It appears that the DMH will promulgate these two very generic sections that allow the evaluators to utilize current professional standards. That part is fine. However, the fear is that the DMH will not leave it at that and will next attempt to control the actions of the state evaluators through memorandum, letters, guidelines, etc. That would not be good, as it would again allow the DMH to dictate results of the evaluation process. We need to lay the groundwork, through public comments, to prevent DMH evaluator manipulation through regulation by memorandum, letters, guidelines, etc., which have not been legally promulgated.
