Allegation 1
               JOHAN thanks everybody after that he States, we will go on with Allegation #1
It involves improper contact, the provision of entertainment and lodging and offers 
of and provisions of substantial cash payments to Kenneth Smith, Jr. and the young
 man's family by boosters, Ray Keller, Wendell Smith and Logan Young.  Both the 
NCAA and Alabama are in agreement as far as the facts and that violations had
occurred.
   
STOP RIGHT HERE!  Allegation #1 boils down to this one little line.  
 
U of A NCAA Compliance threw Logan Young, Ray Keller, and Wendell Smith under 
the bus right here. Alabama basically agrees that Logan paid for Recruit Kenny 
Smith jr.  Basically This is the situation.  The Kenny Smith Case is outside the statute 
of limitations.  This is Recognized by the NCAA & Alabama. 
               The NCAA is trying to get it in the Backdoor by saying the $ came from Logan
Young.  Their only witness is Kenny Smith's mom who by admission never met Logan.
Alabama said the $ could have come from Logan or R. D. Hicks.  Both agree that Terry
Bowden pointed out all this in 1996.  Now Hind sight is 20/20.  
1) We now know that Kenny Smith went to Tennessee.  
2) By his own Admission he committed academic fraud, & attended 10% of his classes.  
3) Fulmer knew this happened.  
4) The secret Witnesses in Allegation 1 are Tom Culpepper and Phillip Fulmer. 
5) Terry Bowden, I think I'll let this Article tell you whether or not he is a reliable witness.
 
               OK in the Transcript at this point Tom Yeager blabs something like it sounds like
in March of 2000, you were starting to get pretty solid information, maybe on a number 
of fronts. The preliminary letter doesn't go out until February of 2001, Can you help us 
a little bit? I mean, sometimes preliminary letters go out the day after something blows 
up in the paper on somebody.  (in other words why in the hell wasn't all this in the
preliminary letter?) Now The NCAA Investigators start to scramble but basically say 
they wanted to protect their "secret Witness." 
               What is really shocking at this point of the Hearing Mr. Jones actually admits 
The Preliminary Letter could have gone out as early as December of 2000 but 
they waited until February! To screw the Alabama recruiting class of 2001 no doubt.
               Alabama finally gets of their ass and starts to respond a little.  Basically we say 
In the original call, you have a guy who picks up the phone, and calls Tommy Bowden
and says, "Look, I've already given this guy an automobile. He is planning on going to
Alabama, but he wants to go to Auburn.  How are you all going to get him a car?"  Well,
Tommy goes to his big brother and says, "You won't believe what has happened to me. 
I had this call from up in Fyffe they basically want to get Auburn in a bidding war for this
young man to come here.        
               Indeed, Smith apparently calls back and reiterates the proposal.  In the course 
of these conversations to the Bowden’s, they talk about Wendell Smith. They identify 
a big logger. They don't call him Ray Keller, but that's who Ray Keller is, and this
character names R. D. Hicks.      
               When interviewed Hick says, "Yeah, it was my money. I paid the money. 
Wendell Smith came to me and said that he, Wendell Smith, wants to become the 
sports agent ultimately when young Kenny Smith goes Pro, and to do that he needs
some money to help out."  That's where the initial money came from, either in direct 
cash payments from R. D. Hicks to Wendell Smith.  The only condition that R. D. 
Hicks attached to providing this money was that he never tell the Smith family that 
he, R. D. Hicks, was the source of the money.  The reason is, I gather from our 
interview, that the Smith family by this time had become drains on the economic 
society of Stevenson and North Jackson, and R. D. Hicks didn't want to get into the 
dole line for that family any more. He wanted to separate himself from them.  So, 
Wendell Smith said the money came Logan Young. I think it is established in the 
record that Logan Young is actually the source of the money, but is contradicted at 
least two or three times in the record.  
               At this point of the hearing Tom Yeager Points out: OK JOHAN says the money
came from LOGAN and BAMA says the money came from R.D. HICKS.
DUHHHHHHHHHHHHHH!  So Yeager ask JOHAN for his best evidence on why 
he can say the money came from LOGAN.  Johan BLABS AWHILE but eventually 
says his it comes down to Vicki Smith Dagan, the mother of Kenny Smith jr.  
She actually says "I never met the man. I wouldn't know him."  
 
OK Hold it right here.  The NCAA is using this!  
 
               In all do respect Allegation 1 Shot Down by their witness admitting everything
she knows is second hand hearsay!
 
               To top it off Johan even admits that he is not disputing that Ken Smith, Jr. got
money from Mr. Hicks. He got a considerable amount of money. He was the one that
brought him from his high school in Tennessee, moved his family over there, gave them
cash payments, took care of the family.  Even that R.D. Hicks was providing the young
man handshakes after games and giving money to the family.  Johan even says However
we think there is no question in Vicki Smith's MIND where the money was coming from.
OK THATS IT!  THIS WITNESS IS TOAST, IN HER MIND, GIVE ME A FREAKING
BREAK.
               Also take into account that R.D. Hicks got in trouble with the Alabama High
School Association over payments to HS players.  Even Tom Yeager starts to ask
questions?  Like Obviously, you had information about Allegation No. 1, as March of
2000.   You had interviews with Logan Young later on that you didn't ask about any of
2001.   this and I guess what I am trying to figure out is what changed from the first batch
2002.   of interviews to the point when this became an issue?
               The only thing is within one month, there is a meeting in Nashville between
Kenny Smith and Mr. Young in his hotel room which was broke up by Mal Moore.  The
relationships between Keller and Young I think are concerning, because these are the
two people the NCAA highlighted from the very beginning of this case who were involved
in the violations.
               But Even JOHAN agreed with MAL's standpoint saying that Mr. Moore's account
is pretty much in line with what Kenny’s Dad told us, that they had been in there probably
no more than a few minutes prior to Mal coming in and once he came in, they did leave.
 
OK I think Allegation #1 has been pretty much been blown to hell.
