Account ("Account") during initial user session. Once registered, follow instructions to enter ten character Code exactly as it appears on game piece and click "Submit". Children 12 years old or younger will be required to obtain verifiable parental consent in the manner requested on website as a condition of registration and entry. Limit twenty (20) online Code entries per person per "day". A "day" will begin 12:00:00 a.m. EST and will end on the same day at 11:59:59 p.m. EST. The following conditions apply to all outgoing and inbound mail in connection with the Sweepstakes game. Mail bottle cap game pieces in a padded envelope or small box with sufficient postage to meet U.S. Postal Service requirements. Do not mail bottle cap game pieces in regular letter-style envelopes because they may burst in transit. Proof of mailing does not constitute proof of delivery. Mail received without a verifiable, legible return address may not be accepted. Submission of prize claim and/or mail-in entry is solely the responsibility of participant, who assumes all risk of loss, damage, destruction, delay and misdirection. Sponsor is not responsible for postage due, lost, late, misdirected, illegible, incomplete, damaged, torn or separated mail due to improper packaging of game pieces or incomplete processing of mail. Mail addressed to participant and returned to Sponsor as undeliverable without a forwarding address will result in prize forfeiture. 11. SWEEPSTAKES DRAWINGS:
Entries will be randomly selected in drawings conducted in accordance with the drawing schedule below to determine a total of one thousand (1,000) Sweepstakes winners who will each receive the Sweepstakes Prize described in Rule 13. Odds of an entry being selected in any drawing depend upon the number of entries processed for such drawing and the number of winners designated to be selected in such drawing. All entries processed prior to a scheduled drawing date will be entered into such drawing (see Rule 9 for mail-in entry processing time) and will remain eligible for all subsequent drawings, if any. Drawings will be conducted by an independent judging agency whose decisions in all respects shall be final and binding. All entries drawn are subject to verification. 12. SWEEPSTAKES NOTIFICATION:
All potential Sweepstakes winners will be notified by overnight courier and/or phone at the postal address/phone number provided with entry. Actual means of notification to be determined by Sponsor at its sole discretion. Each potential Sweepstakes winner must complete and return a signed Affidavit of Eligibility and Liability Release and other required prize acceptance documents ("Prize Documents") for verification by the due date specified by Sponsor in the Prize Documents, which due date shall be no less than three (3) days and no greater than ten (10) days from date of issuance. Potential Sweepstakes winner will automatically forfeit all right, claim and interest in or to a Sweepstakes Prize, including participation in Event (see Rule 15) and Sponsor shall have no liability or responsibility to award any prize in connection therewith or allow potential Sweepstakes winner to take part in Event if: (a) any required Prize Documents are not fully executed and received by Sponsor at the designated address by the due date specified in Prize Documents; or (b) if any mail addressed to participant is returned to Sponsor as undeliverable without a forwarding address or if potential Sweepstakes winner cannot be contacted for any reason; or (c) potential winner is deemed ineligible or otherwise non-compliant with any aspect of these Official Rules. In the event of forfeiture, no prize will be awarded and Sponsor will select an alternate winner, provided sufficient time remains prior to Event. Unclaimed, unverified Sweepstakes prizes as of 9/05/03 will not be awarded, notwithstanding any other provision in these Official Rules. Any portion of a Sweepstakes prize not accepted by a Sweepstakes winner will be forfeited. No substitution or transfer of Sweepstakes prize permitted. 13. SWEEPSTAKES PRIZE:
Each potential Sweepstakes winner whose Prize Documents have been verified and who has complied with these Official Rules ("Sweepstakes Winner") will be eligible to participate in an event scheduled to take place on 9/14/03 in Orlando, Florida and currently anticipated to be broadcast on live television (the "Event"). Each Sweepstakes Winner will receive a Sweepstakes prize package ("Sweepstakes Prize") for one person consisting of: one (1) round trip coach air transportation from an airport near Sweepstakes Winner's residence within the U.S. (airport, carrier and itinerary to be determined by Sponsor) to Orlando, Florida for Sweepstakes Winner ONLY (or ground transportation if such winner resides in or near Orlando) to attend Event; two (2) nights standard single occupancy accommodations; ground transfers in Orlando to and from airport, hotel, Event location(s) and planned activities organized by Sponsor; $100 spending money awarded on site at Orlando to Event attendee; and participation in the Event to play for a chance to win the prizes described in Rule 15. Approximate retail value of Sweepstakes Prize, excluding participation in the Event, is $1,700, depending upon winner's point of travel origin. Date and location of Event subject to change at any time. All travel must be taken on dates specified by Sponsor; no alternate travel dates available. No responsibility is assumed by Sponsor for any travel delays or travel cancellations. Any meals, taxes, tips/gratuities, incidental expenses and room charges not specifically included in Sweepstakes Prize as determined by Sponsor, are the sole responsibility of Sweepstakes Winner. A credit card is required for hotel check-in. A form of government-issued photo identification is required for air travel and Event registration. Any difference between stated approximate value and actual value of Sweepstakes Prize will not be awarded. Sweepstakes Winner will be solely responsible for all taxes on Sweepstakes Prize and will receive an IRS Form 1099 for the retail value of Sweepstakes Prize. 14. ATTENDANCE AT EVENT:
Each Sweepstakes Winner must be present at the Event to participate for a chance to play for the One Million Dollar Prize and the One Billion Dollar Prize (each as defined in Rule 15). If Sweepstakes Winner is unable to travel to and attend Event, he/she can appoint an authorized "designee" 18 years of age or older (or age 19 years or older in NE and AL) to appear at the Event and play in place of and on behalf of such Sweepstakes Winner. If Sweepstakes Winner is a minor (under the age of 18, except residents of NE and AL under age 19), the parent or legal guardian of such minor must appoint an authorized designee (such as himself/herself or another person who is not a minor) to take minor's place and travel to and participate in Event (see Rule 15). Appointed designee must be approved by Sponsor, must meet eligibility requirements set forth in Rule 18, and must sign and return all required travel and participation releases and other documentation as requested by Sponsor for receipt on or before the due date specified in the Prize Documents to be eligible to serve as a designee ("Designee"). Sweepstakes Winner's decision on appointing a particular Designee, once confirmed in writing, is final and cannot be changed. No other persons aside from a verified Sweepstakes Winner or his/her Designee will be permitted to attend or participate in Event. A Designee will be playing solely on behalf of the verified Sweepstakes Winner and will not be playing on his/her own account or for his or her own benefit. As such, Designee will not be deemed eligible by Sponsor as a winner as a result of Designee's participation at Event; Designee will solely act as an agent of Sweepstakes Winner. Sponsor will have no liability to any Designee for any prize that is won at the Event as a result of Designee's participation in Event; Sponsor's sole obligation for any prize that may be awarded at Event will be to Sweepstakes Winner and not to Designee. Sponsor shall have no liability to any Sweepstakes Winner with respect to any claims based on decisions/selections made by his/her Designee in connection with the Event or otherwise. Failure of Sweepstakes Winner or Designee to attend Event and/or fail to report at the designated time and place on the day of Event will result in forfeiture of the opportunity to participate in Event and forfeiture of chance to win the One Million Dollar Prize and One Billion Dollar Prize described in Rule 15. 15. PARTICIPATION AT EVENT:Each Sweepstakes Winner at Event will have a chance (through the participation of Sweepstakes Winner or Designee) to play for one prize consisting of One Million Dollars ($1,000,000) which will be awarded at the Event (the "One Million Dollar Prize") and will have the opportunity to play for one prize consisting of One Billion Dollars ($1,000,000,000) (as further described in Rule 16, the "One Billion Dollar Prize"). Only one (1) One Million Dollar Prize will be awarded at the Event and a maximum of one (1) One Billion Dollar Prize is available to be won at the Event. It is currently anticipated that each Sweepstakes Winner or Designee in attendance at the Event will be required to select a unique six-digit number (from 000,000 to 999,999) at a designated time prior to the start of Event. If a Sweepstakes Winner or Designee fails to select his/her number at such specified time, he/she shall forfeit the right to participate in Event. All numbers selected will be recorded in a digitally signed database. The numbers so recorded in the database shall be the official numbers used to play for the One Million Dollar Prize and the One Billion Dollar Prize. A Sweepstakes Winner or Designee will not be permitted to select a number previously selected by another Sweepstakes Winner or Designee; Sponsor will randomly determine the order in which each Sweepstakes Winner or Designee selects his/her number. The number, once selected, is final and not subject to change. A "winning" six-digit number (the "Billion Dollar Number") will be randomly generated (through secure means to be determined by Sponsor and its Administrators as defined in Rule 18) subsequent to the selection of numbers by all Sweepstakes Winners or Designees. At the end of the Event, the Sweepstakes Winner with the number (through the participation of Sweepstakes Winner or Designee) which is closest to the Billion Dollar Number on the basis of criteria to be determined by Sponsor and announced prior to start of Event (such person, the "Event Winner" and such number, the "Winning Number") will win the One Million Dollar Prize. If the Winning Number is identical to the Billion Dollar Number (i.e., all six digits of the Winning Number are identical to, and in the same sequence as, the six digits in the Billion Dollar Number), then the Event Winner will also win the One Billion Dollar Prize (to be paid in ccordance with Rule 16). The One Billion Dollar Prize will be awarded only if the Event Winner achieves the winning criteria set forth in the immediately preceding sentence; otherwise, the One Billion Dollar Prize will not be awarded and neither Sponsor nor Insurer (as defined in Rule 16 below) shall have any liability to award the One Billion Dollar Prize under any circumstance. Additional details regarding game mechanics and other rules, procedures and conditions for participation in Event will be provided to Sweepstakes Winners immediately prior to Event. Sponsor may, in its sole discretion, disqualify any Sweepstakes Winner or his/her Designee at any time for any actual or attempted fraudulent activity or for failure to comply with the rules or procedures relating to Event. The Winning Number is subject to verification by an independent third party judge present at the Event. Any disputes regarding whether the One Million Dollar Prize and/or the One Billion Dollar Prize was validly won will be resolved by such third party judge, whose decision shall be final, conclusive and binding. The judge's decisions shall be made strictly in accordance with the Official Rules and any other rules and procedures put in place for the Event. Assuming 1,000 Sweepstakes Winners or Designees participate at the Event, then: (a) each Sweepstakes Winner's odds of winning the One Million Dollar Prize are 1 in 1,000; (b) each Sweepstakes Winner's odds of winning the One Billion Dollar Prize are 1 in 1,000,000; and (c) overall odds that the One Billion Dollar Prize will be awarded at the Event are 1 in 1,000. The One Million Dollar Prize and One Billion Dollar Prize are only available to be won at the Event and cannot be won directly in the Sweepstakes or on a game piece. In no event shall Sponsor be responsible for awarding more than one (1) One Million Dollar Prize or more than one (1) One Billion Dollar Prize. In the unlikely event of a tie (as determined by Sponsor) at the Event between two or more Sweepstakes Winners, the One Million Dollar Prize and, if applicable, the One Billion Dollar Prize will be divided equally among such Sweepstakes Winners. 16. FORM OF PAYMENT:The One Million Dollar Prize will be awarded as a one-time lump-sum payment by Sponsor to the Event Winner. If the Event Winner also wins the One Billion Dollar Prize in the manner described in Rule 15, such One Billion Dollar Prize will be awarded in the form of an assignment of Sponsor's rights under a prize indemnity policy (the "Policy") issued to Sponsor by an insurance subsidiary of Berkshire Hathaway, Inc. (the "Insurer"). The Policy shall provide for payment of the One Billion Dollar Prize over 40 years pursuant to the following payment schedule: $5 million per year for each of years 1 through 20; $10 million per year for each of years 21 through 39 and a lump sum payment of $710 million in year 40 (the "40-Year Payment Schedule"). The Policy shall also provide that the One Billion Dollar Prize winner, if any, may instead elect to receive a one- time payment of $250,000,000 (the "Lump Sum Option"), which represents the approximate present value of the amounts received under the 40-Year Payment Schedule calculated using a 4.5% discount rate. If the One Billion Dollar Prize winner, if any, elects the Lump Sum Option, such election must be made in writing to Insurer within sixty (60) days of the determination that such prize has been won; otherwise, such winner will receive payments under the 40-Year Payment Schedule. By participating in Event, participants, on behalf of themselves, their heirs, executors and assigns, agree that, in the event the One Billion Dollar Prize is won, Sponsor's sole liability shall be to assign the Policy to the winner of such prize who shall look solely to Insurer for payment under the Policy, and Sponsor shall have no responsibility or liability arising out of Insurer's failure to perform its obligations under the Policy. Each Sweepstakes Winner will be solely liable for any and all federal, state, local and other taxes associated with any prize(s) he/she wins, and Sponsor makes no representations regarding the tax liability associated with such prize(s). Insurer shall have the right to withhold any amounts required for the payment of applicable taxes. Event Winner is advised to seek counsel regarding tax liabilities associated with such prize.
17. GAME PIECE/CODE VERIFICATION:
All game pieces submitted by mail become the property of Sponsor and will not be returned or acknowledged. All game pieces and Codes thereon are subject to verification at the sole discretion of Sponsor. Anti-fraud detection devices may be used for verification purposes. Game pieces will be void if they fail to pass anti-fraud detection measures, or if determined by Sponsor in its sole discretion to be any of the following: duplicated, photocopied, reproduced, forged, defaced, disassembled, tampered with, mutilated, cut, torn, partially or entirely erased or blank, smudged, altered from the form in which it was issued (i.e., cap liner removed or missing on a bottle cap game piece), unreadable, illegible, stolen, unissued, unauthorized, illegitimately obtained (i.e., through means other than mail-in request pursuant to Rule 4 or retail purchase), or if they fail to contain special markings, inks and/or security codes that may be applied by Sponsor at the time of production, or if they contain an unauthorized message, code or other marking not issued by Sponsor for use in this Sweepstakes game, or if defective or if they contain printing or other mechanical errors or are printed or produced in error. No entry will be valid if such entry is associated with any Code deemed void for any reason, including without limitation, the following: (a) Code is not verified or recognized as a valid Code issued by Sponsor in the Sweepstakes game; or (b) Code is determined to be previously entered and used; or (c) Code is incorrectly or incompletely entered or submitted; or (d) Code and/or corresponding game piece is otherwise void. Sponsor shall have no obligation to the holder of any void Game Piece. Notwithstanding the foregoing, Sponsor may, at its sole discretion and without obligation, elect to replace an illegible game piece with another randomly selected game piece if appropriate upon request, while supplies last. Sponsor reserves the right to inspect and examine any illegible game piece prior to issuing a replacement. Replacements shall be issued at Sponsor's sole discretion and may be denied in the event of non-compliance with these rules. Sponsor may change its policy or set limitations and restrictions on replacements at any time and without notice. Except as expressly stated above, Sponsor shall have no liability or obligation with respect to any void game piece. 18. ELIGIBILITY:
Sweepstakes game open only to legal United States residents residing within the fifty (50) United States or District of Columbia throughout the Sweepstakes Period. Void elsewhere and where prohibited by law, and in Puerto Rico, U.S. Virgin Islands, and U.S. military installations located in a foreign country. Employees, officers, directors and agents of Pepsi-Cola Company, Pepsi-Cola Company bottlers, WB Network, Yahoo! Inc., Berkshire Hathaway, Inc., Sullivan Compliance Company, Diplomatic TV and their respective parents, subsidiaries, divisions, affiliates, distributors, suppliers, and the advertising, promotional or judging agencies or other parties involved in any aspect with the creation, production, operation, execution and fulfillment of the Sweepstakes game of Event (collectively, "Sponsor and its Administrators") and the immediate family members (parent, child, sibling or spouse of any of the foregoing) and household members of such individuals (whether related or not) are not eligible to participate in the Sweepstakes game or the Event. No groups, clubs or organizations can participate in this Sweepstakes game or Event or submit entries on behalf of the group, club or organization. 19. YAHOO! ACCOUNT HOLDER INDENTITY:
All valid Codes submitted into an Account will be associated with an entry in the name of the holder of the Yahoo! ID used at the time of Code submission. In the event of dispute regarding the identity of the holder of the Yahoo! ID, dispute will be resolved in favor of the individual who is both the authorized holder of the Yahoo! ID and password associated with the Account (based upon information submitted at the time the Account was created or updated upon registration for this Sweepstakes) and, if available, the "authorized e-mail account holder" of the "alternate e-mail address" provided when the Yahoo! ID was created. "Authorized email account holder" is defined as the natural person assigned an e-mail address by an Internet access provider, online service provider, or other organization (i.e., business, education institution) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If there is a discrepancy between the name of the person listed as the "authorized holder of the Yahoo! ID" and the "authorized e-mail account holder" of the alternate e-mail address provided when the Yahoo! ID was created, that Yahoo! ID will be disqualified and an alternate potential winner will be selected. Potential Sweepstakes Winners may be required to provide proof that he/she is the authorized Account holder as described above.
