V/V PHẢN ỊỐI HIỆP ƯỚC BIÊN GIỚI VIỆT - TRUNG
Ngày 30/12/1999 và ngày 25/12/2001, Trung Quốc và Cộng Sản Việt Nam đã
ký kết hiệp ước biên giới và hai hiệp ước lãnh hải, làm thay đổi
biên giới lịch sử giữa hai quốc gia và làm mất đất đai của Việt Nam.
Các hiệp ước này đe dọa nghiêm trọng cho sự toàn vẹn lãnh thổ và
quyền lợi của Việt Nam và đã được lén lút ký kết mà không hề có
ý kiến của người dân. Trái lại, hai chính quyền cộng sản này hoàn
toàn không do dân bầu lên. Tệ hại hơn nữa, nó lại được xác nhận bởi
quốc hội không do dân bầu, mà do đảng cộng sản đã chọn lựa trước
khi được đưa ra trong một cuộc bầu cử độc diễn của đảng CS. Hiến
pháp của họ cũng vi phạm các nguyên tắc căn bản về nền dân chủ.
Hơn nữa, kể từ năm 1954, đảng CSVN thường xuyên vi phạm và xé bỏ
những hiệp ước, tuyên ngôn quốc tế mà chính họ đã ký kết.
Lãnh thổ và lãnh hải của một nuớc là thuộc về toàn dân. Không cá
nhân nào, tổ chức chính trị nào, hoặc chính quyền nào, dù bất cứ
với lý do gì, có quyền đổi chác quê cha đất tổ để bảo vệ độc
quyền chính trị của mình. Điều hiển nhiên là chính quyền CSVN chỉ là
một tổ chức phản dân chủ, bất hợp pháp và không tôn trọng pháp luật.
Loại chính quyền như vậy sẽ không có đủ thẩm quyền nhân danh đất
nước và dân tộc Việt Nam để ký kết bất cứ hiệp ước nhượng đất đai
nào cho ngoại bang.
Không người Việt Nam nào bất kể nơi cư ngụ, quan điểm tôn giáo và
chính trị hoặc tổ chức, lại làm ngơ truớc sự kiện sang nhượng đất đai
mà tiền nhân đã dầy công tạo dựng từ đời này sang đời khác. Mỗi
con dân Việt Nam còn yêu quê hương, yêu lẽ phải, yêu tự do và nhân
phẩm không thể ngồi yên làm thinh. Họ phải phản kháng những việc
làm sai trái ấỵ
Chúng tôi, ký tên dưới đây, cư ngụ trong và ngoài nước, đồng thanh
tuyên cáo cùng thế giới:
Hiệp ước Việt - Trung về biên giới và lãnh hải nói trên hoàn toàn
vô giá trị đối với nhân dân Việt Nam; hoàn toàn bất hợp pháp đối
với công pháp quốc tế; và hiển nhiên đe doạ hoà bình và sự ổn định
của vùng Đông Nam Á Châụ Chúng tôi hoàn toàn bác bỏ và cả quyết
rằng các hiệp uớc này sẽ không đuợc phép thi hành và xin tuyên cáo
rằng chúng tôi có quyền bảo vệ đất đai của quốc gia chúng tôi bằng
mọi cách.
Nhân danh công lý, tự do và phẩm cách của mỗi con người và của 80
triệu nhân dân Việt Nam, cũng như lợi ích của nền hoà bình, ổn định
vùng Đông Nam Á, chúng tôi yêu cầu Cộng Đồng Thế Giới, Liên Hiệp
Quốc, và mọi Chính Phủ tự do hãy ủng hộ việc thành lập một chính
quyền dân chủ, hợp pháp tại Việt Nam. Chúng tôi cũng kêu gọi quý
vị hỗ trợ quyền được tự bảo vệ sự toàn vẹn lãnh thổ của dân tộc
Việt Nam chúng tôị

DECLARATION TO THE WORLD COMMUNITY
ON REJECTION OF SINO-VIETNAMESE BORDER AGREEMENTS
On December 30, 1999 and December 25, 2000, the People Republic of China and the Socialist Republic
of Vietnam signed one Sino-Vietnamese land border treaty and two territorial
waters agreements, changing the historical borders between the two countries
and inflicting a great territorial loss to Vietnam.
These treaty and agreements present a serious threat to the integrity and
benefits of Vietnam and were made despite the fact that they were never opened
for public knowledge and discussion. Instead, they were signed cunningly by the
self-imposed leaders of the communist government, none of whom is directly
elected by the people.ï Worse, they were rubber-stamped by the National
Assembly which does not truly represent the Vietnamese people, as its members
are chosen by the communist party before being elected by the people in
monopolistic one-party elections. Even the Constitution is drafted and
implemented in violation of the fundamental principles and procedures of a
democratic constitution. Furthermore, since the 1950 the Vietnamese Communist Party leadership has constantly violated
and willfully rejected numerous international agreements and covenants to which
Vietnam is a signatorỵ
National land and sea territories belong to the peoplẹ Whatever the pretext or
pretense, no one, no political party or government has the right to exchange
their forefathers land for monopoly of political power. This is particularly
self-evident in the case of the Vietnamese government, an undemocratic,
illegitimate and law-breaking institution. Such a government has been endowed
with absolutely no right to sign, on behalf of the nation and the Vietnamese
people, any agreement to relinquish territorial rights to a foreign countrỵ
Regardless of residency, religious or political leaning or association, no
Vietnamese can ignore this sellout of their national territories, obtained and
safeguarded by their forefathers generation after generation. Each and every
person of Vietnamese descent who loves Vietnam, justice, freedom and dignity
cannot keep silent and must protest these wrong doings.
We, the undersigned, living inside and outside Vietnam, solemnly declare to the
world:
The above-mentioned Sino-Vietnamese land border treaty and territorial waters
agreements are considered totally invalid by the Vietnamese people, undeniably
illegal under international laws and obviously posing a threat to the peace and
stability in Southeast Asiạ We reject and assume no obligations to implement
these treaty and agreements, and declare the rights to defend our national
territory by all means.
In the name of justice, freedom and dignity for each and every human being and
for 80 millions Vietnamese, as well as in the interest of safeguarding peace
and stability in Southeast Asia, we urge the world community, the United
Nations, and all democratic governments to support the building of a legitimate
and democratic government in Vietnam. We further call for their support of the
rights of the Vietnamese people to defend their national territorial integritỵ
