Allegation 3
OK This is the biggie.
This is the Albert Means Part of the Hearing. The 1st part of the hearing Johan
lays out what the NCAA and Alabama agree on. They are:
1) Lang did shop Albert Means.
2) Lang solicited coaches for cash and for vehicles.
3) Albert Means signed a National Letter of Intent with Alabama.
Where Alabama & the NCAA differ are:
1) did Young offer $115,000 and
2) did Young provide at least three cash payments of $10,000 to Lang in order to
secure Means' commitment to attend Alabama?
Now the next 100 or so pages of the transcript deal with trying to prove or in
Alabama's case disprove what’s above. Basically The NCAA uses Kirk as the basis of
their claim and everybody else to back up what Kirk says. Kirk says a couple of things.
1) In the spring of 1999 he & Lang devised a plan to market Albert Means.
2) The initial plan had SUVs for Lang & Kirk & cash.
3) The plan was presented to Ivy Williams.
4) Kirk says in August of 1999 Lang says there was a call from Logan.
5) Kirk says in September of 1999 he’s contacted by Botto.
6) The purpose of Botto's contact is Botto thinks Lang can't be trusted. BOTTO LINK.
7) Early October at practice Botto comes & picks up Lang to visit Logan.
8) After Practice Kirk and Lang & stop at the Union Planters Bank.
9) Kirk sees him take an envelope full of Cash, & deposits it in the night box.
10) They go to a strip joint the King of Clubs & Lang tells Kirk "Young bought the deal."
11) Lang says, "we've got to get our own SUV's. He doesn't want a trail. We got to use
cash."
12) Kirk agrees. "Well, cash. Yeah, that's a better deal. You can't trace cash."
13) In November Kirk makes a call to George Mitchell to set up Lang's SUV deal.
14) Lang screws Kirk out of the cash & the SUV so Kirk whines to BOTTO, YOUNG, IVY,
etc.
This is all of Kirk's crap. Now lets move on to Culpepper.
OK at this time in the hearing they describe Culpepper. All of his recruiting crap,
expert at this & that etc. What I found really interesting was how they described
Culpepper drove Logan back from the Orange bowl. Without quoting the transcript it
says He drives Logan Young back from Miami to Birmingham in his Jaguar.
Whoa STOP RIGHT HERE!
Lets go back to Allegation #1 shall we?
In allegation 1 JOHAN describes his trip to Logan’s Bank in Memphis. Johan
says something like I think what impressed Professor Marsh and myself on our trip to
Memphis is when Kenny's Dad described his trip to Memphis with Wendell Smith he said
he went by that building that didn't look like a bank he says, [Page 110 of transcript]"This
is where Wendell Smith told me that he was going to meet Logan Young." He said, "I saw
the Jaguar in there. It was a dark color."
I just thought that was a interesting coincidence with the Jaguar. Has anybody
ever checked to see what color Jaguar Culpepper owned at the time? Well it seems that
Logan TOLD Culpepper a few things during the trip back from the Orange Bowl. What
made it in the hearing was:
1) Young comes right out and tells him he bought Albert Means.
2) Young gave $40,000 to Lang, $40,000 to Kirk, and $35,000 to Ms. Means
3) Logan is giving cash payments to Tim Thompson.
4) Logan has a black guy in Memphis both coaches trust that’s the bag man.
5) Logan goes over to the casino in Tunica laundering it through there.
6) Logan tells him he bought every player Alabama signed out of Memphis since 1994.
To my Surprise that is it. That's all Culpepper had. Not much to me. All of it
hear-say WHEN LOGAN was Drinking. They only used Culpepper's testimony to back
up Kirk. The Next person the NCAA uses to back up KIRK is Wayne Randall. Wayne
Randall is a high school coach over at East High School in Memphis. I had not heard his
name until reading the transcripts. Anyway his story is weaker than Culpeppers.
Basically he says:
1) Kirk came over spring of 2000 saying he got screwed out of his vehicle.
2) Kirk said Lang wasn't doing anything for the mother.
3) After asking Lang in fall 2000 he tells Randall how he marketed Means.
4) How Lang got in good with the mom, so he would know where the kid was going
to go to school.
5) Lang also told Randall he got a $10,000 payment in Nov. Dec. & Jan.
Told you That was weak. It was all hear say as well. The Next person the NCAA
uses to back up KIRK is Pat Washington from the University of Tennessee, and Kurt
Roper, who is from Ole Miss, they also corroborate Kirk regarding the initial scheme.
Basically they tell Johan:
1) both Washington and Roper are presented a plan from Lang in May of '99
2) both coaches said they were asked for a SUV & cash for Lang & Kirk & cash for
Means' MOM.
Now, we get to two other coaches, Brad Lawing, who is an assistant coach at
Michigan State, and Fitzgerald Hill, who was then an assistant football coach at
Arkansas. Both of these guys amazingly get propositioned by Lang on the same day in
January. They both report that Lang asked them for $200,000 cash.
Lawing ask are people entertaining this?" Lang tells him, "Hey, I've already
gotten $50,000 from one school." He says, "Albert is going to a school that's going to
ante up." Then he goes on to say, "And you're going to know what school that is on
national letter day."
Now, Fitzgerald ask what's going to happen if no school comes up with the
money?" He says, "There's a school already in & Alabama is all about business."
If That wasn't a set-up I don't know what is. Anyway,
Johan gets Kirk to Call Mitchell the car dealer at Dyersburg Ford to see if he'll
talk. He basically says F*** Off. So Johan & Bill Sievers go out there later on & Mitchell
isn’t there. They talk to a guy named McDowell a sales rep & he got all the records for
the LANG SUV Purchase for Johan. It of course came pretty close to the crap Kirk was
spewing so that was taken as Gold.
Now if you can believe it At this point of the hearing Johan says that Young's
involvement in Allegation No. 1 also helped convince us that he is involved in this
allegation. I think I have already made Swiss cheese out of allegation #1.
Now we get to Duke Clement an individual that was in Logan Young's social
circle. Duke grew up with the woman that Logan Young was dating. Duke Clement tells
us that Logan told him he is getting DuBose the best players, buying him the best
players, and if he doesn’t win, he's going to be gone. Anyway Duke says something like
"Logan, aren't you worried about getting caught? He said, "No, I'm too smart. I'm much
smarter than the NCAA."
At this Point Johan talks about Rip Scherer & how he had been a great help to
him getting all this information. The big thing is Johan says something like "Milton Kirk
tells Rip Scherer, "I want to cooperate and I want to tell the NCAA the truth, but
I'm worried about Albert. What happens to Albert? If Albert can't play at Alabama, do you
think he can come to Memphis and play?" What a crock of Shit. Then Johan says in mid
December of 2000 Kirk called & He was all shook up. Kirk evidently had been reading
newspapers and listened to Finebaum and all of a sudden, he connected Lewis Allen as
Logan Young's attorney. In his voice mail in early December was a call from Lewis Allen
saying, "I want to talk with you." What does Logan's lawyer want to do with me?
Johan goes on to state at this time There were beginning to be rumors, because
Lang had his SUV & Milton had gone around town bitching about being cut out. The next
thing we know Rip Scherer calls me at the American Football Coaches Convention and
says, "Rich, Milton has talked to the Memphis papers. It is breaking tomorrow." That was
around the second week in January. That's really basically when the FBI and everybody
else got involved was after that newspaper story. Question was this the CFA convention
that the PHAT ONE - Phillip Fulmer was Elected President or Nominated to head up
Ethics or something?
OK Alabama's response starts with Hillard thanking everybody blah blah blah.
He admits it meets the burden outlined in Bylaw 32. Hilard then states Alabama felt that
it didn't meet that burden of Proof in direct evidence as it relates to the two issues.
Did Logan Young provide $30,000 to Lynn Lang?
Did Logan Young offer $115,000 to Lynn Lang?
Hillard says Alabama could not meet that but wanted to make sure that the COI
understood Alabama was not contesting the allegation. Hillard also wants to make it
clear to the Committee that Logan's disassociation should send a message not only to
Mr. Young but U of A as a whole as it relates to his activity. Moreover we believe it is
unacceptable behavior as a representative of the institution's athletics' interests.
Hillard just makes 4 points Allegation No. 3.
1) Milton Kirk.
2) The source(Tom Culpepper).
3) Phone records
4) notice issue or access to information. As it relates to Milton Kirk.
Hillard then goes on about how Johan alluded to the core story & it does not
change. He does ask Did the event happen? Hillard even states Our troubling aspect of
Milton Kirk's testimony is our events leading up to the core and the inconsistencies as it
relates to events leading up to the core story. Hillard states where Alabama was troubled
the most was by information that Kirk had reported that in some instances were violations
that we don't see today for whatever reason (other schools). Then he talks about the
pitch by Lynn Lang to respective recruiters.
He then hones in on Culpepper. Hillard points out that Culpepper reported about
January of 2000, concerning the drive back from the Orange Bowl that Logan Young said
"I had bought Means giving Lang forty, Kirk forty, and Felicia Means thirty-five." The
trouble that we have with this is Felicia Means pitch emerges in the initial scheme But By
fall of '99 Felicia Means is no longer a part of the pitch & By December of '99 and
January of 2000, Felicia Means is no longer in the pitch, as is reported by Fitz Hill and
Brad Lawing and the pitch is cash up front of $200,000, and no there is mention of Mrs.
Means. Now If you are to believe the $30,000 payment in November, December, &
January of 2000, Young would have said to Culpepper, "I've given $30,000 to Lang." but
Culpepper is saying in January of 2000, 40 for Lang, 40 for Kirk, and 35 for the mom.
HILLIARD then addresses the access to information and also the notice issue
stating . It runs to a fundamental issue concerning, I believe even the enforcement
process. Hillard points out that In February of 2000, in an interview with Fitz Hill, up until
July of 2000, there are six interviews conducted by the enforcement staff as it relates to
Albert Means and the recruitment of Albert Means & the involvement of Lynn Lang & the
pitch. On July 27th is an interview with Milton Kirk. August 13th is the initial interview with
the Culpepper. Both provide critical information as it relates to Albert Means, Lynn Lang
and Logan Young. What Hillard and Alabama want to know is why wasn't that
information shared? Alabama gives the NCAA an out as far as information prior to
signing day. however After the signing date, from February until August, when Albert
Means enrolls, there was an opportunity to prevent or try to alert Alabama.
Hillard then points to the Michael Meyers case. Information was shared from The
NCAA to Alabama. Basically Alabama was told - I can't give you the source of this
information -- but FYI, you may have a potential problem. Gene Marsh and Marie
Robbins acted aggressively with that, declaring the individual ineligible.
Then Hillard points out that maybe The perception of Alabama is pre-'95, but
Alabama compliance is at a post-'95 level. The 1999 Beamon case being a perfect
example. In the 1999 case Mal got a call 2 boosters and could have not done anything
with that at that time, but followed up on it to the point that it did result in an infractions
case. He points out that in Allegation No. 7 as it relates to the letter from Steve Spurrier
& Mal calling the Florida, asking "Help me with this if there is a problem, I want to know
about." The culture and the climate of compliance of the institution HAS CHANGED as a
result of Dr. Sorensen, Marie Robbins, Gene Marsh and their commitment.
HILLIARD is questioned a bit then points out again If from February 2nd, 2000,
the signing date, to the point of enrollment, if Alabama had been alerted of the potential
violations or problems with the recruitment of Albert Means, I believe that Marie Robbins
and Gene Marsh would have reacted to that information consistent with the way they
have acted in previous situations.
Ok at this point in the hearing Yeager makes the statement Somebody
was going to end up in this room out of this kid. It was just a matter of who.
So KRAMER has to respond to that. We did have information from one assistant
coach (Milton Kirk). We had no other information at that point. We never developed
any of the information that has been presented here today because none of that
came to us.
In hindsight, should we have done that? I will take full responsibility for that.
Based on that, I don't think the university should have that liability. I will take the full
responsibility for that. I made that decision. OK Roy why wasn't you one the bending
over at the end of this damn Spanish inquisition huh? Anyway he blabs on about having
to protect sources etc. & how there was not an allegation @ that time against any single
one institution etc etc. He admits some small amount of investigating was done. Then
on Page 205] he says with a straight face in all honesty as you look at this particular
case the fact that Albert Means enrolled at Alabama should absolutely not be interpreted
as a shortcoming of their enforcement process or their compliance process. Give me a
F***ing Break! Roy you just F***ed Alabama & YOU KNOW IT! Here is the meat of
Allegation #3. I think Nobody here you will see is defending the booster Logan Young.
In Chapter 14 of "The Fall of The Tide"
I wrote I think now that Sorensen made a calculation along with Gene Marsh that
if they could mitigate the NCAA penalties and get rid of Logan, that they would finally
break the back of the football crowd. Starting from the assumption that we were guilty, it's
no wonder that we start talking about secret witnesses, Marsh aiding the NCAA by
allowing it, and conceding charges against Logan without any real proof. It all makes
sense in light of their attitude toward Logan and others who had traditionally supported
the program, Let the NCAA accomplish what you couldn't - run them off.
KRAMER goes on to defend Alabama with regard to whether Albert Means
enrolled at the U of A. He took responsibility on that issue. OK Roy why don’t you go
visit those 2 Tennessee Boosters in the Movie Pulp Fiction and let them give you your
punishment. Anyway He so much as admits he's involved up to his neck in this thing by
saying even today I can't or Won't give out all of the details as to why I did not inform
Alabama.
Ok at this point Johan's team chimes in & spews out allot of crap about how they
felt like they included Alabama earlier than they should have, and how Gene and Marie
should fell good about getting bent over & raped etc etc. Marie at this point is starting to
feel uneasy so she finally speaks up. She states how she signs off on each athlete
taking the field etc. & all Kramer had to do was call her & say look I cant tell you what or
why but you need to put Albert Means in a hold status. You know not play him. Even
SORENSEN is getting worried and he follows up Marie with a bunch of stuff about how
the integrity of this and the integrity of that has been harmed, I think for the first time it
hits him that hey I let this happen under my watch!
You got to love MR. JONES response to Kramer, I appreciate all that.
Nonetheless, We are here due to the actions of their own booster. When we investigate,
we are representing the rest of the membership to try to expose what is going on. We
owe Alabama only one thing & that’s to be fair & We think we have. He points out there is
no obligation to share information until we send out a letter of official inquiry, beating his
chest and tooting his own horn he states but share information we did way in advance of
the letter of official inquiry.
He then blabs on about Dabo Sweeney and Jeff Rouzie, who believed that
Logan young was responsible for getting four of their colleagues fired during one year.
Now, that may not be true. We don't know obviously But that shows you what we felt like
we were up against.
THUD! Here it comes. They now finally turn to Logan. The COI states not one
of us is too concerned about the certification part of this case what I think is more
important however is who is this Logan character & how did he get so much power?

Not too concerned about the certification part of this case! What the F***? I
thought that was what this whole COI was suppose to be about! It is right
here halfway through the transcript page 211. The COI admits right here
they already had there mind made up! Hell we are still on Allegation #3. I
have already made Swiss cheese out of allegation #1 & #2 & #3 is all just
HEARSAY. UN FREAKING BEILEVABLE!
Hell I'll Sum it up for the dumb Bastards.
1) Young is not a graduate of the University of Alabama.
2) He attended Vanderbilt, but I don't believe he graduated there.
3) He comes from a wealthy family & I gather he inherited allot of money.
4) He Ray Keller, was prescribed to get a hobby so he picked UA FOOTBALL
5) Young loved Coach Bryant. Who don’t.
6) Logan's got allot of Bear photographs and memorials of events.
7) He has given some money to BAMA. a $500,000 life insurance policy.
8) Buying high-priced tickets to football games.
9) When Alabama upper-decked the stadium he purchased a sky box.
SORENSEN then chimes in I am now in my sixth year as president of the
University of Alabama. During all the time that Coach Bockrath was our athletics director
and Coach Moore was out athletics director, never once in any conversation that I've had
with them, and I meet with them on a weekly basis, has Mr. Young's name been referred
to in any decision that we have made. He never enters the conversation. "There is no
conversation with members of the board of trustees at quarterly meetings with the board
of trustees and not once has any trustee ever had, in any circumstance, in a meeting or
outside of a meeting, said, I want you to do this because this is what Mr. Young would
want. Never, ever, once. You need to distinguish between what he says about his
influence and factual, concrete evidence about his influence on the dealings within the
athletic department and within the University. Seems as though his collar is getting a tad
bit tight don't it.
I happen to be privy to the decision to eliminate those four assistant coaches that
year I know precisely the factors that were weighed, how the decision was arrived at, and
how we arrived at the decision. Mr. Young was not involved.
The COI then ask if Logan could have contributed in any other way. Mal tells
them most coaches knew him to some degree and would be able to recognize him. There
were times when whoever recruited in that particular area, somewhere along the way
would cross his path or know him. Mr. Young owned the Memphis Showboats.
He is a very good friend with Jerry Jones(were Dead now for sure) of the Dallas
Cowboys. Mal tells them he attends maybe 3 or 4 practices a year. Logan attends most
of the away games so he might be in the same hotel as the team sometimes. Mal states
Logan has never been on a team charter etc.
OK after all of this crap Johan comes in to sling some mud. He states that Jeff
Rouzie told the NCAA that Coach Bryant instructed staff members to stay away from
Logan Young. Our understanding was Bryant actually threatened their jobs if they got
around Logan Young. Rouzie and some of the other coaches certainly believed that
there was a change when Stallings
left and DuBose came in. Jeff Rouzie states that all of a sudden Logan became much
more visible than he had been with Stallings. A COI member actually ask What years
were those instructions given?
JOHAN of course replied Excuse me? (Dumbass I'll bet you it was at
least 20 TWENTY FREAKING YEARS AGO!) I'm starting to like this DEE
character a little.
So He ask Johan the obvious?
Can you explain the relevancy of that comment?
Johan stumbles through a Rouzie explanation Yeager tries to bail him out by
getting Mal to admit he heard Bryant say it too. However Mal just told the Committee
Bryant told them to stay away from everybody & Stallings was allot like BEAR. J They
then ask Mal about the Ivory Club level Tide Pride. Mal tells them it was $2,500 a seat at
the time. For some reason this DEE guy wants to know how many members in the Ivory
club level - 200 or about 1000 people.
OK I am now supposed to argue this allegation. For the life of me I do not understand
why It ever seen the light of day but I’ll make a few points:
1) Everything Kirk told Johan was hearsay testimony.
2) Why Did Logan use Kirk's man(Mitchell) to do the Auto deal when he could have used
his guy from Missouri?
3) Kirk was never present during any of the phone calls or meetings.
4) If there was a deal for Means why so many phone calls? Was there a bidding war or
something? If so who all was involved.
5) Culpepper Drove Logan back from the Orange bowl. Big deal.
6) A Drunk, Logan says he bought every player from Memphis since 1994.
7) Logan also Says he Gave Lang-40 Kirk-40 and Felecia-35.
8) Where's the Money? Show me the Money?
9) The BOTTO Connection.
10) This is all Hearsay too.
11) What about Culpepper's car being a Jaguar & Kenny's Dad seeing a Jag at Logan's
Bank when they went to go get the money?
12) Randall the High School coach, Hear say upon Hear say Give me a break.
13) Why the obvious calls to Michigan State and Arkansas to setup BAMA?
14) Why bring up Crap from Bryant years? That’s over 20 years ago!
15) Rouzie & Sweeny would have no reason to lie I'm sure. NOT! FIRED!
16) Scherer Same thing, Curry Fired his sorry ass too.
17) Think old Rip was trying everything he could to get Albert at Memphis?
18) Kramer States on Page 205 “in all honesty as you look at this particular case the fact
