If you are eligible for one of the following programs, and if you complete the program successfully, the charge(s) will be dismissed and will not go on your state driving record.
Civil Penalty
If a defendant has no offenses on record for three years (or one year for violations, “Civil Penalty Dismissals” are available. Civil penalties shall be: $155 for violations or $180 for misdemeanors
Adult Probation
Adults are eligible for probation with one or zero moving violations or Class C misdemeanors within three years and one or zero tickets with non-moving-offense convictions (regardless of how many) within three years. The fee for adult probation shall be the same amount as the fine.
Juvenile Probation
Persons under the age of 18 are eligible for probation, but they must appear in court. Generally, Teen 1 is available to minors who have received their first moving offense of Class C ` misdemeanor or below, and Teen 2 is available to minors who have successfully completed Teen 1, or its equivalent, and have received their second moving offense of Class C misdemeanor or below. Teen 1- Probation fee shall be $105 plus, if applicable, the fine amount that would be due for any other guilty finding (e.g., add $30 for seat belt or $105 for child restraint). Teen 2 - Probation fee shall be $180 if for second offense within one year, otherwise it is the amount of the fine. |
