Incapacity
In general every one can make contracts but some don't have this power in full i.e. minors, mentally disordered, drunkards, diplomats, corporation. The aim of the law in this area is to protect those who are vulnerable but not restrict them from making contracts. If you do not have full capacity to contract you are said to be under incapacity.

Minors

The Family Law Reform Act 1969 - introduced the term minor and lowered the age of majority to 18

The law….Protects minors from their inexperience which may let adults take advantage yet tries prevent unnecessary hardship on adults who make contracts with minors fairly.

The Minors Contracts Act 1979 - codified the law on minors by replacing complicated statutes and restated pre-existing common law.

Minors contracts now fall into three broad categories
(I) Valid or Binding
(ii) Voidable
(iii) Unenforceable
