the other cases were filed the same way.

 

 

Sunday, On the 2nd of February 2003

 

 

          The meeting was arranged by Chairman Jimenez, in Intercon Hotel with then Secretary Nani Braganza (Political Adviser of President Arroyo), Gen. Leo Alvez (who flew all the way from Cebu.  He was playing golf in Cebu before he flew to Manila), Assistant Secretary Nick Conti (Office of the Chief of Staff, Office of the President), Atty. Ramon Cuyco (the writer personally requested his presence) and Chairman Jimenez.

 

          After viewing the documents, Gen. Alvez immediately commented that “this is definitely the handy work of Aniano Desierto” he was referring to the sworn statement that was prepared for the writer to sign on.

 

          “After Ombudsman Desierto’s retirement, what position did he requested from the President? Gen. Alvez said.

 

“He requested to be appointed as Supreme Court Justice” said Secretary Braganza.  Secretary Braganza promised to help arrange the Security Details for the writer’s family.

 

 

 

 

On the 10th of February 2003

 

          Chairman Jimenez called the writer and told him that Malacanang agreed to secure his family and details of the security are still being arrange.

 

 

On the 11th of February 2003

 

 

          Chairman sent the mobile number of Secretary Braganza to the writer, Secretary Braganza would be telling the writer its security details.

 

          Chairman Jimenez arranged again another meeting; this time is with the Department of Justice.  The meeting was to be held in DOJ at the office of Usec. Joe Calida.

 

 

Thursday, 13th of February 2003

 

 

          About 9 a.m. at the office of Usec. Calida, Secretary Nani Braganza, Secretary Datumanong, Chairman Jimenez, Usec. Calida and Atty. Ramon Cuyco was discussing on the writer’s concern.

 

          Secretary Datumanong gave instruction to Usec. Calida to make a verbal recommendation on the writer’s concern.

 

          Few minutes later the writer arrived, Secretary Datumanong had left already.  Usec. Calida suggested to the writer to go under their Witness Protection Program but the writer immediately disagreed with the Usec.

 

          Usec. Calida again suggested that the writer be employed by DOJ as a Security officer so that the subject can be able to protect himself, the writer again immediately refused with such suggestion.

 

          Secretary Braganza instructed Chairman Jimenez to secure the subject.  The group agreed that the subject has to be secured.

 

          The writer asked the group if they could guaranty the safety of his family, the group agreed that it is going to be hard.

 

          Then the writer asked them on the possibility of securing his family outside of the country.  Usec. Calida said that it’s going to need an executive directive for the family to be taken abroad and will definitely be outside of their jurisdiction.

 

          The writer left or walked out of the meeting for he thinks that he is just wasting time talking to them and that he is just exposing his self to danger.

 

 

Tuesday, 18th of February 2003

 

 

          Atty. Cuyco was invited for a meeting by Usec. Calida in his Office.

 

          The writer was very confused already with what is happening.  At about 10 p.m. Chairman Jimenez sent a text message to the writer informing him that they are doing every time and also rushing up the security details.

 

 

Thursday, 20th of February 2003

 

 

          President Arroyo requested for an audience with Chairman Jimenez but he did not show up.  The writer was confused on why wont the Chairman show up.  The writer learned about this during his lunch meeting with the Chairman and Gen. Romeo Maganto.  Said meeting was arranged by the General.

 

 

Friday, 21st of February 2003

 

 

          Confused, the writer started disregarding phone calls and meetings from all of them.

 

 

Monday, 24th of February 2003

 

 

          The writer received a text message from Atty. Cuyco, the forwarded message originally came from Chairman Jimenez “Please tell Ric to call or see Secretary Joey Lina, RE. Security Details” – The writer did not act on this request.

 

          The writer continued to disregard all calls and messages from Chairman Jimenez and rest except on Atty. Cuyco.

 

          The writer was thinking of not talking to them anymore but who would protect his family.

 

 

Monday night, 3rd of March 2003

 

 

          Threat and harassment continued, the writer had an incident on the road on his way home.  On his way, he called Leo Castillo of VACC to meet him in the Batasan Police Station.  It took a long way to lose the car that was tailing the writer.  The writer and Mr. Castillo stayed in the station for at least an hour before finally proceeding home.

 

          He was forced to seek assistance from the organization.  He started making calls.

 

 

Thursday, 6th of March 2003

 

 

          The writer brooked its silence and made contact again with Chairman Jimenez.

 

          Chairman Jimenez asked the writer for names of his intended PNP bodyguards.  He also promised the writer that he is going to see the President and discuss to her his concern.  He also told him that he is going to talk to the Appointment Secretary and request for an appointment with the president within this week.

 

          Later that day, Chairman Jimenez told the writer that he was going to met the President within today, unfortunately it was postponed due to the Davao Bombings and that the President has to go there immediately.  The writer also instructed Chairman Jimenez to make representation for him with DILG/PNP in regards to his security details.

 

          Earlier this day, Atty. Cuyco meets Secretary Tiglao and made a report concerning the status of the subject.  He also told Sec. Tiglao that the subject has closed his communication lines with Chairman Jimenez, Sec. Braganza, Sec. Lina and Secretary Datumanong and that it’s only him that he agreed to talk.

 

          Secretary Tiglao promised that the President would see Atty. Cuyco and the writer next week.

 

 

Friday, 14th of March 2003

 

 

          In Manila Hotel, Chairman Jimenez and Atty. Cuyco talked about the concern of the subject.  Chairman Jimenez was briefed on the status of the subject.  After few hours, Chairman Jimenez finally made a call to the President.

 

          Atty. Cuyco called the writer and asked him if he would agree to see the President in about 30 minutes.  Luckily the writer was in the area., the writer agreed to see the President but he would only see and talk to the President if Atty. Cuyco is with him.

 

          The writer met the President in one of the rooms in the Palace.  He met the President with Chairman Jimenez and Atty. Ramon Cuyco at about 11:45 a.m.  The President left Sen. Raul Roco in the other room just to see and talk to the writer.  The writer and the President talk about the concern of the writer.

 

          The writer told the President of his fears.  The President also asked the group on what would had happen had the subject signed on the sworn statement.

 

          “If the subject would sign on the sworn statement, this would be a clear proof that the case against the former President will be a mistrial” said Atty. Cuyco.

 

          “What would happen with the case” said the President, “the case will be dismissed and according to the law, once the case is dismissed he has to return back to his original position, which is the president” said Atty. Cuyco.

 

          The President paused for a few seconds and asked the subject on how this could be prevented and what can she do.  The writer simple told the President that his family is to be secured first before further discussion.  He also told her that if any of his family is taken by bad elements, he would definitely cooperate with them and he will sign any documents that they would prepare.

 

          At that time, the subject and his family did not have any security details.  “Who is taking care of the security details of the subject?” President said.  Chairman Jimenez said that he is still coordinating it with the PNP.

 

          The writer told the President that he no longer feel safe anywhere in the country and that it would be better and safer if his entire family be secured outside of the country.  The President agreed and asked the subject on which country would he like to be relocated.

 

          The President called in the group commander of the Presidential Security Group (PSG), Col. Bangit.  The Colonel was instruction to be in charge of the security and relocation of the entire family safely.

 

          Presidential Protocol Assistant Secretary Cecile Rebong was instructed to make representation with Department of Foreign Affairs in securing travel documents  for the entire family and office appointment or office order for the wife of the subject in working in one of the Philippine Consulate office.

 

          For economic consideration and for the subsistence of the family abroad, the wife of the subject was directed by the President to be transferred from her original work in the Philippines to the consulate office in the country of the writer’s choice.

 

          While the economic package of the writer to be discussed to the Presidential Chief of Staff, Sec. Bobi Tiglao by the subject after the family has been relocated.

 

          On the physical security requirement of the subject, the government or the administration shall provide safe house/s and the expenses shall be for the account of the government.  The closed in PNP security of the subject shall be of the subject choice.

 

          The writer also discussed with the President on how his sister affected in her office by the status of the subject, the president agreed to help his sister.  She look the name of the sister and wrote it down and promised to help her.

 

          The President and the writer talked about the case of former NEA Administrator Manuel Luis Sanchez, the President was also surprised to find out that the wife of the former NEA Administrator is working in her office.

 

          The writer and the President talked about the alleged wives of the former NEA Administrator, the latest allegation of the former Administrator to the President concerning the passage of the EPIRA law.  They talked also about the lifestyle of the former Administrator.

 

          The writer briefs her also on the cases he filed against the former Administrator even before she took office as the President.

 

          The President, upon learning that all of the documents concerning the cases the  subject is handling are being stored only at his house, the president requested the subject to move it to a much safer place, which she said, should be in the palace.  The writer agreed.

 

          Secretary Bobi Tiglao was appointed as the point-man for the President and the writer.  He was the choice of the writer.

 

          The President instructed Chairman Jimenez to discuss immediately with Secretary Tiglao,  all the subject that has been just discussed and agreed upon.  The President called Secretary Tiglao and told to see the group immediately.

 

          Many subject had also been discussed by the President and the writer, the meeting lasted for about 45 minutes.  The President look her lunch during the meeting.

 

          The group left the palace at around 12:30 p.m.  Outside of the Palace they met General Larry Mendoza and Secretary Jimenez.

 

          Chairman Jimenez, Atty. Ramon Cuyco and the writer proceeded to board the Barge and crossed the writer to the PSG ground.  A lunch has been prepared for the group in the cafeteria, just adjacent to the small golf course.

 

          At about 2 pm, the group returned back to the Palace, in the office of Secretary Bobi Tiglao.  The group relayed to the Secretary the matters and instructions of the President.  They were with the Head of the PSG, the PSG Commander called on Major Boyet Baraquel, his Chief Counter Intelligence to attend also the meeting.  Assistant Secretary Nick Conti was also present in the meeting.

 

          The group talked about the reassigning of the writer’s wife in the Embassy of the country of the writer’s choice.  The writer was also requested to help the President in the Lifestyle Check Office.

 

          Secretary Tiglao  even told the writer on why he should support and stay with the administration and that the whole arrangement must be treated with strict confidentiality.

 

          Secretary Tiglao also suggested that the VACC should issue a press statement concerning the cases about “Former NEA Administrator Manuel Luis Sanchez”.

 

          The writer coordinated with Assistant Secretary Conti in bringing in all his files/documents from his house, as requested by the President.  They agreed to meet at the Araneta Avenue home of Assec. Conti at about 7 in the morning the next day.

 

          Later that evening, the writer started photocopying the documents and started meeting his closed friends.  He was not convinced on the sincerity of the people he was taking.  He only trusted one of them.

 

 

Saturday, 15th day of March 2003

 

 

          At about 4 a.m. the writer prepared and packed up in two big boxes the files/documents from his personal files at home.  With his driver, they proceeded to the house of Assec Conti in Manila along Araneta avenue.  He met Atty. Cuyco near the place of Assec. Conti, before proceeding to the house.  The boxes were unloaded and place at the rented second floor house of Assec. Conti and they Atty. Conti will take care of it in transferring the files to the Malacanang.

 

 

Tuesday, 18th March 2003

 

 

          Assistant Secretary Conti, Atty. Cuyco and the writer met at room 419 of the Mabini Hall, Malacanang, one of the offices of Assistant Secretary Conti.  The “documents’ was already in that office.

 

 

          The writer was again asked by Assec. Conti, on the cases about the former NEA administrator.  The writer showed to them the how to counter the expose of the former NEA official.

 

          They talked about the Presidential Directives and agreed to make an “AIDE MEMOIRE” for it.  Atty. Cuyco prepared it and was signed by Assistant Secretary Nick Conti, it was dated as 18 March 2003 and was addressed to the Secretary, it had a heading of “CONFIDENTIAL” ( a copy is hereto attached).

 

          Afternoon in Holiday Inn Hotel, United Nations Avenue, Manila, Assec Conti suggested to the writer to make a detailed quantification list of the  request for the President and the letter should be send through Secretary TiglaoAssec. Conti instead agreed to make the list for the writer.

 

          Chairman Jimenez arrived at the place and the writer was to leave immediately once the Chairman arrives, as agreed between the writer and Assec. Conti.

 

          The writer never knew what has been discussed by Chairman Jimenez and Assec. Conti.

 

 

Wednesday, 19th of March 2003

 

 

          In Camp Crame, Chairman Jimenez talked to the Director of the Police Security and Protection Office (PSPO) Gen. Prospero Noble.  The Chairman relayed the name of the requested choice of PNP bodyguards.

 

          The Chairman relayed to the writer that the Mission Orders for the selected bodyguards are now being prepared.

 

 

Thursday, 20th of March 2003

 

 

          One in the afternoon at Officers club, Camp Crame Aguinaldo, Quezon City, the writer and Chairman Jimenez had a meeting.  They talked about on how the writer felt when he was basically abandoned by the group, especially when there were so many demolition job on him and that the Chairman never lifted a finger to defend the writer.

 

 

Thursday, 21st of March 2003

 

          At about 1:30 in the morning, while the entire family of the writer was asleep in their house, uninvited guest arrived.  The writer was force to cooperate for fear that they might harm his family.  They were all armed and determined to secure and get a particular document from the writer.  Papers were all scattered in the dining and living room areas after the  guest left.  The guest keep on asking the writer if where the documents are.  The writer told them that all his documents are all there and asked them if what particular documents they are looking for.  They even looked in his car.

 

          The writer assumed what particular documents  were they after, he promised them to meet later that morning in Sulo Hotel and promised to bring it with him.  That was about 2:00 in the morning that the guests agreed and left the place.

 

          The guest left the place with a threat to harm al of then if he will not show himself later.

 

          Minutes after and still trembling in fears, the writer started calling for help, they decided to leave their house at about 4:00 in the morning, taking with then their two cars and few important things, the family proceeded to the compound of the House of Representatives in Batasan Complex.  The family look their  breakfast in the parking lot.  The family was very tired and with only few hours sleep and bodies still trembling.  The complex was heavily guarded by military personnel and was the nearest secured place to hide.

 

          At about 6:00 in the morning, Presidential Security Group (PSG) personnel headed by Capt. Willy Gonio fetched the family.  The PSG personnel were with 2 unmarked vans.  The writer instructed to ride with Capt. Goni in their van and plate numbers of his cars was removed.  The group traveled in convoy.

 

          The group proceeded first to the office of Major Boyet Baraquel; the Major received a confidential fax message from Assistant Secretary Conti.  And the writer was made to make a brief report on his self, family and about his house.  There was some information that was revealed only to Major Baraquel.

 

          The group proceeded to a “safe house” inside the Malacanang grounds, it was near the gate (near Mabini Hall) and near a river overlooking the road.

 

          The place had no electricity and only two very small rooms, the  rooms had two double deck beds each and had even no electric fan.  The doors were made of a plastic.  The rooms were directly in clear view to the road on which even public utility vehicles pass through.  In short, the place was not safe and even too uncomfortable.

 

          After complaining, the family was transferred to Grand Boulevard Hotel, booked in rooms 350 and 352, using the name of Mr. Alex Moreno as instructed by Capt. Gonio.  It was only at this time that the family was able to rest comfortably.

Saturday, 22 of March 2003

 

 

          Morning at the Hotel, Capt. Gonio checked on the family, so far everything was normal.

 

          Later in the afternoon, Atty. Cuyco arrived in the Hotel and was briefed by the writer on the latest incident.

 

 

 

Sunday, 23rd of March 2003

 

 

          Capt. Gonio called, told the writer that they will be transferred another location in the afternoon of the next day.  The writer also informed Chairman Jimenez, Assec Conti and Atty. Cuyco of the plans of PSG.

 

          Capt. Gonio also said that Col. Bangit was asking for our Visa applications.

 

 

Monday, 24th of March 2003

 

 

          The group left the Hotel to move to another location.  They directly proceeded to the PSG compound, office of Major Baraquel.  They were told to wait and just stay in the area.  The writer noticed that something was wrong, after more than four hours or waiting, the family hurriedly left the place and ignored all calls from the PSG.

 

          The writer told Chairman Jimenez, Assec Conti and Atty. Cuyco on his sentiments against the PSG and told then that something was wrong.

 

 

Wednesday, 2nd of April 2003

 

 

          Intercon Hotel, with wife of the writer and PNP bodyguards, met Chairman Jimenez and informed him of a probability on why the PSG maltreated the family.  The writer brought out a document that showed that one of the 18 NEA respondents in one of their cases is the brother of Col. Bangit.

 

          The writer told the chairman that this would only be the most logical reason on why they are being treated like this.

 

          The writer also told the Chairman about the “guest” that went back to their vacated house said persons were asking questions that were supposed to be known only by PSG.  The Chairman ignored this information

 

          Few minutes later, Chairman Jimenez received a call from former President FV Ramos.  We were invited to attend a birthday party for the other President.  The party was held in the RCBC Plaza in Makati.

 

          Aside from the former President, we also meet Secretary Braganza, Secretary Reyes, former Senator Shahani, former Secretary Raul Roco, PNP Chief Gen. Ebdane and several other more personalities.

 

          Days, weeks, months pass by.  With so many threats, harassments, moving places, several hours on the road, more meetings and changing PNP bodyguards several times.

 

 

Wednesday, 25th of June 2003

 

 

 

          Music Room of the Presidential Palace, the writer and Chairman Jimenez with President Arroyo.  It was at this point that the President was very angry at her officials on why the family of the writer was still in the country.

 

          She called up Assec. Rebong on her mobile phone and in loud voice she was questioning her on why the family was still here.  Why until now after almost five months since she gave her order.

 

          She also called Col. Bangit and was also very angry.  Col bangit was also talking about the “documents” that was supposed to given to hi, from the writer.  He was telling the President that the writer did not moved or transferred his files at home to the palace.

 

          Chairman Jimenez told the President that the colonel is wrong for the files had already been moved a day after their first meeting.  Then Chairman Jimenez showed to the President documents that shows that one of the respondents of the cases filed by them at the ombudsman was his brother, Mr. Edgardo Bangit and a co-respondent of former NEA Administrator Manuel Luis Sanchez.

 

          The Chairman also told the President that this must have been the reason on why the family of the writer is being given a run around by her officials.

 

 

Thursday, 3rd of July 2003

 

 

          Presidential Protocol Office, at about 1:00 am. had a meeting with Sec. Rebong, the Assistant Secretary gave to the writer seven (7) sets of Diplomatic/Official passport Applications.  She also told him that they are tentatively scheduled to leave by mid-July.

 

 

Morning of the 24th of July 2003

 

 

          The writer and his wife were made to report to DFA to sign on their Visa applications.  As official from the Office of the Secretary told the writer that they have to come back at about 2:00 in the afternoon, by that time all of their passports will already with visa.

 

          Later in the afternoon, Secretary Tiglao called the writer and asked that he be met as soon as possible.  The writer met the Secretary in a law office in Greenhill’s, San Juan.  There was a party in that place and the Secretary handed to the writer seven (7) Official Passports with visa on it.  Atty. Cuyco arrived in that party also.

 

          The writer arrived in the party with his wife and 2 PNP Bodyguards.  The Secretary told the writer that in compliance to the Presidential instructions, he is personally handing to him all their passports with a diplomatic visa.

 

          This was also the day that there was a ambushed on a Customs official and that the Official survived but unfortunately one of his companion did not make it.

 

 

First week of August 2003

 

          Assistant Secretary Nick Conti was confined in Makati Medical Center.  The writer visited the patient in the hospital.

 

 

 

Friday, 8th of August 2003

 

 

          Room 758 of the Makati Medical Center, the writer met the travel agent named Fatima (cousin of Assec. Conti).  The writer got their plane tickets.  Fatima told her cousin that she got the payment for the tickets earlier that day.

 

          Assec. Conti told the writer to go to his family and prepare their things and also instructed the writer to meet him the next day for he will give him the pocket money as seed money for them.

 

 

Sunday, 10th of August 2003

 

 

          Scheduled flight of the family, Assec Conti met the family in the Airport with the seed money as sent for them from the President.  Assec Conti showed to the writer a computation on the expenses and that the President gave One Million Pesos all in all and that the remaining amount is equivalent to U.S. $14,000.00 and he handed it all to the writer.  Assec. Conti was with his girlfriend, the writer knows her also.

 

          The family arrived in Canada safely.  They might have escaped from the physical threats and harassments, but the writer is still in shocked on why they agreed to be relocated and hide the truth.

 

          To verify some issues, writer himself went back to the Philippines twice in 2004 and found out also that most of his cases in the ombudsman was allegedly dismissed.  He also noticed that corruption was present in a much bigger magnitude and that the situation in the country was getting worse everyday.  Many concern individuals tried to see him and relay to him so many disgusting things that the government are doing, but only a few was able see him.

 

          Allegedly, most of the large anomalies always involved with the government officials in the palace.  Betrayals, destabilizations, crimes, drugs, smuggling, bribery, kidnappings, corruptions, bombings and conspiracies were the usual headlines in the newspapers.

 

          This prompted the writer to do this hoped that this would be a start of a better reform for the Filipino people.  This information may have been long overdue but the writer has to do this to make sure that all aspects are considered correctly and religiously.
