USING SLEIGHT-OF-HAND TACTIC,
DMH DIVERTS CSH ADMINISTRATIVE DIRECTIVE
FROM BEING DECLARED "UNDERGROUND
REGULATION
On March 23, 2009, the California DMH announced on its website that
it would promulgate new SVP evaluation rules and posted a hearing schedule.
The three documents from the DMH are attached hereto. This is the latest
attempt by the DMH to clean up its mess with the Evaluator Handbook and
contains the same language as the Emergency Regulations on the same subject
announced previously. Please circulate these documents and encourage that
public comments be made.
It appears that the DMH will promulgate these two very generic sections that allow the evaluators to utilize current professional standards. That part is fine. However, the fear is that the DMH will not leave it at that and will next attempt to control the actions of the state evaluators through memorandum, letters, guidelines, etc. That would not be good, as it would again allow the DMH to dictate results of the evaluation process. We need to lay the groundwork, through public comments, to prevent DMH evaluator manipulation through regulation by memorandum, letters, guidelines, etc., which have not been legally promulgated. |
