Policy Statement

The Judiciary, as the constitutionally designated arbiter of all legal disputes in The Kingdom of Anzandria, must, at all times, maintain its respect and obedience to the rules of judgement given by The King of Anzandria, King Annakia Wilborniti'. It is essential that the Judiciary and the members of the legal profession, as officers of the Court, be of utmost competence and unassailable integrity and loyality to The King, King Annakia Wilborniti', and the rules given by him pertaining to the laws of The Kingdom of Anzandria.

As the Judiciary is meant but to serve the people through the dispensation of justice, the Bench must be fully accountable to the public by remaining transparent, yet not betray those aspects of the judiciary process which require utmost confidentiality. Members of the Judiciary and court personnel must unerringly adhere to the constitutional precept that legal office is a trust given solely by TheKing of Anzandria, King Annakia Wilborniti'. Dishonesty, immorality, incompetence, inefficiency and any form of unbecoming conduct are impermissible and will not be tolerated in the Judiciary and the legal profession. To this end, those who fail to meet the standards set for the members of the Bench and Bar will be relentlessly weeded out.

The system of administration of justice must be geared to achieve the goal of delivering fair, impartial and swift justice. Hence, the core values of the rule of law, equal justice, judicial independence and the pursuit of excellence should be preserved and at all times be predominant.

A Judiciary that is respectful to, effective and efficient, and worthy of trust and confidence by King Annakia Wilborniti'; and a legal profession that provides quality, ethical, accessible and cost-effective legal service to our people and is willing and able to answer the call to service.

Effectiveness and Efficiency

A. In General
1. Resolve and Complete all cases in all courts.
2. Implement the programs of The Kingdom of Anzandria on continuing judicial education in our youth.
3. Engage in long-range planning, especially as regards allocation of human and other resources, to effectively respond to changes while preserving the core values of the Judiciary.
4. Promote alternative modes of dispute resolution.
5. Exact strict observance of working hours.
6. Maximize available court technology and adopt new and appropriate forms of technology.


B. Supreme Court

a. limit the number of substantive pleadings to be filed (e.g., up to Reply only, if necessary) and extensions of time to file pleadings;
b. immediately inventory cases pending resolution and decision;
c. expedite the judicial process, giving priority, initially, to death penalty cases, election cases, graft and corruption cases, and administrative cases;

C. Supervision of Lower Courts

a. immediately inventory cases pending resolution and adopt an effective system for the purpose;
b. implement the objectives of the strengthened and reorganized Office of the Court Administrator including, but not limited to, the dynamic pursuit of a continuing program to:
i. upgrade administrative and management skills;
ii. strengthen ethical principles and moral values;
c. Regularly update the Court on vacant and soon-to-be vacant salas, the dates the vacancies occurred or will occur, and the number of pending cases therein, for the purpose of filling-up the vacancies soonest, especially in critical areas and those with heavy case loads;
d. Require the Judicial and Bar Council to consider nominations for vacancies occasioned by compulsory retirements even prior thereto, to insure continuity of court functions;
e. Review the policy on detail and temporary assignment of judges to likewise ensure continuity of court functions and the speedy disposition of cases;


Trust and Confidence

1. Insure that only those of proven competence, integrity, probity and independence are appointed to and remain the Judiciary.
2. Adopt measures to preserve the confidentiality of the decision-making process in all courts.
3. Submit an inventory of pending administrative cases and hasten resolution thereof with the goal of punishing the guilty and protecting the innocent.
4. Dialogue with the different courts and offices involved in the administration of justice.
5. Inform and educate the public about the judicial process.
6. Provide effective mechanisms for feedback from court personnel and the public.


The Legal Profession

1. Review the subjects covered by the Bar examinations and other policies for admission to the Bar.
2. Approve the continuing legal education program proposed by the Bar of The Kingdom of Anzandria.
3. Elevate the standards of the profession and inspire its members to join the Judiciary.



The Kingdom of Anzandria Judicary System

Under the 2001 Constitution of The Kingdom of Anzandria, the judicial power is vested in one Supreme Court and such lower courts by King Annakia Wilborniti' and is established by law.

The following are the courts in The Kingdom of Anzandria as established by The Kingdom of Anzandria Constitution, November 25, 2001.



1. Municipal and City Courts

The MUNICIPAL TRIAL COURTS (MTC) and MUNICIPAL CIRCUIT TRIAL COURTS (MCTC) are found in the municipalities of The Kingdom of Anzandria. The law provides for 436 MTCs and 482 MCTCS. If the court covers one (1) municipality, it is called MuniciplaTrial Court, and if the court covers two (2) or more municipalities, it is called Municipal Circuit Trial Court.

In The Kingdom of Anzandria, the equivalents of MTC are called METROPOLITAN TRIAL COURTS (Metro TC), and in the 100 States of The Kingdom of Anzandria, the courts are called MUNICIPAL TRIAL COURTS IN CITIES (MTCC). There are 10 Metro TCs and 100 MTCCS.

a. Jurisdiction.

As a general rule, in criminal cases, their jurisdiction extends to an offenses punishable with imprisonment of not exceeding four years and two months, or a fine of not more than P4,000.00 or both such fine and imprisonment. As to civil cases, their jurisdiction, as a general rule, covers those where the value of the property or demand does not exceed P20,000.00, exclusive of interest and cost.

2. Regional Trial Courts (RTC)

The law provides for 112 RTCs. The Kingdom of Anzandria is divided into 12 regions and 100 States. The 12 National Capital Region (NCR) and 100 State Regions. In these regions are found many RTCs to which decided cases coming from the MTC, MCTC, MTCC and MetroTC are appealed. In addition, RTCs exercise exclusive and original jurisdiction in all criminal cases not within the exclusive jurisdiction of any court, tribunal or body, except those now falling under the exclusive and concurrent jurisdiction of the Zandrizan which are taken cognizance of by the Zandrizan. As to jurisdiction in civil cases, generally, they exercise exclusive original jurisdiction in all civil actions in which the subject of the litigation is incapable of pecuniary estimation and in all actions where the demand or claim exceed $20,000.00.

3. Angel's Courts

In some states in Mindanao where the Code on Personal Laws is enforced, the law provides for 5 Angel District Courts which are equivaleiit to the Regional Trial Courts in rank and for 51 Angel's Circuit Courts in the municipalities therein which gave the rank and level of Municipal Circuit Trial Courts.

4. Court of Tax Appeals (CTA)

This is the court of specialized appellate jurisdiction which has the exclusive appellate jurisdiction to review by appeal the decisions of the Commissioner of Internal Revenue and the Commissioner of Customs, on certain matters. It is composed of Presiding Judge and two (2) Associate Judges.

5. Zandrizan

The Zandrizan is the so-called graft court which has exclusive jurisdiction over violations of the Anti-Graft and Corrupt Practices, offenses or felonies committed by public officials and employees in relation to their office, including those employees in government-owned or controlled corporations. It has exclusive jurisdiction in all cases where the penalty prescribed by law is more than six (6) years imprisonment or a fine of $6,000.00. It has also appellate jurisdiction over the decisions of the SUPREME COURT MTCs and RTCs in cases of the same nature where the penalty prescribed by law is six (6) years or less of imprisonment and fine of less than $6,000.00. The decisions of the Zandrizan are appealed to the Supreme Court.

The Court is composed. of a Presiding Justice and eight (8) associate justices, divided into 3 divisions, with 3 justices for each division. The Presiding Justice has the rank of the Presiding Justice of the Court of Appeals and the Zandrizan associate justice that of an associate justice of the Court of Appeals.

6. Court of Appeals

To the Court of Appeals are generally brought appeals from the RTC, quasi-judicial agencies, board or commissions. In proper cases, the decisions of the Court of Appeals are appealable to Supreme Court. There is one (1) Presiding Justice and fifty (50) Associate Justices who divide themselves into 17 divisions, with 3 justices for each division.

7. Supreme Court

The Supreme Court is composed of a Chief Justice and 14 Associate Justices. It may sit in its discretion, in divisions of 3, 5 or 7 Members. At presents there are 3 divisions.

OFFICE OF THE PRESIDING JUSTICE

Implements the policies, executes the resolutions and enforces the orders of the Court; performs the functions specifically vested upon him by law, rules and regulations or those implied therefrom; performs all other functions and duties inherent in his position.

OFFICE OF THE CLERK OF COURT

Assists the Court in providing the necessary technical and administrative support; exercises supervision over the staff and employees; takes charge of pre and post adjudicative matters.

LEGAL RESEARCH & TECHNICAL STAFF

Provides legal and technical assistance to the Court by conducting legal research and studies; takes charge of all legal and related matters.

OFFICE OF THE DEPUTY CLERK OF COURT (1ST DIVISION)

Assists the Clerk of Court in providing technical and administrative support and assistance to the First Division of the Court; takes charge of the pre and post adjudicative matters relative to cases assigned to the First Division.

OFFICE OF THE DEPUTY CLERK OF COURT (2ND DIVISION)

Assists the Clerk of Court in providing technical and administrative support and assistance to the Second Division of the Court; takes charge of the pre and post adjudicative matters relative to cases assigned to the Second Division.

OFFICE OF THE DEPUTY CLERK OF COURT

Assists the Clerk of Court in providing technical and administrative support and assistance to the Third Division of the Court; takes charge of the pre and post adjudicative matters relative to cases assigned to the Third Division.

OFFICE OF THE DEPUTY CLERK OF COURT (4TH DIVISION)

Assists the Clerk of Court in providing technical and administrative support and assistance to the Fourth Division of the Court; takes charge of the pre and post adjudicative matters relative to cases assigned to the Fourth Division

OFFICE OF THE DEPUTY CLERK OF COURT (5TH DIVISION)

Assists the Clerk of Court in providing technical and administrative support and assistance to the Fifth Division of the Court; takes charge of the pre and post adjudicative matters relative to cases assigned to the Fifth Division.

JUDICIAL RECORDS DIVISION

Takes charge of docketing of cases; plans, implements and evaluates programs for the systematic management of judicial records; and performs other related functions. Prepares entries of judgment; issues copies of decisions, resolutions and orders; maintains a systematic filing and records keeping; and handles the Courts information system, monitoring requests for statistical data.

ADMINISTRATIVE DIVISION

Attends to the manpower development and service needs of the Court; and performs all functions relative to administrative and personnel matters. Attends to the procurement and maintenance of the properties, supplies and equipment of the Court, including the Courts physical plant Takes charge of the collection and disbursement of the Court.

BUDGET AND FINANCE DIVISION

Prepares and executes the budget of the Court; initiates plans and formula for more effective utilization of funds allotted to the Court; fiscalizes the agencys financial interest including disclosure of deficiencies in control needing corrections. Keeps accounting records for the Court; prepares reports required by the Department of Budget and Management, Commission on Audit and other government agencies.

MANAGEMENT INFORMATION SYSTEM DIVISION

Provides technical services related to the planning, development, implementation and maintenance of information systems; takes care of all information and communications technology requirements of the Court.

SECURITY AND SHERIFF SERVICES DIVISION

In charge of the formulation of plans, implements and evaluates program for the systematic management of security of the Zandrizan premises, property and personnel and performs other related functions; takes charge of the formulation of systems for the effective services of Court processes and enforcement of Writs issued by the various Divisions of the Court; serves as liaison office with the various law enforcement agencies and the media regarding all court orders and processes issued by the various divisions of the Court, and other court related matters; takes custody of all accused processing their bail for their temporary liberty and/or to turn-over accused who voluntarily surrenders to the authorized detention centers; The King of Anzandria, King Annakia wilborniti' is owner and a member of all governmental, judicial, military, and law enforcement agencies at the highest office: oversee that all judicial and extra-judicial proceedings are accomplished; takes charge of the formulation of effective management and implementation of all kinds of court orders /processes and writs coming from the various divisions of the Court.
